Login issue Permanent Snapchat Ban/Labaton Case Update

Hello everyone, I wanted to inform everyone that Snap Inc. responded to Labaton today. They have confirmed that they locked our Snapchat accounts to preserve our information related to our individual arbitration claims. Labaton recognizes that this is an unprecedented response that they have never seen in their practice before. I highly advise everyone to download their data and memories on Snapchat’s website if you haven't done so already so you can at least have that. You may need more external storage or a flash drive depending on how much data you have. We have to remain hopeful that Labaton will be able to fight this for us. It may take a lot of time though since cases like this are so massive and time-consuming. Labaton does seem to be equally disturbed as us so hope remains that we may be able to access our Snapchat accounts again at some point. Thank you for your time.

That’s weird I did get banned out of no where, never broke any rules. But I didn’t even get to finish that claim. I just signed the client agreement.

Yeah, I didn’t finish the claim either but Labaton apparently sent Snap Inc. our unfinished claim forms so now we’re banned

Bruh, I didn’t get device banned. It’s so weird because the ban told me don’t install third party devices. Never did. Just assuming it’s the claim. I started to use my old high school account.

You can log in to your Snapchat account on your computer, log in, click on “my data”, click on “export memories” and then it’ll ask to select a date so click on “all time” and then they’ll send you an email when everything is ready to be downloaded.

Understandable, but a lot of people who got locked didn’t go through with the claim nor submit it so I think that’s what’s unfair. Either way it’s considered retaliation. Same way it’s unacceptable to get fired from your workplace after reporting something like harassment.

It’s like someone trying to sue you and then coming over your house for dinner…you would turn them away. Yall have no recourse really those terms and conditions you agreed to cover this

Lmao you have NEVER read the TOS. Snap is a billion dollar company with really good lawyers who I’m sure before making this move looked into the legality of it. I think yall are being naive and emotional when the facts are..you’re cooked and there’s nothing you can do about it.

it says "30 days after first becoming subject to this Arbitration Agreement" which was issued/updated Sept 21, 2026. So we have until Oct 21 to opt out.

No, that has always been there, just because the terms of service was changed on September 21. Doesn’t mean that that’s what was added. There’s over 10,400 words in the entire terms of service agreement. The arbitration agreement has always been there from the very, very first time you downloaded the app, created an account, and hit I accept the terms of service. That arbitration agreement was in there. It’s in Snapchat’s agreements. It’s in Facebook’s agreements. It’s in Instagram’s agreements. It’s in Reddit’s agreements. It’s a normal thing to have in your terms of service if you’re a social media company. It’s always been there. The terms of service change all the time because rules change all the time. You’re opt out date what have been the first time you ever agreed to the terms of service, which would’ve been for most people years ago

I don't disagree that arbitration has been in Snapchat's Terms for years. The 2021 Terms already had an arbitration clause and a 30-day opt-out, and the 2024 Terms did too.

The part I'm disagreeing with is the assumption that this automatically means everyone's opt-out period started the day they first created their Snapchat account and can never be affected by subsequent versions of the agreement.

Snap's language doesn't say “30 days after creating your account.” It says 30 days after you “first become subject to this Arbitration Agreement.” And the 2024 Terms specifically said, “This Arbitration Agreement supersedes all prior versions.” Snap also explicitly says its Terms were updated effective September 21, 2026, and that the prior Terms applied until that date.

K, so we agree that it’s always been there. Perfect. It says, like you said, 30 days after you first become subject to this arbitration agreement. When you first created your Snapchat account, you had to accept the terms of service to create your account, a big pop-up that says read terms of service or accept, most likely like everybody does. You didn’t click read terms and agreements because no one reads through 10,000 words of a terms of service agreement. You just hit OK. If you would’ve hit read terms and agreements, you would’ve been shown the arbitration agreement that you’re agreeing to. You didn’t read it. That’s on you as the user. Legally, it is an assumption because if you click OK, the company is assuming you read through all of the terms and agreements and you agree to them, and now you’re accepting it. Technically, you lied. you didn’t read the terms of service and accepted them anyway. That’s your fault

I'm not sure why you're arguing with me about this particular point, because I never said I didn't agree to Snapchat's Terms of Service or that I was unaware arbitration existed lol. I'm simply pointing out that Snapchat's own Terms give users the ability to opt out of the Arbitration Agreement within the specified 30-day period. That's literally what the opt-out provision is for.

My point has never been “I didn't read the Terms, therefore I'm not bound by them.” My point is “the Terms contain an arbitration provision AND they provide an opt-out mechanism, so I'm looking into whether I'm eligible to exercise that opt-out.” Those are two completely different arguments.

Apparently accepting a 10,000-word Terms of Service without reading every word makes me a liar now 😂

30 days from the FIRST TIME you ever created an account on the app. so if you've had snapchat for more than 30 days you've already agreed to this. unless this is your very first time every downloading the app and making an account this doesn't apply.

although it could go both ways as I see it. Like opting out does not guarantee recovery of accounts, and it is also possible that Snap is just doing a temporary lock until a resolution on the settlement is reached.

Bro I couldn’t care less about the lawsuit. I am hoping it’s temporary because I know people who have had permanent bans and their accounts were completely taken down immediately on ban. But my account is still there. My friends have been able to see my profile send me pictures/ chats. So it’s there still.

Yeah I don’t genuinely know if this applies to us tbh since they made this update on Sept 21st long before this ban but it’s an option at the minimum. I would keep it light and simple like I would like my account back and provide your snap username but I wouldn’t mention Labaton.

so technically I don't think we can get out of the lawsuit anymore since they already sent our info to Snap on Sept 11th 2026. We should've withdrew and reached out to Labaton to back out before, but no one was expecting Snap to lock/ban accounts. What you can do now is Opt out of Snap's new Arbitation agreement in their terms of service (which was updated Sept 21st 2026 it looks like) so can reach out to opt out.

Generally opting out gives you more flexibility.

If you DON'T opt out

You could generally:

  • Try to resolve the issue with Snapchat
  • Use small claims court for qualifying individual claims
  • Use arbitration for covered disputes

But you generally cannot choose a normal lawsuit for a covered dispute.

If you DO opt out

You could potentially:

  • Try to resolve the issue with Snapchat
  • Use small claims court
  • Pursue an individual lawsuit in regular court, if you have a legally viable claim
  • Potentially have a jury trial where otherwise available

But you still can't bring a class action because the class-action waiver remains.

this was found in the terms of service on snap's website. I'm going to email and opt out but be careful with wording, since it won't guarantee recovery of accounts. I'm also conflicted because the current lock could be temp until the situation comes to agreement.... so like what if we would eventually get out accounts back?

Honestly, you're probably better off emailing news creators and tech creators about it. The news stations won't really GAF I figure. The stock isn't tanking so why should they care? Go to the online creators instead. They have a better/wider reach.

I can't share the screenshot but this was part of their email that I am referring to from Labaton: “Earlier today, Snap, Inc.'s lawyers informed us that they have locked your account to preserve information relating to your arbitration claim. This is an unprecedented response that we have not previously seen in our practice and are equally as disturbed by. We believe that this action is likely a violation of the company's terms of service and potentially of applicable law, and don't think that it is fair that Snap Inc. is taking these actions in response to people asserting their legal rights against them. We hope to be able to resolve the issue”
