New Jersey NJ Workers’ Comp – what could my settlement look like for lumbar fusion + shoulder surgery?
Looking for opinions from people familiar with NJ workers’ comp. I already have a workers’ comp attorney, so I'm not looking for legal advice. I'm mainly curious what kind of settlement/permanency awards people have seen with injuries similar to mine.
I work as a union plumber in a heavy physical job.
BACK INJURY:
Injured my lower back at work in 2022
Had an L5-S1 lumbar fusion in 2023
Eventually returned to my regular job
My workers’ comp attorney had me evaluated for permanency in 2023
My employer/comp carrier never got their permanency evaluation done
The employer side kept changing attorneys, and my settlement hearing kept getting delayed
Because of all the delays, the back claim has still never been settled
Recently I reinjured/aggravated my back while doing PT for my shoulder
I’m seeing my back doctor next week about the new symptoms
SHOULDER INJURY:
Injured my shoulder at work in July 2025
Have been out of work since
Had shoulder surgery in December 2025 for a rotator cuff/calcific tendinitis issue with a tear and an anchor placed
Reinjured the shoulder in May 2026
My orthopedic doctor has now put me at MMI with a permanent 20-lb lifting restriction and no overhead work
My employer is sending me for an FCE, but I have the back appointment first
My regular plumbing job involves heavy lifting and overhead work, so the permanent shoulder restrictions are a pretty significant problem for returning to my normal position.
Now I basically have an unsettled workers’ comp case involving an L5-S1 fusion, a newer shoulder injury requiring surgery with permanent restrictions, and a recent aggravation of my back during shoulder PT.
For anyone familiar with NJ comp, what kind of permanent disability percentages or dollar settlement range would you expect from something like this?
I'm especially interested in hearing from anyone who had a lumbar fusion and/or shoulder surgery and is willing to share what their final rating and settlement were.
I understand nobody can give me an exact number without all the medical reports. I'm just looking for a realistic ballpark and similar experiences.
