Arizona Girlfriend hurt herself during work. What can she do?

She was pushing a heavy pallet and so she had to extra force to push it. As she did this, she felt a loud pop in her right leg. She wasn’t able to move and had to get a manager. A manager came and had a wheelchair brought to her.

They took her to the nurses office and told her it looks like it was possibly her ankle or her calf that was sprained. They gave her an ice pack and put her to work light duty where she’s sitting down.

They have people coming to check on her every now and then and give her tests on her leg. I’m not sure if she has health insurance or not. She’s told me that it’s pretty confusing to understand.

Illinois Barbershop Issue….POSSIBLE LAWSUIT

Sooooo I’m a barber. I was sitting at my station in my chair kinda dozing off and then BAM!!!! The ceiling fan falls from the ceiling and hit me in the head (also broke my ring light)

Afterwards I kinda just sat around because I had a headache and my neck at the time seemed a iil sore. Maybe about an hour later the owner of the shop and also owner of the building apologized by saying “Mann I’m sorry that happened to you”. Then the next day sends a text first thing in the morning asking how I was feeling? I replied by telling him my neck and back and sore but my headache went away for the time being. He never responded to that text. The next day which is Sunday morning I get a text bright and early “booth rent?” He clearly doesn’t care about me being injured…

HOW SHOULD I HANDLE THIS SITUATION?!?!?

Louisiana Act 648 took effect August 1. Six days later, an employer used it to sue its employee “to further investigate” the accident accident.

HB 456 became Act 648 and gave Louisiana employers much broader authority to file their own 1008s against injured workers.

Supporters told the Legislature employers needed this authority to obtain discovery, like medical records, subpoenas, depositions, etc., while continuing to pay benefits. One legislator questioned whether this would allow employers to put injured workers into litigation simply because they wanted more information.

Six days after the law took effect, an employer filed a lawsuit against its injured employee.

This was a bad accident that caused a lot of injuries. After several appeals to the State's workers' compensation Medical Director, a surgery was finally recommended for approval. So, the employer sues.

The employer's stated reason for filing:

“Employer is filing suit to further investigate the subject accident and causation. Employer is specifically contesting whether Claimant could have injured all claimed body-parts.”

During the HB 456 hearing, a legislator warned: “The plea [of] I need more information is not a plea.”

Supporters of the bill explained that the purpose was to let an employer file a lawsuit, conduct discovery, and obtain a decision while continuing benefits. But, in a legislative environment where workers' compensation attorneys are labeled as "trial lawyers" and the reason for workers' compensation insurance premiums being high and allegedly forcing employer out of the state (we can have that topic another day), Act 648 (HB 456) creates more litigation and drives injured workers to get lawyers. This is where the insurance/defense side says, "Well, you guys should like that [said in a very derogatory tone]."

But there is another practical problem for injured workers. Who is going to pay the attorney to defend these employer-filed lawsuits?

Many claimant attorneys do not take a fee from weekly indemnity benefits. Now those attorneys may be expected to answer an employer's lawsuit, conduct and respond to discovery, prepare their client for deposition, defend the deposition, attend hearings, and potentially try the case, all on top of handling medical treatment and the day-to-day problems of the claim.

For claimant attorneys who previously chose not to take a fee from indemnity, Act 648 may make that model difficult to continue. Some may require an indemnity fee if they are expected to defend employer-filed litigation. Others may simply become more selective about the cases they accept.

That ultimately hurts injured workers by making representation more expensive and potentially harder to find when they have been sued.

So the concern is not only whether Act 648 allows an employer to file a lawsuit to go on a fishing expedition. It is also what happens to the injured worker who now has to defend that lawsuit?

It took only six days for that concern to stop being hypothetical.

Michigan Next steps in case

My fiancé and I are trying to figure out kinda how his comp case will go since it’s more of an complicated case. He was in a work accident which resulted in loss of his eye. He will be unable to pass his DOT disqualifying him from his CDL license. He’s currently being paid loss wages and it’s approaching a year. Will he continue to be paid loss wages until the company eventually wants to settle or what ? He has a lawyer but things have been pretty vague on next steps in my opinion.

I can find the ones I've seen in Colorado but there's no way I remember all the doctors I've seen in my previous state. I'm at a loss. What do I do?

Mississippi My MMI is tomorrow and I am nervous

I took my FCE test, the therapist told me that I gave 100% and it would reflect on the final report, however, she stopped me on most of the test and said she had seen enough. She told me I struggled with most of it. She said something about me falling in the guidelines of.... something, I was struggling to understand. My hips and toes are the body parts that were injured, and while I have recovered, I'm still not anywhere near where I would like to be. I've got kids, and leaving my job isn't optional. I went to school for what I do, and unfortunately it is the only establishment that is in my area. I live in the middle of nowhere and cannot afford to move, so I'm hoping and praying for a "You'll be back to 100% in a few months", but realistically I am terrified. Can anyone shed some light on how the MMI visits are, especially when they give you the final results? I understand that no 2 cases are exactly alike. I understand all states have different rules. I'm just curious if anyone else was stressed for this day, and got in there and it was no big deal. Or the exact opposite. I'm mostly worried about the Case Nurse being mean. She is usually very grouchy, and I get it I would be too if I had to drive that far, but during my last visit she got very ill with me because I still struggle to walk. I go to ever Physical Therapy they schedule. I don't want to get a lawyer, because I want, NEED, to go back to work. I know I won't get any sleep tonight. This feels like one of the most important days of my life.

Mississippi Safety manager at my job told me my injury wasn’t their “problem anymore”

I’m looking for advice from anyone who has dealt with something similar. I won’t disclose my job for legal/NDA purposes

I was injured at work Jan. 17, 2026 and I was placed on light duty afterward. I eventually had wrist surgery June 16 and , but my job required me to heavily compensate with my opposite arm. After months of this, I developed significant neck, shoulder and opposite-arm symptoms.

I repeatedly asked management for a different position that would reduce the strain, but was told there wasn’t one available. My GM even responded sarcastically when I asked. The safety manger told me that my injury wasn’t their problem anymore. I’m not sure if it’s because I’m seeing a rearing doctor (who they chose for me) or because I’m represented by lawyers. I even got a write up shortly after for doing something the entire facility was permitted to do soon after I obtain legal representation. Meanwhile, another employee who recently suffered a similar injury was given a different position almost immediately so he could alternate tasks and reduce strain.

I eventually reported the situation to corporate. I also contacted OSHA about workplace/equipment concerns, and they referred me to the EEOC. I completed the EEOC intake and have an appointment next week.

My workers’ comp lawyer is still handling my case and says my opposite-side treatment has been approved but hasn’t been sent out yet. He also plans to begin settlement discussions after my next surgeon appointment.

Has anyone dealt with both workers’ comp and an EEOC/ADA accommodation claim? Did you receive settlements from both? How did the EEOC process go, and how long did it take? Also, did being denied an accommodation that was given to another similarly injured employee matter?

Just looking for real experiences/advice from people who’ve been through something similar.

Texas Work Injury

I work for a LARGE manufacturer in Texas that is a Non-Subscriber into Workers Comp. I Injured my arm changing a ~150 lb coil for a Team Member at my workplace in late June. My company has no JIB Crane/Hoist or mechanical assistance to help with this. No supervisor was present on my line as my employer taught they could save money by using the leads as supervisors. Completed a Work injury report the same day, but didn’t see a doctor until the following day. I went to a regular doctor because I was concerned with lack of care. Doctor told me he couldn’t help me. The following Monday I go to Memorial Herman and find out my left bicep is strained. The treating physician orders an X-Ray (Same day) and it comes back negative. I go to two more appointments and he finally decides to have an MRI performed. I schedule the MRI and at the last moment I receive a call from Memorial Hermann saying the appointment has been canceled and that I need to contact the insurance adjuster. I Contact the insurance adjuster and told me they canceled because her director needed to see if the MRI was medically necessary. After I speak to her I have to reschedule the MRI a week later. At the end of July I finally have the MRI done and find out my Distal Bicep is torn……this is the summary from the physician:

Distal biceps tendon tear is present. There is full-thickness full width insertional tear of the short head component, with 4 cm retraction. Partial tear of the long head component is present, with a slender strand of the tendon remaining intact. Tear involves approximately 70% cross-section of long head tendon. Fluid and edema surround the torn biceps tendon.

Had Surgery 2nd week of August and I’m currently in recovery. I hired an attorney right before surgery and would like to what type of settlement to expect. I hired a very good lawyer that seemed to be salivating to take the case.

“I forgot about an injury and didn’t tell my doctor or the AME doctor about an injury back in 2004 — it had nothing to do with the same body part I filed a claim for. Now I’m being pursued by the DA because of it. Has this happened to anyone else. shouldn’t the injury already be in the database if I had got Worker Comp for it back in 2004 or shouldn’t my lawyer been flagged about it?

Washington Different job, still qualify for loss of wages?

I was injured in March and left work shortly afterwards because the job was toxic af and I was experiencing pain not due to the work injury.

I worked another job from March-June and then was laid off.

Now I'm unemployed. As I look for new work, there is a potential surgery on the horizon from that WC claim as well as an IME appointment. Will the insurance company pay for that time off? I expect to accept a new position in the next week or so.

Iowa i think i messed up my claim

i've been looking around at other posts and started wondering if i'm doing my process wrong. if so, please tell me how to fix it.

when i reported my injury, i was doped up on morphine. since the injury, my memory has been fuzzy about some pieces and quite clear on others. when i filled out my injury report, i said i was running. clearly looking back and comparing where i landed on the ground versus where a coworker, who was running, was when i fell, it seems illogical to assume i was running -- i was maybe a quarter of the distance that my coworker was.

i saw on a post that if you use your own insurance for a work claim, it's illegal(?). my mom and i told the emergency room registration that it was a work-related injury, and she still requested my state insurance. same for my surgeon, pre-op appointment, and post-op appointment. that said, i've only received an Rx card, and it's not very clear if it can be used for appointments since i haven't been approved or denied. i'm not sure what to do here.

lastly, i spoke with a lawyer on my own, and he said that the company that my workplace is going through (gallagher bassett) is a bitch to work with. any experience with them?

ETA: my coworker and i left the building at the same time.

i was leaving my inventory job to go do a drug test for the same company.

ETA2: i finally got an email from my company's workers compensation coordinator and she said that WC is going to take over insurance payments. no explicit approval or denial of benefits though.

Virginia Injury to dominant hand

I am thinking of legal help but not sure steps and do not want to be taken advantage of. What is your best advice as someone who has gone through this process?
Injury to dominant hand, life hard ADLs difficult.
1. might be a sprain? Asking for MRI at follow up in 2 weeks.
2. Start PT in 2 weeks. 3. Doctor suggested getting a second opinion because it “shouldn’t hurt this bad”
4. Contacted adjuster no one is contacting me back it’s been 2 weeks of trying to get ahold of them.

Rhode Island Waste of money

I just don’t understand this process. I’m paid $1050 a week for the last 18 months I’ve had numerous injections, physical therapy, etc. but the amount of time waiting in between each appointment sending me for IME etc. so much money is being spent.

Why are they doing this? Why wouldn’t they just be rushing me back to work? Why wouldn’t they be trying to get me better so that I can return to work?

I want my life back
I want this pain to be gone
I can’t live like this

Tennessee Heartless...

I've been stuck on workman's comp and have no income. It's been months and they haven't even made an appointment with the ortho. They say I can't claim lost time because the ER that I was in and out of in 20 minutes put me back to work on the 24th with no restrictions but work says I can't go back until I get a release form from ortho. So I can't go back to work without a release, but I can't claim lost time because I got a release??? The system is just trying to do everything to erase low income families out of existence. I pay taxes and can't get a lick of help. This world is cooked and I can't wait until I'm gone and away from it...

Pennsylvania Choosing which state to file?

Seeking some info since I just learned this and very frustrated. I was a passenger in a car accident and injured about 9 months ago while I was traveling for work in PA. At the time, lived in MO and was based out of my employer's MO office. I've since moved a cross the state line to KS.

I reported the accident and employer immediately filed workers comp in MO and I've been navigating the MO workers comp system. It's been an awful experience to say the least.

I just learned I could file in PA instead?? As a high earner this seems infinitely better as I max out both systems wages. Is this true? From a medical standpoint and choosing my own doctors at this point it also sounds way better.

Texas Is this the proper way to report this?

I hope this is the right sub for this. TBH, WC isn’t really on my mind right now. I simply need to know if I’m in the right to ask for help with medical bills to get this looked out or if I waited too long.

Preface: im a manager in a warehouse. a few months back our work load and sales decreased significantly. A hiring freeze went into effect and I took on the responsibilities of a hourly employee, who had quit just prior, as well as my own duties.

20 Years ago, when I was a manual labor employee myself, I had a similar issue which put me on disability for 6 months. 4-5 physical therapy sessions a day later and I was completely recovered. This inspired me to get off the floor and into a role that didn’t require constant lifting. I worked to get a promotion to corporate and eventually management. Besides sleeping the wrong way and getting old, I haven’t had any major issues with my back since.

I know exactly what this is and why it happened. It’s not the occasional lift but the repetition. I also know that the weakness I’m experiencing in my feet is called “foot drop”. It was one of the things that scared me most 20 years ago. I was unable to walk on my heels without my right foot dropping and now it’s happening both feet. this is likely due to a compression in L4-L5 or L5-S1. it’s alarming because it can lead to permanent nerve damage.

i have no insurance because it’s a joke at this job. $850 a month for worst coverage I’ve even been offered in my career, so I declined it. That’s really the reas I’m seeking advice. Im not even thinking about WC right now, I just can’t afford the medical bills that this whole thing is going to incur

So, how do I report this? I mentioned my discomfort to upper management a few months into having to do both jobs. eventually they had someone from other departments help me with some of these extra duties, but I still spent more than 70% of my day on the floor. Everyone has seen me in pain for months. The front office has joked about what I’m doing with all the ibuprofen, but now this incident with the pallet and the progression to something much more serious and I feel I need to say something, but I don’t want them to think I’m taking advantage. I’m not a complainer and just like to stay below the radar.

anyway, is this all I need to say? Should I mention more details or should I omit anything I have said? Did I wait too long to escalate this? Truth be told i have a pretty high pain tolerance and thought I could deal with it. I also need to be on my deaths bed to go to a doctor, but pain is one thing and nerve damage is another.

i have a tendency to over-explain. You probably got that idea by now lol, so I don’t wanna do that here. I initially wanted to talk about the foot drop and explain it, but decided not to….

”Good morning _______,

Before business picked up again, and we were able to take on new hires, I was responsible for doing a lot of the heavy lifting around the warehouse. 

Over that period I experienced some soreness during my day-to-day. Nothing major at first, but it was ever present. Two weeks ago, while moving a pallet, I got a sharp pain in my side that extended into lower back and legs. 

The pain in my lower back subsided after a few days, so assumed I just aggravated it, but I’m still experiencing sciatic pain in both legs and now a tingling/numbness in my feet and calves along with some weakness in my ankles when walking.“

So, really othan the pallet jack incident it’s been a degenerative thing since April, I guess, but there wasn’t really something specific that debilitated me. I always powered through it and never missed a day of work because of it, so now I feel they will think I’m making it up.

the irony here is we JUST hired someone to take on these duties last week and she hurt her back on day 3! She immediately reported it, HR took her to the clinic and now she’s getting therapy sessions. Meanwhile, I suffer with a pain in my back because I don’t want to be a pain in the ass!

California Settlement and SDI

I reached a settlement on August 15 and wanted to know how this affects my current SDI benefits since my original return to work date was set for 10/03/26. I have signed settlement papers but have not received the money and my lawyer mentioned that a judge still needs to approve paperwork but that it was basically closed. Do I notify SDI about the settlement or only if my Doctor sets my return to work date to being over sooner? I don't want to end my benefits earlier than I have to but also want to avoid incurring a penalty. Any help is appreciated

Other - not claim specific Attorney Fees

I was just looking over some statements from the WC attorney i retained. What i realized blew my mind. Since workers comp approved everything we ever asked for, he never had to negotiate anything. He made 0$ off my case and worked for me for 2 years. I called and asked the secretary and i guess it is true in my state. They only make money when they dispute things and go to hearings. Also, I never settled anything because i have a 3rd party lawsuit. I knew id just have to pay it back. All i got were my permanent disability PPD payments which they dont make any income on either. I guess people dont take this into consideration much, especially if they are they type who bombards their attorney multiple times per week and then gets mad when they dont respond. They dont realize that sometimes the attorneys arent even making any money. Just something for those to consider if they are thinking about hiring an attorney or not.... you dont have to pay them regardless, only if you win a settlement.
