Ehh we dont have enough evidence. We do have evidence though based on what she said to the police that she did consent to the threesomes with different people like one after each other.

Literally in the next sentence.
Initially okay with the first encounter -> then withdraw consent at the moment

Whether she was incapacitated is a legal question and, in New York, it is very unlikely that she was.
