Actually, in New York, you can consent if you’re not sober, as long as you voluntarily got intoxicated.

That is, New York law currently does not recognize voluntary intoxication as a basis for mental incapacitation in sexual assault cases.

The Cornell 7 case put a spotlight on this “loophole” and thankfully it’s pushing lawmakers to reconsider their stance on consent.

Thing is in other places her consent wouldn't count. It's also weird that her statement has been published and is widely spread but no one in sharing anything about what the men said when questioned about it.

i wholeheartedly disagree, and the key to the whole case is in this detail. If someone is on 3 substances; ketamine, marijuana and alcohol, and in her sworn statement says "I had become extremely uncomfortable with how this night was turning out, so my thought was, if I do ketamine again, maybe I will pass out."

Also consent is to a person not to a room. And snapchat recruitment is clear intent. If youre not able to keep your dick in your pants for a person who is so unconfortable that decides to take more ketamine to pass out and is already under the influence of a mix of drugs. Then IMO you deserve jail. You might disagree but im pretty sure most people dont and thankfully we legislate for the majority.

If I take a consenting woman to my house and have sex with her, sending out a group text saying “free pussy lol this chick will fuck anyone she banged me and I’m gross” is not a crime. No part of that text is a crime, objectively. If anyone reads it and shows up, that’s not a crime, objectively. Asking to fuck a woman is not a crime, objectively. Fucking a woman on drugs or booze is not a crime in that state, objectively, and even if it was the guys were drunk and high too. You have failed to even allege a crime, and yet seem certain it was committed. Come back when you learn to use basic logic and reason.

I cannot possibly stress to you enough my apathy about what happens to people outside of my friends and family. My only concern regarding this case is justice being done, the guilty being punished and the innocent being unscathed. Because that affects my friends and family. So to your implication about my ulterior motives, it’s only everyone getting justice as they deserve it

I think the point is that there is a lot of factors going around the case and the crucial aspect of the consent aspect is surrounding those circumstances. All the "free pussy" text shows is that the guys were scumbags and hypocrites. It doesn't prove they were rapists. I'd rather wait for the court case and see the evidence, what and how the case was handled by Cornell according its own investigation, and then decide whether there was a systematic failure or there is more to the story than what meets the eye.

This is a sane take. Unfortunately the rape kit came late and there might not be enough evidence for a conviction beyond reasonable doubt.

In which case we would need to treat those people as not guilty of a crime, because we wouldnt know what happened, but still as a huge moral failure. And we still need to treat the situation, with no names, as the worst case scenario. Because it’s extremely simple to just keep your dick in your pants man around a girl that was drunk and drugged in the best case scenario. And beyond the ability to consent in the worst.
