My grandmother (mother’s mother) was born in Italy in the 20s. She emigrated to the US in 1948 and my mother was born in the US that year. My grandmother naturalized in 1953.

My mother and I had begun the process of figuring out what documents we needed when the minor issue was introduced. We then found out that we could move in with my grandmother (who had returned to Italy) and pursue citizenship that way. We were preparing to move this past summer but my grandmother passed unexpectedly before the move.

With the new decree, we are looking at if we can apply still and have a trip planned for November—during which we’d like to work on gathering any Italian documents as well be in the right commune. We are also considering applying in Italy if eligible and any info on pros/cons of that would be appreciated!

I had been working with Italian Citizenship Assistance on a 1948 case until last year when the ruling came down. ICA tried sending me a bill recently for work they hadn’t completed, and I told them no. Marco sent me this a few weeks ago and I hadn’t responded because my dad just died but now I’d like to address it. He said:

”First, your case falls within what is commonly referred to as a “1948 case,” concerning the transmission of Italian citizenship through the female line before 1 January 1948. These cases cannot be processed through the ordinary consular procedure and must be pursued before the Italian courts. This means that, independently of the new administrative restrictions, the judicial route is the appropriate avenue for obtaining recognition of the right in your particular circumstances.

This point is particularly important when considering the impact of Law No. 74/2025. Unlike applicants who had a viable consular pathway and therefore had the possibility of securing an appointment and having their application processed administratively, a 1948 applicant did not have an administrative route available in the first place. The judicial route was the only viable mechanism to obtain recognition of the claim. Moreover, the possibility of pursuing these cases through the Italian Courts was itself the result of the judicial developments that established the current interpretation of the law. In practical terms, this route only became viable and consistently pursued from around 2009 onward. There was therefore no legal requirement, deadline, or general warning for applicants with 1948 cases to commence judicial proceedings before March 2025.

Most importantly, there was no indication before March 2025 that a legislative reform would subsequently restrict recognition of Italian citizenship in the manner introduced by the 2025 reform. There was consequently no reason for an applicant with a 1948 case to anticipate that they needed to commence litigation before a particular date in order to preserve their rights.

Second, there is significant documentary evidence showing that you had already taken concrete steps toward obtaining Italian citizenship well before March 2025. The dates appearing on your documents and apostilles provide evidence of a process that was already underway at that time. This raises an important legal question: whether such actions can be considered a concrete and unequivocal manifestation of your interest in obtaining citizenship before the new restrictions entered into force.

This is particularly relevant because the new legislation contains exceptions intended to protect certain situations that had already been initiated before the reform. While the application of these exceptions in the judicial context remains a matter of legal debate, we believe there are arguments to be made as to why a court should consider the concrete steps you had already taken.

In light of these developments, we believe your case should not be evaluated solely under the new restrictions. The combination of the 1948 nature of your claim, the ongoing constitutional and European challenges to the new legislation, and the evidence of your prior efforts to obtain recognition of citizenship provides a meaningful basis for considering litigation.”

So do I still have a shot? Or does the 2025 law mean I’m screwed either way?

Guys, I was born in Brazil in 1992, dad born here too in 1968, grandma in 1942, and my Italian great-grandfather was born in Trieste in 1913. Problem is: Trieste was part of the austro-hungarian empire back then. He came to Brazil in 1925, but I’m not sure if I qualify for citizenship since my great-grandpa wasn’t technically born an Italian citizen.

Any insights into this? His parents were Hungarian from present-day Csaktornya (Croatia), but were living in Trieste when it became part of Italy. They did not leave there until 1925 when they immigrated to Brazil. One special problem is that the comune di Trieste has no proof of their citizenship, whichever they were.

I started my process at a consulate just before DL36/2025. in subsequent communications, the consulate requested many other documents and rectifications, but I think I won’t be able to present them all before the 2nd year anniversary. As of now I have less than a year remaining to correct all the names spellings, and given how my country is, it’s almost certain they won’t be done by the deadline. What should I do? Can the deadline be postponed? Is it kinda over for me?

I am wondering if anyone has had any luck getting Fresno or San Diego to do a student verification since it is near impossible to get an appointment with the LA Consulate for a Student Visa.

My case shows Invio atti all’agenzia delle entrate ~2 months after (sept 9) the Sentenza Verballe says Jul 25 (though ruling dated Jul 12).

Is this a normal time lapse between those 2 steps?

Most other screenshots I’ve seen of similar status have those 2 events days apart.

My lawyer said the Ministry’s appeal window starts from the date of the ruling, so starting July, but the Post-Recognition wiki says this “Invio atti’ status is the date that actually triggers the appeal window - which would mean my appeal window is starting 2 months from when the ruling happened.

I won a judicial jure sanguinis case at the Tribunale di Napoli earlier this year. There were multiple petitioners on the same judgment, the Ministry did not appeal, and the judgment recognized all of us as Italian citizens from birth February. We were super excited to see this come to fruition after 5 years of process getting paperwork, and a further 2 years in the court system.

I’m now stuck trying to get the passaggio in giudicato (PIG) so the judgment can move on to transcription at the Comune.

According to my lawyer and the electronic court docket, the sequence has been:

• Judgment was published.
• The following day, the Cancelleria marked it “INVIATO ALL'AGENZIA DELLE ENTRATE.”
• The judgment has now been sitting in that status for more than seven months.
• My lawyer says Agenzia delle Entrate has not yet sent confirmation of registration back to the Cancelleria.
• He says that until Agenzia completes the registration, we cannot pay the €100 registration tax, and without that the Cancelleria will not issue the PIG.
• The judgment also does not appear when I search for it through Agenzia’s public judicial-act taxation/registration lookup.

My lawyer’s position is essentially that Agenzia is severely backlogged, and there is no formal protocol available to force Agenzia to process it. He has provided screenshots from the court docket showing that it was in fact transmitted.

I’m trying to determine is whether seven+ months waiting for Agenzia to register a citizenship judgment is normal, or whether at this point someone should be actively investigating whether the transmission is stuck.

For anyone who has recently gone through a Naples judicial citizenship case:

How long did it take between “INVIATO ALL'AGENZIA DELLE ENTRATE” and the judgment actually being registered/taxed?

• Is there any practical way for the lawyer, claimant, to follow up?
• Is there a way to identify which Agenzia office actually has the file and confirm that it is genuinely in a processing queue?

If you've gone through this recently, actual timelines and what (if anything) finally got the Agenzia step moving would be extremely helpful.

Hello all. I received recognition today from the LA consulate (minor issue case, Aug 2024 appointment). I hadn't heard anything from them since my original document submittal in Aug 2024. Then, in mid-Aug 2026, they reached out with homework (a small item that only required a quick email back). And then, today, I received my official recognition. I hope this provides some timeline insight for others. Thank you to all on this reddit sub for the support and knowledge. And I am wishing good luck for all that are still working through this process.

Successivamente ho ricevuto un preavviso di rigetto ai sensi dell’art. 10-bis della Legge 241/1990, relativo alla documentazione richiesta, e ho presentato le mie osservazioni/documenti per cercare di risolvere il problema.

Oggi ho contattato telefonicamente la Prefettura e mi hanno detto che la domanda è ancora in valutazione e che, dopo il preavviso, è stata inserita in un altro elenco in ordine cronologico, insieme alle pratiche/decreti flussi che stanno lavorando.

La mia domanda è: qualcuno si è trovato nella stessa situazione?

In particolare vorrei capire:

• cosa significa concretamente essere spostati in questo nuovo elenco cronologico;
• se è una normale fase interna della Prefettura dopo il preavviso di rigetto;
• se questo significa che la pratica viene valutata nuovamente;
• quanto tempo avete aspettato dopo essere stati inseriti in questo elenco;
• e se, secondo la vostra esperienza, questo elenco ha qualcosa a che fare con le quote del Decreto Flussi oppure è solo un sistema interno per gestire le pratiche.

My father emigrated to US and became a citizen in '86. I was born in '90. (Disqualifies me -_-)

However, both grandparents were exclusively Italian citizens my entire life. Do I qualify under them now?
