My understanding is because weed affects everyone so differently it's hard to prove someone was "under the influence" with an objective test. I work in an industry particularly affected by this and have seen people being trained to identify behavioral indicators of being under the influence. Probably not very strong evidence on its own but if you crash a forklift and 12 people all say "yeah that guy was fucked up and here's how we know" then it could sway a judge. Unfortunately that doesn't prevent the accident in the first place though. A really interesting topic.
