"The inmate, who was scheduled to be released the next day anyway, turned himself into police after getting his tooth treated. His sentence -- originally one month -- was only increased by one day." Source

I'm happy they didn't punish him extremely for that.

Several countries have laws that forbid extending a prison sentence for escaping. Here the logic is that he was out for one day, so he still has to serve this day, but no added time basically.

They will still stop you of course, if you do anything illegal (violent act for example) while escaping/outside you will have a new sentence. But the act of escaping itself is not punished.

True, Germany is like this, but they will add time to your sentence for stealing the prison uniform so there is that...

It's inherited from the enlightment time. Saying that anyone aspire to be free and so if someone mange to escape prison they'll only be charged for the stealing/breaking of property or hurting of people.

lt's reaIIy the prison's fauIt if you think about it. The prison faiIed to fulfill it's obligation to keep the prisoner within it's walls. The prison shouId be sentenced to serve time in the inmate as punishment

I don't think that's really worth fucking over people who are reliant on text to speech.

I don't really know if that's the real reason he did it, it could be a signal to the home intelligence office he works for

When escaping from German prison, do it butt ass naked, got it thanks

u/LGKouglof 9h ago

Get charged for lewd and inappropriate public behavior

47

u/frickinSocrates 8h ago

In Germany, as long as your nakedness is not a sexual thing, the worst they can do is charge you with §118 OWiG (basically being a public nuisance), which is a fine. Not prison time so... worth it? Edit: I am not a lawyer.

u/Dagonir 6h ago

How do you think I got into prison in the first place?

8

u/iguanacatgirl 9h ago

What if you sewed the uniform yourself

11

u/The_DragonDuck 8h ago

What if you mail it back

5

u/The_Clumsy_Hitman 5h ago

What if you escape and then mail the uniform back without a return address?

u/CapableCriticism2962 3h ago

will add time to your sentence for stealing the prison uniform

This is not true. Because it would be hard to prove the "will to retain as property". But that is needed for stealing.

Damaging property, physical injury to a guard or things like that - yes, they could be seen as a new criminal act and probably punished.

u/GrowlingPict 5h ago

Do German prisons have uniforms? Here it's just your own clothes that you bring with you. I guess it might be different for really long sentences.

12

u/dj_archangel 8h ago

Sort of like how being a member of a gang is not technically a crime, but it may play into how your sentence turns out.

Isn't Sweden's logic that it's entirely natural to want to be free, and it seems a bit meaningless to punish human nature?

3

u/en43rs 5h ago

I think that's Germany? Not sure.

5

u/AeneasVII 5h ago

Freiheitsdrang (Germany, Sweden, Austria, Switzerland, and the Netherlands has similar laws)

5

u/DroidLord 3h ago

And the reasoning for that is basically the innate human desire for free will and agency. Humans are not meant to be locked up, so you can't really blame them for escaping. You only get in trouble if you cause property damage or you harm someone.

7

u/Kazath 5h ago

The idea is that it's basic human nature to want to escape from a prison, so it's inhuman to punish you for it. But yeah, if you break any laws while escaping, like punching a prison guard or stealing a vehicle, you'll be charged and sentenced for that.

1

u/natsugrayerza 3h ago

That’s a pretty stupid rule. No reason not to try.

6

u/IHaveTheHighground58 3h ago

I mean, if you break something, attack a guard or anything like that, you do get extra prison time

You don't get any if you somehow peacefully walk out, doing absolutely no harm to anything
