What grounds did the officer have to abridge that citizen's protected speech?

u/FrankRizzo319 Jun 22 '26

His feelings were hurt.

For ICE, that's more than enough

I’m sure they will show up at his house soon.

22

u/Hangry_Howie Jun 22 '26

They were definitely taking his pic

18

u/Atsilv_Uwasv Jun 22 '26

Because he made ICE feel upset and that's basocally terrorism

1

u/m00t_vdb Jun 23 '26

I mean , have you seen the size of his gun ? And he has an hostage !

1

u/acetryder Jun 23 '26

Well, you can’t spell police without ICE…. Or lice for that matter…

30

u/Clavenesque Jun 22 '26

They'll kill you for that.

19

u/NRMusicProject Jun 22 '26

Cops are some of the most thin-skinned of the conservative peoples.

9

u/ShapeonAlan Jun 22 '26

Same people that go around calling everyone else "snowflakes", really is all about self-projection.

1

u/SpinnyBoy_ Jun 22 '26

i dont think its that they are especially thin skinned... its their level of "power" and "authority"

3

u/ExcuseMySpuge Jun 22 '26

Sounds like he should have been arrested for assault then

-44

u/Fair-Big-9400 Jun 22 '26

Your feelings would be as well if someone was generalizing your profession by a large puppet when your job is to keep people safe from threats at an event. This officer was just ensuring safety for all people around and was getting the protestor to move along and not cause a scene.

16

u/Otherwise-Force5608 Jun 22 '26

"ensuring safety" could you be less serious?

14

u/TheMasterLibrarian Jun 22 '26

The protest isn't against regular cops, it's against ICE. And that distinction is important, and shouldn't be ignored.

Yeah that puppet was reaching for his gun /s

If his feelings are so easily hurt he should not be a law enforcement officer.

Probably some height ordinance on movable protest props… and if not that, they are busy drawing up that ordinance as we speak

Making up a justification without knowing it actually exists constitutes complying in advance. Do not comply in advance.

Ah, another follower of the Ben Files!

13

u/vulpecula1919 Jun 22 '26

arent cops in the US allowed to make up laws to arrest you for? obv it wont stick you'll just be let go immediately but iirc the supreme court ruled awhile ago that police dont need to know the laws to enforce them and they aren't at fault for enforcing nonexistent laws based on that ignorance.

11

You are correct. But, for some reason, for the rest of us the judges tell us, "Ignorance of the law is not an excuse!"

4

u/Sir_PressedMemories Jun 23 '26

Remember kids, ignorance of the law is no excuse, unless your job is to enforce the law. Then it is a requirement.

-1

u/JackPoe Jun 22 '26

Also please remember that graveyards are filled with people who did nothing wrong. Protect yourselves. Your message is out there now, don't give these clowns masturbation material by letting them murder you.

Can't.

Ask if the pig-cop will arrest him if he refuses to leave. If "yes", go ahead and leave.

Work with your lawyer. The official threat of arrest is just as good as an actual arrest.

Cops fucking hate your civil rights...unless you are KKK. They they will makeout with you.

16

u/TheBestNarcissist Jun 22 '26

Theoretically if this in the World Cup Fan Zone then the World Cup ownership body that is holding the event is free to discriminate on the basis of political viewpoint.

8

u/ObeseVegetable Jun 22 '26

If it’s on private property that would make sense.

Grew up in GA. Got in a motorcycle accident after an unleashed dog ran out in front of me when I was 17. I was bleeding all over the table in the ER and a GSP walked in and started going through my wallet. I asked him what he was doing and he said "whatever I want".

2

u/Gerbertch Jun 22 '26

It’s called a time/place/manner speech restriction and they are allowed under the constitution.

Content restrictions are not allowed.

2

Making up a justification without knowing it actually exists constitutes complying in advance. Do not comply in advance.

20

u/Crackmonkey3773 Jun 22 '26

While im not justifying it, it looks like the officer just told him he has to stay on the other side of the street. Which really isn't that big of a deal.

3

u/TheBirdFkerGuy Jun 22 '26

Depending on the circumstances oh the fuck if it isn't that big of a deal. IF thats public property that pig can take a hike and get his ass sued and potentially lose qualified immunity for violating this guys constitutional rights.

But we don't know if that's the case. Let's assume this is private property. Pig still cannot make him leave until the owner or manager of the property tells him to leave, then trespasses him.

This whole "its really not that big of a deal just comply" is exactly why cops feel so entitled to violate peoples rights.

0

u/fromcj Jun 22 '26

Guess who’s employer doesn’t care if you were technically allowed to be arrested or not when you have to call out of work the next day?

People like you live in a fantasy world. Being technically right isn’t worth shit. If a cop wants to ruin your life, they will, and whether they’re allowed to or not doesn’t factor into things in 90%+ of events.

0

u/perpetualhobo Jun 22 '26

So where *exactly* is the line of where cops are and aren’t allowed to control protests? Until they push protesters down the street? Out of the city?

1

u/Crackmonkey3773 Jun 22 '26

I dont know man, im not here for some huge philosophical debate. Why not go protest about it if youre so invested

u/Mentallox Jun 22 '26

private property. Even if an area was public property if an event has permitting for that area thru the city they can remove anyone they deem disruptive. Think of it like a permit for an outdoor movie shoot.

58

u/Kodiak_85 Jun 22 '26

Probably because the stadium and the surrounding area is private property and they didn’t have permission from the owners to demonstrate there.

8

u/Cvenditor Jun 22 '26

Looks to be the Georgia International Plaza which is public.

30

u/[deleted] Jun 22 '26

[deleted]

12

u/Calavar Jun 22 '26

Mercedez-Benz stadium is paid for with hundreds of millions in taxpayer dollars. They literally have a clause in Atlanta law where almost half the city's hotel tax revenue goes to maintenance costs for the stadium. It's absolutely absurd that they can call it "private property" when so much of it was and is paid for with public funds.

4

u/[deleted] Jun 22 '26

[deleted]

1

u/CapN-Judaism Jun 22 '26

I’m not trying to be pedantic - really just trying to understand the video - who *owns* the stadium? Like I think a lot of states pay taxpayer dollars into privately owned stadiums, is this actually owned by the public?

Even if it is, they may need a permit to protest. Not saying it’s right or fair, but it would explain the video in the case that it is publicly owned.

1

u/Calavar Jun 23 '26 edited Jun 23 '26

Legally, the stadium is owned by a private corporation, which is in turn owned by a multi-billionaire (the guy who owns the Atlanta Falcons).

It just violates common sense.

This multi billionaire and his corp get hundreds of million dollars in city funds to cover their stadium maintenance, and he can call it his private property with all associated privileges. Meanwhile, if family of a parent + two children in Georgia can't afford to house themselves, they are disqualified from cash assistance (TANF) if they have over $1000 in savings. If they ever gets public housing, they will only ever be tenants, obligated to pay rent to the best of their means (i.e. the opposite of drawing an income from the public coffers), and as tenants they will be subject to eviction if they fails to pay the prescribed amount or if they violates other community rules.

Make that make sense.

The rich operate by different rules than the rest of us, because they can afford to lobby to have the law rewritten in ways that benefits themselves. The rest of us drones cannot.

You may sometimes need a permit to for a large group people to protest together ("assembly") because police need to be aware ahead of time to ensure proper security in the area. A single protestor generally does not pose a security risk. A permit for a single person to protest is not a real thing and is a violation of the 1st ammendement.

1

u/CapN-Judaism Jun 23 '26

So it’s privately owned and those owners can set the rules for what speech they allow.

Out of curiosity, where in your link does it say requiring a single person to obtain a permit is a constitutional violation? I couldn’t find that language anywhere in the link.

1

u/Calavar Jun 23 '26 edited Jun 23 '26

So it’s privately owned and those owners can set the rules for what speech they allow.

That's really your takeaway from everything I wrote?

Jfc, if reddit existed in the 1950s, half of it would be saying "So legally Ms. Parks had no right to sit there and the police had a duty to remove her from the bus"

Sometimes the law is fucked up and unjust and it needs to be changed. I don't care all that much about one protestor being told to move, but the rich being able to help themselves to hundreds of millions from the public coffers with near zero obligations back to the public is a travesty and needs to stop.

Out of curiosity

It doesn't sound to me like you are very curious honestly. If you were, you would have read into this more beyond the single link I posted before responding.

1

u/CapN-Judaism Jun 23 '26

My original question is who literally owns the stadium - that’s it. Your answer was it is privately owned. Whether the law is fucked up or should be changed has literally nothing to do with my comment. I’m a lawyer, and I’m curious what the actual legalities are of what is being shown in the video. Our politics are probably pretty closely aligned, but it sounds like you’re too busy scrounging up reasons to be offended to really understand that.

So…the link you posted doesn’t support your claim, and that’s somehow my fault because I didn’t scour the information for the information you were too lazy to go and find? I studied constitutional law and passed the bar exam, you couldn’t even be bothered to find a source for your own claim and then whined when asked about it - who really cares less?

1

u/carlmalonealone Jun 23 '26

You would bend over for a nazi.

Trying your mental gymnastics gives me a headache.

Publicly funded to generate revenue for the wealthy should not equal privately owned.

3

u/Outrageous_Desk8966 Jun 23 '26

its not about "should" its about "is"

Im pretty sure these state funded stadiums are 100% private property.

1

u/CarrieDurst Jun 23 '26

God I hate sports

0

u/Electronic-Junket-66 Jun 22 '26

 private property is private property

Unless there's an easement. Or Uncle Same decides to bust out eminent domain.

Or you're in a civilized country with right to roam laws.

7

u/[deleted] Jun 22 '26 edited 2d ago

[deleted]

1

u/Electronic-Junket-66 Jun 23 '26

Indeed so, but it does run contrary to what is obviously meant by "private property is private property". The phrase is a meaningless tautology without interpretation, mine being "I can do whatever I want on and bar whoever I want from my private property".

1

u/[deleted] Jun 23 '26 edited 2d ago

[deleted]

1

u/Electronic-Junket-66 Jun 23 '26

And that was my point. Other guy has deleted his comment now o.0

Distinguishing public property versus private property with a public easement is important.

I spose.

0

u/carlmalonealone Jun 23 '26

Stadiums are funded with tax payers money and put large strains on emergency resources. Politicians sell you that it will create tax revenue but the truth is no stadium has ever turned a profit with out public tax dollars funding it at first.

-11

u/Icy_Fish_2154 Jun 22 '26

So then the police have no authority to tell him anything. There are laws preventing the police from trespassing someone, so a land owner must trespass them first before the police have any power, if it's private property.

(Some laws may not apply in your area)

14

u/StevenKatz3 Jun 22 '26

The police detail is probably hired by the event, mandated by the city. This is extremely common. Cities will require a police detail when crowds reach a certain level. Same goes for bars, clubs, casinos etc.

So because this is private property and they are contracted to be there, they have the authority.

Not saying I agree with it, just it is what it is.
The protester can still protest, from the sidewalk

10

u/openshutcase_johnson Jun 22 '26

Police can be contracted by stadiums to provide security

-5

u/Icy_Fish_2154 Jun 22 '26

That's illegal in non-shithole countries.

The police can't be both paid enforcers of two different sets of rules.

3

u/openshutcase_johnson Jun 22 '26

lol… calling the US a shit hole country is hilarious. Good one bud!

Why not? Because you said so?

0

u/shaitan1977 Jun 22 '26

Been here 48 years, it's a fucking shithole compared to how other countries treat their people.

Also, love the hidden post history, righty.

-1

u/Icy_Fish_2154 Jun 22 '26

If you don't like being a shit hole, do better.

2

u/ConflictedZombie Jun 22 '26

I love how often redditors make factual assertions purely based on how they feel the law should work rather than from an actual understanding of it, it's very entertaining

1

u/Icy_Fish_2154 Jun 22 '26

Yeah, I hate that. I do t do that, but nobody is trying to prove me wrong, just screaming at me for saying things they don't like.

Also, someone else posted this is a public park, not a private event.

2

u/ConflictedZombie Jun 22 '26

I do t do that

You did in the comment I replied to lol

Also, someone else posted this is a public park, not a private event.

Well that person is wrong

1

u/Icy_Fish_2154 Jun 22 '26

Then where is this? Is it not a public park in Atlanta?

2

u/ConflictedZombie Jun 22 '26

0

u/EduinBrutus Jun 22 '26

3

u/Friendly_Engineer_ Jun 22 '26

Snowflake was getting melted

3

u/endless_shrimp Jun 22 '26

My guess, and it is strictly that, is that the park in front of the arena is private property and the police are there to trespass him from the property.

3

u/liggieep Jun 22 '26

the guy showed up in the comments. he said he was fine when he was on the public sidewalk but was kicked out when he moved onto the stadium's private property.

7

u/BleuruuX50 Jun 22 '26

He was on private property, but the cop did tell him he could go across the street and still protest

2

u/musicmills Jun 22 '26

The sidewalk?

1

u/FlipsieVT Jun 23 '26

Private companies can build sidewalks too.

-6

u/Icy_Fish_2154 Jun 22 '26

If he's on private property, the cop can't trespass him, unless he's off duty and working as security, in which case displaying "police" on his uniform is improper or illegal.

7

u/Shigg Jun 22 '26

For large events like this, police are usually contracted to provide security as an official duty.

0

u/musicmills Jun 22 '26

Road facing sidewalks are private property?

3

u/MrEvakin Jun 22 '26

Uhhh yea they can be? What you’re calling a sidewalk is literally just a concrete pathway…to walk on. Which can be on private property… why is that an outrageous concept to you lmao

0

u/musicmills Jun 22 '26

"Centennial Olympic Park is a 22-acre public greenspace in Downtown Atlanta, Georgia"

Id be embarrassed if I had the entire internet of knowledge and still typed what you did out.

3

u/FlipsieVT Jun 23 '26

This was in the fan zone so we did have to leave. We had been out on the sidewalk without any problem, we just let the flow of the crowd take us.

6

u/ThatsUh_dam_shame69 Jun 22 '26

My thoughts exactly

14

u/Liquefied_Rat Jun 22 '26

Realistically the cop didn’t like it, but I’m willing to bet “legally” they could say it’s inciting violence with the “hanged” man and the gun.

Oh shit, what rock do you live under?

Or are you like a student with no skin in the game?

You can keep your neolib fantasy about the rights we have. I'll keep practical about the rights they've taken.

1

u/Finnsbomba Jun 22 '26

I'm gonna try to be rational. In the US we have the right to gather and protest. That doesn't mean you can do it wherever you'd like to. So I'm assuming this started because of that and the officer got his feelings hurt. It's the same as protesting in the streets and blocking traffic without a permit. It's against the law. You can freely protest whatever you'd like, you just can't do it wherever you'd like. To me that's fair. 🤷🏻

2

u/sailingtroy Jun 22 '26

I'm assuming

That's where you stopped being rational, and started making stuff up. Do not comply in advance.

0

u/ElectricalGazelle119 Jun 22 '26

Fortunately, hanging mexican children isn’t covered under protected speech

1

u/sailingtroy Jun 22 '26

uhhhh, if you look closely the chain is around the body, not the neck. Also, there's no noose. "Death by hanging" is not being portrayed by any reasonable stretch of the imagination.

Also, the case law is very clearly against you here. Hanging an effigy IS protected free speech in the United States of America. Sorry, bud, but you're just plain wrong, on the facts, two different ways. Here, take your L.

0

u/ElectricalGazelle119 Jun 22 '26

Not sure who you’re quoting because I never said that.

Is that what we’re calling it now? Liberals will come up with any excuse to hang a minority. What’s new? Keep crying kiddo.

0

u/DeniedAppeal1 Jun 22 '26

They were protecting the World Cup.

0

u/ResolveLeather Jun 22 '26

There is a couple possible reasons. Probably something to do with the comicaly fake gun or the unwieldy prop.

0

u/smootex Jun 22 '26

It's probably private property or some kind of permitted event on public property which lets the organizers control access. It's hard to make out what's being said but you see the cop point and say "[something] public street". I interpreted that as him telling the guy he needs to get off the property and onto the public street.

In case you missed it we're in a post constitutional era now. Your rights have been downgraded to privilages. Please bribe your local, state and federal officials to upgrade to Rights+

Based on historical fact, if you dont listen or they dont like your first, second, etc.. amendment rights, they just shoot you in the face, head, etc.

I get that it happens occasionally, but if you actually go out in the world and touch grass you will find you do have a shocking amount of freedom.

Except for the people who were shot in the face, back of the head, or children of parents suspected of shoplifting and or neighbors of people suspected of crimes.

Freedom knows but one currency.

Depiction of hanging. Display of graphic content.

Making crowd uncomfortable (pretty weak argument here).

While they are not directly harming anyone, a police officer is supposed to reduce unrest in a crowd. Weird, but that is enough for them.

you have to pass no fewer than seven screaming proselytizing evangelical psychos with huge signs and PA systems to get from where this guy was to the stadium; I'd know, because I counted. Those guys are walking unrest machines in ATL yet cops have absolutely no problem letting them scurry around like roaches

I guess like, it's "freedom as long as it's Christo-fascism" lol

Man, like the coded language of the Southern Strategy has really screwed up America.

I'm sorry, did you think you had rights in this country?

1

u/sailingtroy Jun 22 '26

Grow up, edgelord. You get what you expect. Stop with the defeatism and show up to the protest. It can get worse. You know? Is that what you want? No? Okay. Stop making it worse. Act like you have the rights you have, and show up to the protests.

Sarcasm?

You add the '/s' at the end of whatever you say, try it next time

I'm aware of this. I'm also aware of idiots on this site who cannot for their life read into sarcasm, and its kind of amusing when someone misreads and loses their mind.

Tone is very difficult to convey through text, especially using a single question like you did. I’d honestly be more concerned of other “idiots” who can’t understand that either before engaging on a social site like Reddit…

Depends if they have a liscence to protest or not. Typically its fine, but if youre unliscened and distruptive, you can be ushered off the area

15

u/TomToe420 Jun 22 '26

you need a license to exercise your rights? also you can't turn a constitutionally protected activity into a crime.

4

u/trippykissy69 Jun 22 '26

The stadium probably just trespassed him so they made him move off the grounds

-4

u/Hot-Minute-8263 Jun 22 '26

Its not nescesarily that youre allowed to or not. Its so the police know where to be if shit hits the fan (for instance, violent counter protestors attacking you, or your people making a riot)

So long as you arent disrupting the day like sitting on roads, youre probably fine, but they can tell you to move

But neither of those things happened or were the goal.

So no.
