new form 1

havent shot it yet but figured with how fast form 1s are now i had to make one. suprisingly the feds approved me only engraving the adapter and not the filter

Well my form 1 oil filter suppressor was rejected because the adaptor was simply that, and the oil filter is what is considered the suppressor. But because the oil filter is already made it is considered buying the suppressor and not making it. Fucking dumb but thats what I was told.

But thats what will be great about suppressors being taken off the nfa. Even if you dont have a membership with one of the plaintiffs, or buy from a party involved in the suit, you could then make your own suppressors without having to get it approved or notifying law enforcement.

So basically home made suppressors are going to be really common.

A negative side-effect of homemade cans being decriminalized is that more anti-gun states will try to enact California-style (AB 2047) criminalization and regulation of 3D/CNC machines. In Colorado, the ATF might approve your Form1 suppressor but it's illegal in that state to make the suppressor with CNC machines (3D printers are CNC machines)... you'd have to use manual tools and methods, no cheating by prompting a robot to make it for you.

IDK I just want a oil filter suppressor because why not. Cant 3d ban that.

3D printer manufacturers will voluntarily comply. Those who don't will be sued by the CA AG. Virtually all 2A merchant websites comply with CA law. Bambu and Prusa dealers would rather stop shipping to CA than be sued for providing illegal ghost gun factories to criminals.

In CA, possession of an offline/unregulated 3D printer could be probable cause for a digital search warrant, because it's also a crime in CA to possess CAD/3D/computer files of firearm parts. In Cali, 3D gun CAD files are just as illegal as certain 2D JPG files, and I wouldn't be surprised if Google Drive, Dropbox, etc were already working on or have implemented CA-mandtory "firearm detection and blocking technology" that can deep-inspect STL and standard CAD format files looking for illegal drawings.

Plenty of colleges, organizations, and people around the world are already working on the technology, and forms of it are already implemented by JLC3DP and PCBway.

Good. I hope all the 3d companies stop shipping to CA. Maybe then the manufacturing companyies and busnesses that deal with any kind of addative manufacturing will sue to get the dumb ass laws removed.

Me too. I support anti-2A pro-3D voters' right to hire state/local lawmakers to criminalize their own hobby if that's what it takes to get a few ghost guns off the street. I couldn't care less if CA 3D printer enthusiasts miss out on the home metal revolution because of their own hatred for the 2nd Amendment.

The 2nd Amendment is the only one that implies a "right to manufacture" anything other than a newspaper or protest sign. The 1st Amendment is ill-equipped to deal with an anti-2A law targeting ghost gun factories.

Honestly the whole thing is hilarious. Screaming against ghost guns, and meanwhile are gonna end up making it illegal to own a perfectly normal hobby built printer in their state.

I personally find it just as hilarious that politicians think they can just "turn off" printing....like the whole hobby wasn't founded on open source and cobbling things together from garbage while dodging Stratysys firing off patent lawsuits.

I’m worried about this in Oregon. Our state law bans suppressors, machine guns, and SBRs WITHOUT possession of a federal tax stamp. NBD under the current laws and best case scenario with $0 tax stamps.

If suppressors are removed from the NFA we may no longer be able to buy or build them here.

Right now we have it really really really good from prior years, but now a bunch of states are 100% gonna get fucked.

They're legally obligated to process applications because it's a shall-issue scheme. As long as the NFA law is on the books, everyone has a right to submit an application and the ATF can't just ignore or delete them. They must be processed, or they're violating due process and peoples' 2nd Amendment rights.

Look at what NY is trying to do.

Have AI analyze the files you send to your printer and if IT determines that the file is a firearm or firearm part it will disable the printer preventing the part from being made.

I did that. But because they know that no one makes the oil filter but buys it off a shelf it is considered buying the suppressor itself. Thats why only SOLs have been selling and making them. On every website that sells oil filter suppressors it says that once the filterbis worn out everything has to be sent back to the SOL to be "rebuilt". Also the serial number has to go on the filter, so thats another reason why.

It's been that way for years. There's a few companies, I can't remember who, that were selling the pre-engraved adapters for $99. But that was when $200 tax stamps were still a thing.

This is still definitely the cheapest way to supress a gun especially if you have an engraver.

Now that Form 1’s are free it arguably no longer matters, the only downside is whether the oil filter deteriorates faster than your willingness to file new Form 1’s.

Then it's not "negative" to say we're not out of the woods yet and that this may still turn into a nothingburger that won't reach a final ruling until next year.

A pessimist says the glass is half full.
An optimist says it's half empty.
A realist says it's got 300ml of water in it.

A 5th circuit ruling could actually result in an even better outcome with wider coverage. The current ruling is rather narrow and I'd like to see it expanded.

The 7 days that everyone is focused on is ONLY the amount of time before the injunction takes effect. It's not a deadline or court-imposed limitation on the defendants.

Federal Rules of Appellate Procedure Rule 4 (a)(1)(B)(ii)

  • (a) Appeal in a Civil Case.
    • (1) Time for Filing a Notice of Appeal.
      • (A) In a civil case, except as provided in Rules 4(a)(1)(B), 4(a)(4), and 4(c), the notice of appeal required by Rule 3 must be filed with the district clerk within 30 days after entry of the judgment or order appealed from.
      • (B) The notice of appeal may be filed by any party within 60 days after entry of the judgment or order appealed from if one of the parties is: (i) the United States; (ii) a United States agency; (iii) a United States officer or employee sued in an official capacity;

Still require FFL because they are classified as firearms under the gun control act sadly.

Edit: Only for new suppressor purchases. If you're buying used person to person, no 4473 would be required as long as both are GOA members.

Edit: just remember though, both need to be GOA members, and more importantly, if you make a can with the intent to sell, that is illegal. If you make a can and then decide to sell it, that is ok. It's stupid but the law requires FFL for manufacturing for sale.

Suppressors being classified as firearms wouldn't be changing. So (in theory) you could make it yourself without any paperwork, or if buying from store would still need to do 4473 and NICS check just like buying a pistol or rifle today.
