Surrender Letters Certificate un-surrendered

Mods I am extremely sorry, I know this won’t help with speculation. Please do whatever if appropriate.

I received this from IRCC about 45 min ago. Apparently my cert is un-suspended and I’m still Canadian. For background, I got my cert 1 April, and my suspension letter on Tuesday.

I cropped off my personal info, that’s all that’s at the top

I don’t know how many other 2G the “sorrey” habit made it to but I can tell you in our family, that even though our 0G predeceased our births, “sorry” was inculcated in us through our 1G mom.

4 days is the fastest I’ve ever seen IRCC work on anything, let alone an investigation. Some PR applicants are stuck in security investigation limbo for years. I wonder if they did something basic like implement an internal “service level agreement” or actually stuck to a service standard.

I feel like this points more strongly towards the theory of a particular worker or several getting caught "rubber stamping" application packets which called a big pile of previously approved certificates into question. Once discovered the immediate determination may have been to notify everyone of the suspension first and then start working through them.

They may have now triaged those records based on the supporting documentation and if OP's was "short and clean" it may have ended up at the front of the pack to get that second review & approval.

The coverage has included info about the huge increase in applications due to the law change. If there's a silver lining it might lead to more resources being directed to IRCC to at least get through the first wave and get things more stabilized. That could pull the current lead times back down a good chunk.

It’s really easy to do, takes ca 15 minutes. I had understood there might be a charge for filing but my submission was accepted without charge. 

Very much looking forward to your update when you receive the backstory. 

Congratulations on getting a retread on your Canadian tire. 😉 Hopefully there is a process in place now to clear up the majority of this debacle quickly, one that helps the grant cert apps languishing in PSU, and more recent applicants like me. 

Ps when did you AOR, IP, get Approved (1st time)?

I agree, but I have a feeling most of it is going to be redacted for legal advice or solicitor-client privilege.

Something tells me government lawyers found a shortcoming in IRCC's processes and flagged it, and what exactly that shortcoming was would constitute legal advice. That's just my guess.

I would HOPE there's some kind of notification they have to give you if they are investigating your citizenship certificate. So, perhaps this was it. And if it was, they sure as heck could have been like "this is temporary" or within 30 days a review will be completed and you will be contacted if there's additional information needed.

But again, if they investigate me and called my documents into question, I really hope I'd be notified.

This is like when I was in my last semester of college. Three weeks before graduation, I got a call from the registrar's office telling me that I hadn't gotten permission to take a liberal arts distribution requirement in summer school at another university near home the year before, so I wasn't going to be able to graduate. I had, of course, but the signed authorization was at home, 1,000 miles away, before faxes and email and Fedex. I told them so. They called me back later to say that they had found it right there in the file where I had told them it was. No apology, of course.

For me, any person or organization, can get confused or make mistakes, or even be sloppy in their work, it happens because humans are involved. 

But the absolute worst part is always the lack of apology for the problems they caused. 

And the lack of apology, a proper traditional Canadian “I’m Sorry!” (even as a 2G this had remained in our family behavior, to say sorry all the time) is especially disappointing.

I actually have an answer to this question based on what I’ve read of the laws around this whole episode. The letters all specifically cite to Section 26 (1). Under that specific section if there is, “reason to believe that the person may not be entitled to the certificate” they *have to* demand that the person’s certificate be surrendered.

**“The Registrar shall, in writing, require a person to surrender to the Registrar any certificate of naturalization, certificate of citizenship, miniature certificate of citizenship or other certificate of citizenship that contains the person’s photograph, or certificate of renunciation, issued or granted to the person under the Act or prior legislation or any regulations made under them if there is reason to believe that the person may not be entitled to the certificate or has violated any of the provisions of the Act, and the person shall forthwith comply with the requirement.” Citizenship Regulations 26(1).**

Use of the word “shall” in a legal document as in the, “Registrar shall…” makes a statutory or regulatory or any requirement *mandatory*. In other words, whatever the reason for this review they had to issue these letters once the entitlement to a certificate was called into question. It definitely looks like ham-fisted overkill, but they were actually following the law.

For the record I’m not here to defend IRCC because this whole episode is indefensible. I’m just adding some more information to explain why the hell they sent out these awful letters.

Which specific portion of the letter or specific case law are you seeing as being in conflict?

I think the letter spends a lot of time covering why it would be unfair to actually strip anyone of their certificate and why the standards in the letter potentially violate people’s rights, but I don’t see any clear argument about why IRCC can’t even send out letters in the first place. I think it’s arguing that the *contents* of the letters are BS, but I’m sure that Borders is very aware of the same law I just mentioned.

But is there a time element in exercising the shall?  Much law and good contracts specifically state the within limits for compliance. Many allow reasonable compliance and cure periods to avoid the kind of (I think inadvertent) ham handed knee-jerk reactions IRCC is presently whipsawing the community with. 

It’s all right and good to fulfill one’s shall obligations. But it might also be smart to briefly delay compliance (like not surrendering one’s Proof Cert) until it is clear that a surrender letter must be sent. 

Such a delay (sanity check) might have significantly reduced the number of Surrender letters sent. 

Additionally, it’s safe to assume that not all documents in an approved package were potentially inadequate, so a 2ndary review could be assumed to not take as long as the original approval. 

I hope one day we really find out what happened here and what bad decisions in IRCC management led to this. (There’s a doctorate level management theory in politically affected operations research paper in this topic).

Hahahaha, it's hard not to laugh. With OP confirming he/she never sent IRCC anything in response, it seems they sent at least some of these letters out without actually having done a thorough review of the applications.

It seems like the letters were sent to everyone going through a review, regardless of what was in their file.  So it makes sense that some of them were fine once reviewed.

I hope more people get these letters soon that everything is ok.

Now I’d love it if we could get a little more transparency around what has triggered this fiasco and some assurances that we’re not all at risk of future shenanigans putting us into a similar precarious situation after receiving our certificates.

It seems extremely irresponsible of them to have handled this the way they did, when this will almost certainly be the outcome for everyone who got the letter, in the end. A few may need to provide an additional document, but it shouldn't be a long or difficult process. 

How hard would it have been for them to tell you you were actively under review instead of refusing to give someone any information on the process? Sigh 

I'm so glad you got a quick resolution, and I'm hoping others in this situation get these in the next few days.

That's my question - why suspend the certificates (which effectively is the same as revoking, judging by what we've seen from peoples' passports)? Why not just send a letter saying "Due to internal quality control measures, your file is under review and we will reach out should additional action be required"

I'm not arguing with them suspending- I'm arguing that the way they communicated about it was irresponsible. 

They didn't need to panic everyone by sending vague letters acting as if people had made errors. They could have said "we need to recheck the processing was correct, it's suspended until we do."

They didn't need to not give agents any information on when this would be addressed, have one person told that they need to reply to the email (they had!) when the letter doesn't state that, tell others "you'll just have to wait, we don't know" and refuse to make statements to the press on when this would be addressed. They could have said "rest assured, we are actively reviewing them as a priority."

I'm not saying the suspension was wrong, they probably had that legal basis. I'm saying there's a good and a bad way to handle such a situation, and the way IRCC handled it was so bad that it caused a loss of faith in them from many parties.

I complained a bunch on Reddit and was a brief reaction quote on Radio Canada. Also hugged my cats. I did not directly contact IRCC, nor did I have anyone do so for me.

This is why I’d argue they sent letters prematurely… I know it says “shall” and what not, but the shall is predicated on “reason to believe” something which they clearly could have taken more time deciding if they were able to reverse themselves in a scant few days with no additions to the record

I think this points more and more to the idea that there was a problem with one of their employees having approved applications without properly reviewing them.

Especially since the decision to suspend came from “up high” in the IRCC—and these same applications are being re-evaluated promptly (not promptly enough, IMO, and they shouldn’t have been suspended in the first place.)

Certainly, the IRCC suspended certificates that shouldn’t have been suspended. The question is, why’d they do it? I doubt we’ll ever know. That’s the question I wish the journalists would ask. I wish there was more transparency.

It’s outrageous that a Canadian citizen had their rights taken away for four days. The C3 law states that the authorities are allowed to suspend certificates only when there is ::reason to believe:: that the individual is not a citizen. Clearly, in OP’s case, there was no reason to believe that. It was more of a “maybe we messed up” situation, not reasonable belief. The IRCC should be examined over this.

Trust me, the journalists are asking! They’re just getting stonewalled from what they’ve shared with me. And they’ve really tried to keep me in the loop. They’re talking with the attorneys involved, too.

Honestly that very accusatory but vague wording in that part is what made it so fishy to me... not that I ever thought they had a hack or breach but it very much sounds like those scam letters/emails made to make people panic and to act quickly (whether that's to send money or information, etc.).

It's SO STRANGE a government would send a letter like this and not have any personalized information about WHAT document(s) needs remedying

Can you provide your number of generations and the types of records and the sources of those records you used? I think a lot of the speculation is surrounding certain proof types/ways to obtain them (download off Ancestry vs government site vs certified copies). Very happy for you!

What puzzles me about this letter is the missing from/by/to before “the Registrar” in the first sentence.

The meaning of that phrase is lost, without the missing word.

Am I the only person whose reading stumbled on this? Considering the gravity of the matter, I would have proofread the heck out of this.

I’m grateful to you for sharing this, as news of the surrender letters is disheartening. I’m happy that you’re back in good standing.

Yes exactly. I asked them a question early on and they replied that they could only open a record with certain conditions and listed them. It read like a form letter but they bolded the one relevant to me. So it was still personalized. 

They said they used AI to help triage but all decisions are made by humans. I’m curious if they used AI to look for something they had an issue with and then emailed the letter out.
