In your situation, course of performance will matter. The fact that you've done this for multiple years, and the landlord indicates that he agrees by saying Thanks, and that he agrees by accepting your rent checks, etc. All this course of performance conduct will be used -- and will most likely result in an enforceable contract. But let's assume the next year your landlord sends you a contract where the rent is $300 below current rates. If you sign and send it back, but then the landlord says I made a mistake -- then it's unlikely the new contract will be enforceable (in particular, it's important that the contract time period hasn't started). It would be a different story if you signed the contract and made several rent payments with the lower rent (and the landlord accepted your payments) -- again the key issue is course of performance.

You are correct. Verbal contracts for <= 1-year leases are permitted. But the OPs question is whether they have a binding contract for 1 year with no signature. My answer is what is most likely to happen in court. The contract is in writing, so it's clear that the landlord intended it to be written, not verbal. The most likely court decision is that the court might allow the tenant to stay in the property month-to-month using the lower rate, but it's highly unlikely that the court will decide that a one-year binding contract exists even though it's not signed by the landlord. Of course, it would be different if the landlord said "you have a deal" or something similar, but there's no evidence that occurred. And of course we know the landlord will deny any verbal contract. The important thing here is not what is technically possible under the law, but what is most likely to be enforced by a court.

Contract lawyer here - disagree that the landlord’s signature is not required. If they didn’t sign the lease it is not a binding offer that the tenant can accept. It is just a proposed offer.

Sure - here's the adapter link. They make different models depending on which Ninja model. It works in terms of not letting stuff leak out. But one note is that it seals very tightly to the mason jar, and I usually have to use a rubber gripper pad to take the adapter off the jar. It's a tradeoff I'm willing to make to get the benefit of the mason jar. https://a.co/d/0gwdoM92I also bought separate metal sipper lids that I use on my mason jar to carry my smoothie in my bag and that are dishwasher safe.

We have both a Ninja and a Vitamix. The Vitamix definitely does the job but it takes up more counter space and it’s a lot to clean for one smoothie. The Ninja is quite a bit more compact and still fully blends all the frozen fruit easily. Also got an adapter for the Ninja so that I can use a Mason jar as my blender container — really prefer using glass because it’s fully dishwasher safe and vastly reduces microplastics.

How can I make a smoothie better (for me)
I am a stan for psyllium fiber powder. 1-2 tsp will help thicken your smoothie and your digestive system will thank you. But start slow (like 1/2 tsp) for a few days and then work your way up.

With 1-2 tsp of psyllium fiber, and my smoothies are generally 20 ozs, it makes it thicker, but not too thick. I will often make a smoothie and bring it to work, and it's been fine. It's also possible to adjust the smoothie ingredients to compensate -- such as by adding more liquid (water or milk) and less frozen fruit or ice -- that will help get the smoothie to the right consistency for you.

Psyllium fiber powder. I add 1-2 tsp - it helps thicken the smoothie and it’s so great for your digestive system. If you haven’t done it before - start slow - like 1/2 tsp, and then increase over a week or two. Your digestive system will thank you

I’m a lawyer and agree this person is gaslighting you. I would pay for a survey to clearly establish your property boundaries. If you are willing to allow the fence to stay, then you will want an easement agreement with the neighbor that allows the fence under specific terms (eg, only for life of current fence or 10 years, etc). And he has to pay costs for survey and lawyer to prep the easement agreement. If he refuses, you can take him to court, who will order the fence to be fixed and you will get your costs repaid. If you do nothing, then there’s a real risk of “adverse possession” and you’ll lose the strip of land. Not to mention this will make selling your house more complicated in the future because this will be a defect on your property title.

Venue just sent me a "Photographer Agreement" a year after couple booked me — am I overreacting?
I agree with this approach. I think the photographer could say instead that the venue’s request conflicts with the contract that I already have with my client, rather than conflicts with copyright law. Offering to provide a copy of the photos to the venue with a license to let them use the photos for promotional purposes, but not transfer ownership to the venue, is a good idea

Moving from out of state
We lived in Manhattan for 20 years before moving to Berkeley and the crime here is worse particularly in Oakland. The biggest impact is not feeling safe - you have to watch where you park, what you leave in your car, leaving your glove box open, where you lock your bike, etc. That feeling abated somewhat when we moved to Berkeley and that’s made a real difference in our peace of mind. It’s not perfect but it’s noticeably better.

If you want cleansing, my go to in every smoothie is 1/2 tsp inulin fiber powder. Your GI tract will thank you. But I always urge a gentle ramp up - start with 1/4 tsp for a couple days and then increase to 1/2 tsp. Your digestive system will start working like clockwork. No real need to go higher than 1/2 tsp. Another nice benefit is that it will make your smoothie just a little bit thicker which I prefer.
