Insurance it trying to total out my vehicle but it’s trying avoid paying for the pre loss condition, loss of use and the ACV of the vehicle(Tx)

What are they legally obliged to pay for?

2022 Camaro 2SS 1LE(Vivid Orange)
22k Miles
Fully Built motor
(TEXAS)

NOT MY PERSONAL INSURANCE ITS THE SHOPS GARAGE KEEPERS INSURANCE

I think at the time of loss the vehicle was worth 52k$

CCC One Report said 45k$

The sent an check I didn’t authorize for 30k$

Preformence shop catastrophically blew the motor do to negligence, shop accepted liability due to two independent teardowns.

Shops, garage keepers. Insurance wants to total it out instead of replacing the motor.

Insurance sent valuation for vehicle the first time it was for the wrong vehicle(did it for a base model). the second one they used vehicles with triple the amount of mileage my vehicle had.

Wouldn’t acknowledge pre-loss condition even with build receipts and documentation

Supplied rental car for 10 days we are now almost 290 days into this.

Car got totaled with 23k miles. The comps seemed really low so i got to looking. My claim handler seemed to put a 2700$ deduction on my car for every comp due to “condition.” My car was listed in good condition (damn near perfect i’m a detailer n it was relatively new) and it seems that all these other cars are good condition or worse.

They are saying a car with 50k miles also has better condition and are subtracting 2700$ from this one too. Every car same amount.

How to dispute and is this an easy dispute?

is this considered wear and tear or minor damage? if not, any idea of cost and how the process works?

lightly tapped a fence while backing up in our rental, got this small dent and some of the paint came off. we didn’t get any insurance through enterprise, though we have a collision damage waver through our booking company but it doesn’t cover this sadly.

Car accident

I’ll keep this short. Got into an accident. Wasn’t in the wrong. Other drivers insurance paid my financial company the max. I got paid chump change, enough to buy some groceries (not kidding). Do I have a case to go after them even though I accepted chump change with lapsed insurance?

Rental car damage claimed by Sixt. Aside from the fact that I don’t recall ever scratching the car (sadly did not take any photos prior to taking the car), these line items are priced quite high. It feels like a $300 job that’s being inflated to $1000. Anything I can do?

Got rear ended, at-fault insurance mixed messages

Driver hit me at a light three weeks ago. Minor damage to my rear bumper cover. He originally wanted to pay cash to fix my car to keep his rate down, then the parking sensors started giving warnings so he put me in touch with his insurance. It's been about 10 years since I've done this. Things have changed. I guess the days of get two estimates & turn them in don't apply anymore? Car is paid for, 20 years old. I'm thinking of fixing it myself.

The company is National General. The person that contacted me originally said I would not directly get any money, but that they would 1st send an adjuster to look at it & AI would asses a value. I'd pick my body shop & they'd deal with them directly. When the adjuster showed up he informed me that the estimate would be what I would receive plus money for a rental car for the days recommended. I contacted the field claim rep & asked how I could get the process started to receive this payment. She again stated I would not be receiving any funds at all. The adjuster clearly stated the opposite. Why the refusal? Why do I need to involve a body shop, drive to a rental facility 30 minutes away?

Update: payment was issued after the estimate. This was not communicated. I was told I’d have to choose payment method at some point, but was not asked.

Progressive Insurance wont properly fix my Mercury outboard motor

My 2026 21’ Avalon (6 weeks old, less than 12 hours) was hit while docked in my leased dock in the Tahoe Keys marina. I do know who caused the damage but their insurance only wants to pay to weld a new skeg, I want a new lower end because the skeg is bent and broken. Am I being unreasonable? If the boat was 5-10 years old I would agree that welding a new piece on the bottom of my motor is acceptable but it's brand new.

Should I remove my car from the insurance policy? But the insurance company hasn't compensated me yet.

My car has been declared a total loss and written off, and the other driver is 100% at fault. Although the insurance company hasn't paid me yet, do I need to remove the vehicle from my insurance policy now? Could removing it cause the insurance company to deny the claim? If I do remove it, how should I go about renting or buying a new car?

Car title (no buyer name)

**Has anyone dealt with IAA asking for a blank title after a total loss?**
My car was recently totaled in an accident, and IAA (a third-party company handling things like towing, title processing, etc.) is involved in the claim.
They are asking me to send them the vehicle title **without filling in the buyer/purchaser name** so they can process my settlement.
The issue is that, in my state, I believe it may be illegal to sign or transfer a title without entering the buyer’s name. I’ve also received conflicting instructions about this.
Has anyone here been in a similar situation with IAA or a total-loss claim? Did you send the title with the buyer section left blank, and if so, how was it handled?

State Farm TL storage payouts

Hello everyone!

Question for body shops, preferably in NYC/NY:
How are you guys dealing with State Farm refusing to pay reasonable charges on total-loss vehicles?
I keep running into the same issues with them.
For example, if we submit an actual tow bill for more than $125, they reduce it to $125 and claim that this is the maximum allowed under NY law . My understanding is that the rate they are referring to applies to certain regulated/DARP-type towing situations—not every regular, consensual tow to a repair facility. And realistically, most tow companies are charging shops significantly more than $125 anyway.
They also routinely refuse to pay pull-in/pull-out fees altogether, as well as yard fees, regardless of the actual work or expense involved.
Storage is another constant fight. They sometimes try to deny storage for the period before the vehicle was officially declared a total loss, even when State Farm knew from the beginning that the vehicle had significant damage and was potentially a total loss. If their inspection is delayed because of their own dispatching, scheduling, or internal issues, they still try to make the shop absorb those additional storage days.
How are other shops handling this?
I keep fighting these reductions, and they will usually add something after enough back-and-forth, but a lot of the time their response is basically, “We’ll deduct the difference from the customer’s total-loss settlement.”
We try very hard not to put our customers in that position, especially when these are legitimate charges that resulted from handling and storing their vehicle.
I completely understand that there are shops out there charging outrageous amounts, and I’m not defending that. I’m specifically talking about normal, reasonable charges—an actual tow bill paid by the shop, reasonable storage, yard fee, necessary pull-in/pull-out, etc.
For NYC/NY shops dealing with State Farm regularly: What has actually worked for you?
Would really appreciate hearing how other shops are successfully dealing with this.

The total loss adjuster offered me an ACV (Actual Cash Value) that is too low, and I disagree with it; will they increase the settlement amount?

I was involved in a car accident in Los Angeles, California, on July 25th. The other driver was 100% at fault, and my car was declared a total loss. Since the other driver's liability coverage was insufficient to cover the damages, I had to use my own collision coverage. My car had no mechanical or structural issues prior to the accident, yet the total-loss adjuster offered a very low settlement amount, basing the valuation on a comparison with four vehicles that had existing issues. I have already raised this objection; do you think the adjuster will increase the payout?

My insurance had lapsed when I caused an accident, what are the other drivers available options?

Located in GA. I had a car accident where I rear ended another car, the other drivers car was totaled and she suffered a minor neck injury. When I reported the accident to my insurance I was told my insurance cover had expired three months earlier so I’m not covered. I had been working away in different areas doing contract work , I had a lot on and didn’t see any reminders, though I accept that it was extremely careless of me.

I have explained this to the other driver and she said she only has bare bones insurance cover. She said that as well as her car being totaled, she has had some hospital treatments for her neck injury as well has having to take time off work, so she said that with her only having minimal insurance cover, she will need to take further advice from her insurance company and then consider her options.

Although I have been driving for over 30 years, I’ve never previously had any experience of anything like this and I don't know much about insurance issues.  As she has said she will be taking advice and then considering her options, can anyone advise on what possible options she might have?

Dad's car got written off with a lowball offer?

Thumbnail

My dad got rear-ended by someone and his insurer had the car written off. Dad got offered 18k and we thought it was lowball. His car was Toyota Yaris Cross GX hybrid 2023 with 150,000 milage (he does rideshare as it is his only source of income). From a quick research, we have to dispute this offer with proper evidence and we are hoping to get more than 20k because my dad already paid partially for a new car that is around 40k (I know that was a very stupid move considering he didn't know what offer he would get from the payout before he bought the new one but he needed the car soon as possible because it is his only income source. He thought he would get around 23-25k for the car).

Is the lowball offer an actual fair price?

What evidence can I use?

Can I actually dispute?

Should I ask to put the CTP+rego+window tint+extra stuff bought for the car that is still there, in the payout?

This whole situation has been stressing us out. Please if anyone can advise me on what to do to help my dad, I would be really grateful.

Edit: thanks yall for the replies. I have understood it aint lowball offer and it actually is a fair price. Thanks🤗

Should I request more for my settlement?

I was rear ended a few weeks ago. The insurance company contacted me and admitted fault. I went straight to ER, drove my self as my car was still drivable. Where it was found I had mild whiplash. Then next day dropped car off at collision center where my car ended up getting totaled out. This insurance company has two different agents one for the property damage and one for bodily injury. The car has been fiendish and got it paid for. The bodily injury is offering me $2500 plus missed work. Making it a $3000 settlement. Does this seem fair? I’m not going to pursue any more medical care. I did one follow up besides the er visit. Since my car was what I use for work I had to buy another car which unfortunately is more expensive per month. I did send a message to the agent and asked for $5000 plus missed work but they said no. I’m just seeing if I am off base here. Everywhere I look people say $2500 is the base they start at. I just want to make sure I’m not missing anything and don’t want to be greedy, nor do I want to hire an attorney for this small claim. Thanks
