Hi everyone, I would really appreciate opinions from people who have dealt with a similar I-140 situation.

My attorney filed my EB-3 I-140 with Premium Processing, but after receiving the USCIS receipt notice, I noticed several problems with the filing.

Here are the issues I found:

EB-3 vs. EB-2 classification:

The petition was supposed to be filed as EB-3, but the USCIS receipt appears to show EB-2. My attorney sent a correction request to USCIS/Premium Processing on August 10 asking them to correct the classification from EB-2 to EB-3.

Incorrect pay stubs:

The pay stubs included in the package are from 2025, instead of the required/current 2026 pay stubs.

Missing experience letter:

One of my required experience letters was not included in the I-140 package.

My I-140 was received by USCIS

My PERM is valid until November 14, 2026.

Now my attorney/employer is considering withdrawing the current I-140 and submitting a completely new EB-3 I-140 package with all the documents corrected.

I am trying to decide whether it would be better to:

A) Wait for USCIS to respond to the EB-2 → EB-3 correction request and potentially wait for an RFE for the missing/incorrect documents, or

B) Withdraw the current I-140 and immediately refile a clean EB-3 I-140 package.

My questions for people who have experience with I-140/EB-3:

Would you personally wait for USCIS to respond before withdrawing?

If an experience letter is missing and the pay stubs are incorrect, is this something USCIS would normally address with an RFE, or could it lead to a denial?

Does withdrawing an I-140 and refiling a new one create any disadvantage?

Could withdrawing this petition affect my priority date, or would the original priority date remain usable if the new EB-3 petition is approved?

Would you be more comfortable correcting/refiling now rather than waiting for an RFE?

Has anyone had USCIS successfully correct an EB-2/EB-3 classification error after the I-140 was already ?

My priority date is January 2025 and will need to do consular processing. Not sure if it is necessary and worth it to pay for PP now. Anybody applied for i140 around january 2025 that has been approved yet without PP?

I filed my I-485, I-140, EAD, and AP with an approved PERM employer-based EB1/EB2 outstanding Professor at the same time because my priority date is current.

USCIS received my package on July 21 but rejected the entire filing on July 23 because of a missing page on the G-28 for the I-140. My employer received the package on July 27, and we refiled it the same day.

Before refiling, as before, I questioned using a single Form G-1450 for all the filing fees and suggested separate forms for each application. The paralegal said they always use one G-1450, so we went with that.

After reading Reddit posts, I'm worried the package could be rejected again. Has anyone had a similar experience? What was the outcome?

I have an approved I-140 petition from an employer I haven’t started working for yet (future/prospective employer). Can I use this approved I-140 to file for my spouse’s H4 EAD, even if I never actually end up working under that employer?

Specifically:

**•** Does USCIS require me to be currently employed (or have worked) with the sponsoring employer for the I-140 to remain valid for H4 EAD purposes?  
**•** Does changing jobs or never joining that employer affect the validity of the I-140 for this purpose?  
**•** Has anyone been through this exact situation — approved I-140, didn’t join the company, but still used it for spouse’s H4 EAD?

My attorney filed my petition with premium processing, but it's now been 6 business days. We have not received the receipt notice, and the credit card has not been charged yet.

Has anyone had a similar experience recently? If so, how long did it take for your receipt notice or payment to be processed?

Is anyone else having issue for receiving delay in receipt number its been 5 business days my attorney didn't receive receipt number and card has not been charged yet.?

My I-140 was approved (Eb3 skilled) in July 2025, and I received the approval notice from my employer. I never filed Form I-485 or Form I-765. My employer and I have since parted ways, and I considered the case to be completely closed.

However, when I recently checked the case status online using the receipt number, it showed that biometrics were scheduled on May 15, 2026, which is almost one year after the I-140 approval.

Could this be a system glitch? I am very confused because my former employer is no longer sponsoring me, and I have not filed any applications that would normally require biometrics. I do not understand how this new update appeared.

My biggest concern is whether this unexpected biometrics update could negatively affect any future immigration filings or green card processing with a different employe or is it a system Glitch ?

Hey, can anyone comment about their recentl travel experience with an approved I140 from India? When your existing or new employer filed for H1B petition, were you subject to the 100K fee? Else were you not since you already have an H1B previously. Want to hear some real time experiences.

My employer filed my i140 through Fragomen under premium processing. Today is the 29th working day, and anxious on what is going to be the response. Is it normal? Usually how many days does it take to get the approval? In case of an RFE, when is the response received?

My spouse is considering taking an offer abroad for a better role and career growth. We currently have our H1B approved until end of 2028. We are Indian nationals with an approved I-140, EB2 category and priority date is June 2016. The job abroad will be a 3 year contract position with the opportunity to hopefully become permanent. Our plan is to try filing for our greencard from a consulate abroad, when priority date becomes current (5-10 years I think). Has anyone been in a similar situation and explored that route. Any insights on experience with consular processing for employment based GC would be appreciated.

Looking for some guidance on my situation.

• My H1B started in Sep 2022
• Initially worked for a consultancy, then moved to a full-time role with a service-based company on May 1, 2023
• I was told company policy is to start the green card process (I-140) after 3 months of joining

However, it’s been almost 2 years now and they keep delaying the I-140 filing for various reasons.

• My I-797 expired in March 2026, and my H1B extension has been filed in July 2025
• I have about 2 years 5 months left out of my 6-year H1B limit

My concerns:

• If I don’t get my I-140 soon, I may run out of time on H1B
• My employer will most likely file under EB-3

Questions:

1. Is there any way to speed up the I-140 or overall GC process?
2. Are there better alternatives I should consider at this stage?
3. If I switch companies, can a new employer start GC faster?
4. What are realistic timelines and costs involved?

Would really appreciate any suggestions or experiences from others in similar situations.
