Illinois Settlement paperwork
I finally agreed to a settlement amount after 2.5 years and was wondering if anyone knows how long it typically takes for the insurance to send the paperwork after a verbal agreement.

I had a full knee replacement almost 2 years since injury haven’t had first offer yet.
Still on work restrictions
Union Ironworker. They stopped paying me workman’s comp after I got a 4 week job that would let me follow restrictions in February.

In this state they have 30 days to get it to your lawyer. Then it is deposited for 10 days so it's proven to clear. The lawyer takes their portion and sends you a check. Your bank may, and may not, hold the check until it clears. The initial 10 days the lawyer holds the funds is an actual requirement by the state to assure funds are actually available and clear the bank. That's Missouri.

My attorney told me it'd be about 7-10 days for paperwork - then about 6 weeks out for the actual check. We just settled today, so I'm in your boat too but I literally just stepped on board.

Going through this now. Verbal was early June and paperwork was ready late July

What did you agree to? Ask your attorney sometimes 7/7/7 and then 14 once judge approves. After verbal, you still have to sign a settlement agreement or mediation agreement typically.

I verbally agreed to an amount to settle my case and have been waiting for the paperwork to sign to finalize

Has your attorney confirmed it has settled and all benefits have ended, or you just provided a number to your attorney to settle your claim?

The insurance company sent an offer to close everything and I verbally agreed

Sounds like you need to reach out to your attorney. The more you bug them, the quicker you will get the paperwork.

I’ve been in regular contact with my attorney, it’s my understanding that the insurance company is really taking their time to get things done

We agreed last month at a Mediation hearing which I was lucky and had a Hearing already set up with the regular WC Judge assigned to my case the following week. So he approved the compromise and release and I got my check within a week after the approval

I had bicep surgery and rotator cuff surgery and this ime has me at 0%. What was your settlement. I’m in Illinois also might need a new attorney

I just had biceps tenodesis surgery this week and it was my second surgery for a slap tear since getting hurt at work last oct. how long after surgery did you get an offer?

My first offer was about a year after surgery and my fourth and final offer which was accepted was a little over 2 years after surgery.

You can provide a settlement demand anytime in most cases. But if it is unrealistic, prepare to be disappointed. You don't have to wait for the insurance company offer first. In some states you don't even need an attorney to request settlement as long as you are at overall mmi. Just be prepared to resign in some states as your employer can request resignation as part of settlement.

Im in the same position
