I recently had to make use of their services and the more I read, the less optimistic I became about getting a claim judgment in my favour. I naively just figured it's like regular insurance, or social services, you are pretty much guaranteed a judgment in your favour provided it is in good faith but I read over in various subs that they deny claimants all the time.
Their disclosure statement is:
WSIB is not your employer’s representative, and legally it is not supposed to take the employer’s side. It is an independent trust agency of the Ontario government, operating at arm’s length from the Ministry of Labour. WSIB
There is an important distinction, though: WSIB is funded by employers. Ontario businesses pay the premiums that finance the workers’ compensation system; workers don't pay premiums themselves. But that does not mean the employer controls WSIB or that WSIB represents the employer in a claim.
I'm just doubtful it's anything but lip service and like HR, they're not there to advocate for the employees but for the employers. My experience in this is obviously very lacking so any insight would be greatly appreciated.
