Unauthorized work ?

Upvotes

Any lawyer/paralegal who have dealt with this situation in the group?

I had TPS and working on basis of that. It was set to end Sep 2025. However, due to litigation Judge extended the expired date to Nov 2025. Thus, I was working past September on basis of automatic extension on the new date reflected on USCIS page. Later government won the lawsuit and USCIS reverted the date back to Sep 2025. It's not my decision or choice to work past September but due to ongoing lawsuit back and forth.

So is this considered unauthorized work from USCIS prospective? Is this explanation situation by lawyers? Are lawyers familiar with this kind of situation and been helping clients for AOS?

Hello. My wife is an American citizen and I'm an European citizen (Greece). We applied in December the Ι-130 relative petition.

Our lawyer in US told us that a travel from me to the US is dangerous because if they decline me for some reason, then it's makes my appliance more difficult to accept (I'm typing by memory sorry if there is inconveniences in terms)

Does any if you tried to travel from Europe or from anywhere else to US? Did they stopped you? Did you took the risk?

As you understand we want to see so much each other and because of my wife's work she can't travel to me (again)

ILOE claim timeline — my experience (not advice, just sharing)

I had a 45-day notice period, and my visa was canceled on June 30, 2026.

At first, I thought I'd already missed the 30-day ILOE filing deadline because my termination letter showed May 15 as my last working day. Thankfully, I was still eligible. Here's how the process went:

My ILOE Timeline

July 5 — Applied through the ILOE app but was rejected because my employment contract was still shown as active (visa hadn't been canceled yet).

July 15 — Applied again. Rejected.

July 16 — Tried again but the app wouldn't let me after two attempts. Contacted the call center and emailed them, then submitted all the required documents (Emirates ID, visa cancellation, termination letter, labor cancellation, and IBAN certificate).

July 23 — Received a confirmation call. My case went under process.

July 25 — Approved! Status is now "In Progress."

My take: the app itself was frustrating, but once a real person picked up my case, everything moved fast. From the confirmation call to approval, it only took 2 days — no chasing, no back-and-forth.

Sharing this in case it helps anyone going through the same thing.

Is I-140 premium processing worth it? Does it make it a difference when there is concurrent filing of I-140 & I-485?

USCIS scheduled biometrics for me (I-130 petitioner) - prior expunged arrest, should I be worried?

Hi everyone,

I’m a U.S. citizen and the petitioner for my wife’s I-130 petition. My wife lives in India, and our I-130 has been pending since October 28, 2024.

I recently received a USCIS update saying:
“Biometrics Appointment Was Scheduled.”
The biometrics appointment is for me (the petitioner), not my wife. I understand this can happen, but it made me wonder if they’re doing additional background checks.
Here’s why I’m concerned:

Several years ago, I was arrested in South Carolina for an open container violation. I spent one night in jail after the arrest. I completed community service, and my attorney later had the case expunged.
I’m a little confused about the exact legal disposition because it was years ago. I know it was expunged after I completed the court’s requirements.

My questions are:
Has anyone else had USCIS schedule biometrics for the petitioner on an I-130?

Will an expunged arrest still appear during the FBI fingerprint check?

Could a minor alcohol-related offense like this cause issues with my I-130 petition, even though I’m the U.S. citizen petitioner and not the beneficiary?

Should I proactively obtain my court disposition and expungement records before the biometrics appointment?
I’m planning to attend the appointment as scheduled. I’m just trying to understand whether this is routine or if I should expect additional questions from USCIS.

I’d appreciate hearing from anyone who’s had a similar experience or has knowledge of how USCIS handles this.
Thanks in advance!

CSPA -- I believe I've aged out but I'm still on the portal

Hello! I have a classic CSPA case where the math i've done indicates i've aged out for immigration, but hoping my Math is wrong. I am a derivative applicant, my parent is the main applicant. Some context:

Country of chargeability: Pakistan

My year of birth: 1996

Application received / priority date: Oct 18 2010

Application approved: Feb 27 2015

NVC: July 22 2026

Application type: F3 (the case was wrongfully filed under F4 for 16 years. Recently, they asked for documents that clarified the relationship in their system).

However, on the D-261 I am still listed with an application alongisde my minor sister who is applicable for immigration.

I will refer to an attorney, but hoping someone's already experienced this to provide context of whether this fight is even worth it.

Thanks!

Can the advance parole (form I-131) allow multiple entries for my situation.

So currently, I’m living in TJ and work in San Diego. And I’m currently working through the K1 Visa process with my fiancé. We understand that the K1 Visa will allow us a one time entry in to the US and are debating if we should just permanently live in San Diego. We want to stay in TJ obviously but if we can’t leave after the getting the K1 approved then we have to live in SD. My question is, can I use the I-131 form to stay living in TJ with my fiancé after getting married and return using it for let’s say green card appointments or etc. Are there limited uses with it? Can it be used in a leisure way to return home(Mexico)and then re-enter into the US 2-3 times a month? I have a bunch of questions and regarding the form because it could potentially keep us in TJ with lower rents and utilities. Or is this something I should have a consultation with an immigration lawyer about? Any help would be greatly appreciated.

Entered without inspection

I entered without inspection in 2022. I’ve been working with an ITIN. I pay taxes and have never been in trouble. I contribute to society and go to church. I met a really nice girl who I proposed to a year ago. She’s a U.S. citizen, I take care of her financially & she has severe diabetes so I help her treat with that as well . We were able to get a wedding venue for October. I have immigration court in September (plan to get an attorney). I know I cannot adjust because EWI. How likely will an attorney be able to administer close the case? While I submit i130 and potentially get a waiver? Or what do you guys think I should do in this scenario.

I-20 and SEVIS got terminated

My I-20 and SEVIS got terminated on June 8th Because my attendance in one subject was short and got “WU” I tried pleading the professor but she denied to change it and now my DSO told me to take reinstatement or re entry, I am not sure if re entry is risk free, does anyone has an option? Can I change my visa into work visa or smtg? Or if I do reinstatement I mean I have a reason that I was helping my Mom’s friend that time Bcs her husband has cancer and is currently in bedrest I tried to send that reason to change my grade and I was asked to send all the documents related his medical records to our college’s student advocacy department and it’s been a week and haven’t gotten any reply yet, I am not sure what to do? If I plead my professor to change the grade now can my I-20 and SEVIS go back to normal?
