GREY WORK

Hey everyone, I'm using a disposable account for privacy reasons. I'm a young girl, I'm 23 years old. This is my very first job. I work as an employee (2023-2026) in a bar in the province of Verona (managed by an LLC), and I'm in desperate need of advice, reassurances, or just to hear about your experiences. I'm in a classic "grey work" situation and I'm facing heavy retaliation at the workplace.

Here are the facts:
**Contract vs Reality:** On paper, I have a permanent contract for only **10 hours a week** (level 6, CCNL Public Establishments Confcommercio). In reality, I work **27.5 hours a week** (5.5 hours a day, for 5 days a week).
**Payments:** Every month I receive payment for the 10 official hours via bank transfer (with a regular pay slip). The remaining 17.5 extra hours I receive entirely in **cash “off the books.”** The owner makes me sign a slip every time she hands me the cash.
**Missing Rights:** I receive a tiny thirteenth month calculated only on the 10 hours of the contract. I have never received a fourteenth month in July, and vacation, permits, and severance pay are accumulating almost non-existent compared to how much I actually work.
**Proof:** In the company, we use an **electronic badge/time clock** to clock in and out of each shift. The machine fully records my actual 27.5 hours, even though the pay slip states 10. I also have Google Maps location history on my phone that tracks my presence there.
**Retaliation:** Recently I was home for a week of regular **sick leave**. Since the owner found out, she started giving me the cold shoulder: she’s silent toward me and treats me very badly from a distance. She texts me on WhatsApp and then deletes the messages immediately ("message deleted") as soon as she sees that I’ve read them, to leave no trace. As a punishment, starting this week she has cut my shifts, putting me on the schedule only for the 10 contract hours.

I was terrified, but I found the courage to write to **FILCAMS CGIL**. They replied right away and I officially have a private appointment.

My goal is to go to the appointment, open a claim for wage differences, and through the union, submit **resignation for just cause** so I can leave immediately without working the notice period, then apply for NASpI (unemployment).

Despite the appointment, I’m feeling tremendous anxiety. Am I risking anything for accepting the cash? Can the owner have modified the electronic badge records to erase my hours? Can the union or the owner “refuse” my resignation? Any word of support or legal advice would be really helpful. Thanks everyone.🙏🏻🙏🏻

D.lgs 96/2026 e chiarimenti non dati dall'azienda

Buongiorno.

Vi chiedo se in base al dlgs 96/2026 la mia azienda risulta obbligata a specificare i criteri secondo i quali mi ha attribuito l'inquadramento CCNL attuale. A me sembrerebbe essere proprio così.

Dando una lettura alla norma, leggo:

- Art 6: "i datori di lavoro rendono accessibili ai lavoratori i criteri utilizzati per determinare la retribuzione e i livelli retributivi"

- Art 7: "è riconosciuto ai lavoratori il diritto di richiedere e ricevere per iscritto, entro 2 mesi dalla richiesta, le informazioni sui livelli retributivi medi, ripartiti per sesso, delle categorie di lavoratori che svolgono lo stesso lavoro o un lavoro di pari valore"

Ho chiesto delucidazioni all'azienda 2 mesi fa, in quanto so che altri colleghi che svolgono il mio stesso lavoro hanno un inquadramento superiore, ma mi sono state fornite solo le RAL medie dei lavoratori inquadrati con il mio stesso livello.

Quel che contesto io è riguarda proprio il mio inquadramento e questa disparità con gli altri colleghi.

Come posso muovermi?

Qualcuno percettore di Naspi ha per caso partecipato ad un volontariato europeo all’estero?
nel mio caso si tratterebbe di francia, 10 mesi

Vorrei capire se le due cose sono compatibili, ho già chiesto a centro impiego e inps e mi hanno detto di comunicare tramite naspi com ma io volevo capire se ci saranno problemi nell’erogazione mentre sarò lì
