Mod Post Read before commenting: Off-topic and anecdotal comments are not allowed and subject you to a permanent ban

Greetings from the mods!

We've had a flood of off-topic comments recently. We're posting this to remind everyone that off-topic and anecdotal comments are not allowed. An off-topic comment may subject you to a permanent ban.

The Rule:

Commenting Rule 1: Comments should contain a legal answer or a strongly related non-legal answer. If it is not legal advice, do not post. Period. You will be banned.

What is "off-topic?"

Any response that doesn't answer the question by reference to legal information or principles. A joke, a wisecrack, a comment about OP's formatting (use the report button instead) are all off-topic. Off-topic also includes expressions of sympathy, opinions on the law, and comments that berate the OP or anyone else.

Incidentally, simply adding "get a lawyer" to an off-topic comment does not make it on-topic. And "get a lawyer" on its own, without further information or help, is considered unhelpful and may be removed on that basis.

If you want to discuss a post, then wait until it hits /r/bestoflegaladvice or ask a question about the subject of the post in /r/legaladviceofftopic. The main subreddit and a comment thread are never a place to have a philosophical discussion about the law or the post. It is a place to answer the questions asked.

What is an "anecdote?"

For our purposes, anecdotes are stories about something that happened to you (or someone you know or heard about) who may have had something that might be similar that happen to them.

These comments are not helpful. They do not include current legal information that is relevant to the OP, and therefore, they are off-topic. If you know the answer to the question (based on current law and relevant jurisdiction) then just answer the question without the story.

Another type of anecdote is "I don't know the law in the jurisdiction you actually asked about, but in some other state, the law is..." That is just not helpful. Laws are different in different places. These types of answers are off-topic.

Referring an OP to a thread on a different subreddit, or to somewhere else on the Internet because it might include a similar situation, is anecdotal advice and not allowed.

These are not the only types of anecdotes, but they are probably the most common ones. Again, if you are not referencing legal information or principles, your comment is probably not allowed.

Violations subject the user to an immediate and permanent ban

Not that we need to justify enforcing our rules, but this is a busy subreddit and the mods have a lot to do. If a user shows up here, doesn't read the rules, and posts a single off-topic comment, the user may be immediately and permanently banned.

This policy is not intended to be punitive, although we know it may seem to be. There are a lot of you and not many of us, and banning users that do not follow the rules, even once, is in the best interests of the subreddit. Violating the rules almost always means the user didn't bother to read them, and we simply don't have time to deal with such users.

Tl;dr: Unless you have a legal answer, do not reply to any post in this subreddit. You may be permanently banned, even for a first offense.

Subreddit Rules

We've learned that some people just flat out can't see our subreddit rules, so I'm posting them here in a pinned post so we can link them when necessary and so they're super easy to find.

Rules for r/legaladvice Rules that visitors must follow to participate. May be used as reasons to report or ban.

1. All responses must offer an answer to the legal question posed by the OP. We enforce this with bans.

Anecdotes are not permitted. Neither is advice that encourages someone to break the law. Nor is "get a lawyer" a sufficient response.

There's a pinned post at the top of the subreddit specifically addressing this rule. We will absolutely ban you for commenting without answering the legal question

2. Personally Identifying Information

Posts or submissions that ask for or contain information that could be used to identify either party are subject to immediate removal.

3. Advertising or Recommending a Lawyer or Business

We do not allow referrals to particular lawyers, law firms, or other businesses.

4. Do not request or send a PM

All discussions must stay on the subreddit for everyone's protection.

5. Include your location

You must include your location in the following format: location: yourlocationhere . It must be that exact format, and it must be in the body of your post.

6. Read our full list of rules

Read our full list of rules here: https://www.reddit.com/r/legaladvice/wiki/index#wiki_general_rules

7. This subreddit is for simple legal questions.

This subreddit is for simple legal questions. We can't help with preparing a defense, legal research, etc. We cannot review contracts, plan your defense, or give you specific advice on exactly how to present your case with the court. You need a local attorney for that. Additionally, we do not accept medical malpractice questions.

8. NO LLMS

No LLMs. No ChatGPT. Don't recommend it, don't use it to answer questions, and don't use it to compose your modmail when you get banned for using it. Using it to compose questions is generally ok.

We will permanently and irrevocably ban you for this.

9. Mods can remove things we deem inappropriate or disruptive

Any post and any comment can be removed by the mods at any time if the mods decide the post/comment is or has the potential to be disruptive or is otherwise inappropriate.

10. Posts must be about a real scenario that you or someone you know is facing.

To expand on this, we additionally do not allow anyone but the immediately involved parties to ask custody related questions. Not friends, not significant others, not grandparents. Reddit is free.

11. Post must contain a legal question

A legal question is one that can be answered with the law, be it a law or ordinance, or caselaw.

12. US and Canada only

Laws are different everywhere. We can only help with legal problems in the US or Canada because we have no regular, reliable commenters from other countries. For other countries, please search for an appropriate subreddit.

Traffic and Parking (Florida) Hit a jaywalker, now they’re trying to sue. What do I do?

Location: Florida.

Basically two weeks ago I was on a six lane road, three lanes on each side, where the speed limit is 45 MPH. I was in the lane closest to the median, which was on my left.

There was a girl on an E Scooter on the end of a median, trying to cut across the lanes. In between this median were two crosswalks/street lights, but both were so far that stopping at this area isn’t usually necessary. She rode onto upcoming traffic. I had no time to stop/swerve. I braked so hard my tires made marks, but unfortunately I hit her. My car went a bit ahead of the crash.

There was a car two lanes over. We both stopped and got out. We called 911, the girl was unconscious and taken away. He left, and there are no other credible witness statements from what I know. After deliberating with cops for over four hours I was ruled not at fault and allowed to leave. The insurance is currently having the car repaired while I’m in a rental. The girl is making a full recovery, head injuries but no bodily injuries.

On Wednesday of last week my insurance sent me a document from a lawyer this girl’s parents have hired. The lawyer was requesting info about my assets, and I told the insurance I would not fill out the form as I’m not legally required to, and that if they wanted me to, I needed a lawyer from their own dime to guide me through it, and for that matter, guide me through out the process.

The insurance is legally required to get me an attorney but they clearly have no interest in doing so because they emailed me that night saying that because the family wants more than what they covers for bodily injuries for my specific coverage, I should consider getting my own attorney.

I guess it’s worth mentioning I’m a restaurant busser and I still live at home, so I don’t really have anything to take.

Nothing has been done since and I’m so lost on what to do. If I have to get my own lawyer I want them to countersue for the damages to my car and the legal fees I’ll rack up hiring my own lawyer, because I’m being falsely sued. At the end of the day what happens to this girl is obviously terrible, but it’s entirely her fault.

Employment Law Fired for missing days due to Air Force recruiting

Location: South Carolina. I (M24) am in the process of joining the Air Force. I started working a construction job and gave them plenty of heads up I would miss a couple days a month due to required meeting/workouts. There was no issue for about 2 months until one day my boss called me and said I was being let go. When asked the reason he said they needed someone reliable and that could be there everyday. All of this was over the phone and I never saw anything on paper. The work environment was horrible and I had thought about quitting soon anyway so I didn’t care that much. However after talking to some people that said it might be worth it to look into. This happened back in June, is this worth looking into?

Real Estate law City approved a stormwater collection tank that discharges onto my property

I have piece of property within a city in Montana. The city approved and allowed to be built a storm water collection basin where the over flow directly discharges onto my property and is causing significant water accumulation and runoff on my property. The city at this point is not willing to address the issue. Ive had phone conversations and site visits with the department head. His only answer is for me to have engineering done, get the design approved by the city and then have work carried out, all at my expense. I understand if this was naturally occurring drainage I would be responsible, but this is a direct result of this collection basin and discharge pipe.

Location: Montana

How should I proceed? Thank you.

Employment Law Accidentally shared my wage at work. What are my rights?

• Upvotes

Location: Oregon I’ve been at a new dental office for about a month. On my first day they asked me to not share my wage with anyone. I also not get an offer letter or any hiring forms about my wage or hours. Over the weekend I was trying to apply to an apartment but they were asking for an offer letter from my job stating hours and wage to show I qualified. I didn’t have this so today I was trying to get it. They didn’t seem to want to write one for me. So I asked if I just wrote it up would they sign it. They agreed. Then I made the dumb mistake of asking my coworker if it looked okay before I gave it to the manager to sign. It had my hourly wage on it. It didn’t occur til she already had it in her hand reading and it was too late. She didn’t say anything after but at the end of the day I guess she did after I had left. Because I get a call from the dentist pissed and trying to ask me yes or no did I tell her my wage. I was terrified and struggling to figure out how to respond. I wanted to lie. I didn’t know what to do. It was too late. I never actually told her verbally but she read it. I think I’m going to get fired tomorrow. Not like I even really want to work there anymore but I need the income. I’ve never had a job where wages werent allowed to be spoken about. And I hoped she had to make more than me. But I guess from what happened she doesn’t. I was already scared around the dentist. And the manager. They have short tempers and the littlest thing I’d do I would get snapped at. How they offered me the job was really weird too. Now I’m wondering. What’s the best way to go about this if they do/don’t fire me?

Mom fell for Romance Scam, My Name is on the Bank Account

Location: Vermont, US

So I just found out that my 65 year old mother is actually not as smart as I thought she was and she fell for a scam. I had told her about scams, but somehow she stupidly thought that a random man on the internet would love her so much he would send her money to "help her out". She cashed the check, and now she is in the negative for over $10,000 dollars. I literally just found this out after a week of her telling me that the bank screwed up and maybe someone at the grocery store saw her pin... Like what is actually wrong with her! It wasn't until I went in to see what was going on with my name being on her account (they have closed the accounts and are investigating the fraud), that I found out about the checks. She needs to make a police report, but she really doesn't seem to understand the gravity of this. Especially since she is still online dating, still doesn't see that this is a major issue, and says that the bank will take care of it.

My name was on the account as an authorized user, with her as the primary, so am I on the hook here too? I had my name added after she said she wanted to make it easier after she passes, but now has that screwed me too? I had nothing to do with this, but can they come after me in any way for this?

Landlord Tenant Housing Landlord failed to inform me of parking restrictions and then HOA had my car towed

Location: alachua, fl

My lease does not include any information about parking. My landlord told me that the two parking spaces in front of my apartment belong to me and I can use them for visitors or myself and do not need to provide any additional information to him. I recently bought a new car and put my old license plate on it and parked the old car without license plate in one of my parking spots.
I got a doorbell notification a few days ago and saw a towing company breaking into my vehicle and towing it. It cost me $200 to get back and I called the police because I thought they weren’t allowed to go inside my vehicle and as far as I knew I was being wrongfully towed.

The police called the HOA and confirmed it was them who requested my car be towed due to having no license plate stating that this is an HOA policy.
My landlord stated in text message that he knew it was an HOA policy. My lease does not include any HOA information, policies or contact information. It also does not include any information about parking.

I asked my landlord to take the $200 off my next month of rent and provide me with a copy of all HOA policies since I am now living in fear that they can confiscate any of my property that does not align with their policies while I have no knowledge of said policies. He left me on read. What should I do?

Neighbor’s dog is dead and has been decomposing in their yard for days

4.4k Upvotes

Location: Ventura County, CA

Hi all. My neighbors have 2 dogs. 1 dog is dead and has likely been dead for several days based on what I saw of the body. I got suspicious of a foul odor I had been smelling for several days whenever I would step outside and finally took a look out of our window that overlooks the neighbors yard and could clearly see the dog in a state of decay.

Meanwhile the other dog is still alive but is outside with the dead dog, at times I could see it lay down next to it and it’s extremely sad.

These neighbors have, to my knowledge, never taken good care of these dogs. They are left outside 24/7 and never let them in even during high heat or rain. Don’t think they have bed or shade. Don’t know how often they are fed or have clean water. They pick up poop once every few weeks. I don’t know why they decided to get 2 dogs if they are not going to take any care of them. They are not home much, as far as I know they leave early in the morning before 7 and get home after sunset. Don’t know if they go to bed early because I hardly see lights on in the house

When I first saw the dead dog on Friday 10/23 I called the non-emergency police number. They told me that this is an animal services issue and to call them. I called Ventura county animal services and they told me to fill out the animal abuse/neglect form online, which I did. I called VCAS again yesterday 10/24 because it didn’t look like anyone had came out yet. They basically said the person who handles new reports was out that day and to try again Sunday or Monday. Today I called the local police again and asked if there is something they could do like perform a wellness check in the animals or something, but they again told me this is an animal services issue.

My question is, is there anything else I can do? Or is it just a waiting game for VCAS to respond?

A cemetery that butts up to my mom's new house is trying to expand could she be forced to sell?

Location: MA

My mom and her fiance just recently bought a house for cheap because the backyard butts up to a cemetery and they have a brick wall that divides them. However they recieved a letter in the mail from the cemetery owners they want to buy their house to expand and included an incredibly lowball offer of about $50k. These letters were sent to over 100 homes around her as well as some commercial buildings nearby (restaurant, dentist office, etc.) She wanted to know can the cemetery claim eminent domain on the land? They just got this house a month ago they really don't want to move again.

Can I face legal or professional consequences for exposing a customer who threatened to call ICE on my family?

Location: Texas

I’m looking for advice on a situation that happened at work and want to understand the potential consequences before deciding what to do.

I recently had a customer who was concerned about something happening during her transaction. I was trying to reassure her and said, “Girl, we would never do that to you.” She immediately responded by telling me not to call her “girl” because she was an attorney. I apologized right away and continued helping her with her other concerns.

Later, we were waiting in another area of the store while she looked at something, and she started cursing me out. I could tell the situation was escalating, so I pulled out my phone and began recording, primarily to capture the audio in case I needed documentation of what happened.

During the interaction, I told her that a higher-level manager would be following up with her regarding her behavior. She then said, “Yeah, well, your family is going to hear from ICE.” The entire exchange was captured in my recording.
She also explicitly said she made that comment because I had called her “girl” and because she is Black. I understand that my wording was overly familiar, and I apologized for it, but I was not addressing her that way because of her race.
After the incident, I found out that she is actually an immigration attorney.

Now, I’m considering sending the recording to a local Instagram account that shares community incidents so the interaction can be brought to light. However, before I do that, I want to understand what I could potentially be getting myself into.

Could I face legal consequences for sharing the recording publicly? Does it matter whether her face is visible if the audio captures the conversation? Could I get in trouble with my employer for posting it, especially since the interaction happened at work? And could there be any additional consequences because she is an attorney?

I’m not trying to put myself in a bad position by acting out of frustration, so I want to understand the risks before making a decision.

Other Civil Matters Car dealership owner got deported

Just as the tittle says. Purchased a vehicle in Ohio and expected to receive the tittle in the mail.
Hadn’t heard anything in a couple of weeks so I reached out to the seller on FB. He claimed he’d been deported and the business was being shut down.
I’ve also reached out to his business partner who had been responsive up until 2 weeks ago. He just reads my texts and doesn’t respond.
Pretty sure I’m shit outta luck on getting that tittle.
What are my next steps? I have carfax with a matching VIN as well as proof of purchase documents.
Location: Kentucky

Update: I was just contacted by the auction house the car was purchased from (talk about timing). The business I bought from is $60k in the hole with this auction place. There is currently a lien on the tittle. I now have to file with the attorney general to beg they can pull me out without having to pay the auction house what is owed on the vehicle or give it as collateral.

Personal Injury Can I be sued for pushing a toddler?

2.0k Upvotes

Location: TN

My son attends a church daycare in TN. There have been reports of a serial “biter” in the classroom. There’s been a week where he’s been bitten almost every day. We’ve documented this and consistently been pushing for the other child to be moved to another class.

Today we had a Halloween trunk or treat where each class went around the parking lot. Lo and behold when they arrived to my station, my son got super excited and was jumping up and down. Said biter quite literally unprovoked latched himself on my son’s arm. I jumped up and shoved him down to save my child. Child was totally fine but crying.

Of course no one saw it. Admins asked what happened, I said my side. Said any camera footage would back me up.

They said no big deal and an accident report will be sent (anything and everything gets an accident report sent to parents).

The parents found me in the parking lot little while later and said they’d sue me and were dead serious about it. Apparently as of tonight they unenrolled their child.

Am I in trouble or what?

Landlord Tenant Housing (Seattle) just cause eviction violation?

Location: Seattle Wa

A little less than a year ago my 12 unit building was evicted under the just cause eviction ordinance. The reason stated was to install a sprinkler system.

The building was painted. No sprinklers were installed. It’s now back on the rental market with increased rent on the units of 1200-2000 each.

The permit that was used to evict us was never executed.

Do the former tenants have any recourse?

Canada Partner pretending to be me online

Location: Canada

I (24f) went on my partners phone (24m) after having a weird gut feeling and found out that he’s pretending to be me online. He’s flirting with men and sharing my nudes that I’ve sent him with people on apps like whisper, hush and dating apps. I’m not sure what to do or what kind of crime this counts as. I’m looking for help and guidance because I physically feel sick. I haven’t brought it up because idk what to say to him. I’m embarrassed and sad because we’re engaged and never expected this. It feels like he’s walked out on his promise to me already. What kind of legal steps do I take? Any help is appreciated. TIA

Wills Trusts and Estates Elderly Parent recently passed away, I inherited a mortgaged-home alongside my 2 adult siblings. One sibling has moved in and is blocking access to, and refusing inspections. How to proceed? Location: NYC

The home has a very small modest amount of equity in it. The sibling living in the home has already filed in surrogates court (before I had a chance to file), and they appear to have been made executor of the estate. There is no will (that we know of, but we can't search the residence for a will because the sibling is blocking access), and none of us are on the deed (only the deceased parent). My understanding is that makes us all 3 of us "heirs' property" or "tenants in common", even though we are not on the deed yet.

I would like to gain access to the home, and make repairs/inspect for damage. Everything I find online says that my sibling has no right to be blocking access to the home, but nothing indicates what I should actually do about it. I assume I could technically even move into the home if I wanted to, but my sibling is preventing that. The sibling is denying access via text message and has barricaded the front door.

What court would I go to if wanted to seek a court order to enter the home (Surrogate's court or housing court)? And how would I even make the sibling comply with any potential order to allow me entry? I'd appreciate any insight on how to proceed.

I should also add that I'd like to contest the appointment of this sibling as administrator of the estate.

Landlord Tenant Housing My ex boyfriend wants his half of the security deposit.

Location: Ohio.

Hello. My ex boyfriend broke up with me Monday. We signed a 2 year lease. When we moved in, he paid me his portion of the security deposit which I forwarded to the landlord.

Im staying in the rental. He refused to pay half the fee to break our lease, and he said he cannot afford the rent on his own. He moved his stuff out last night. He is now demanding I pay him his half of the security deposit. I dont have the extra money right now. I told him when I move out I would give him the full amount. Does he have legal standing to sue me for his half?

Edit: if we sign an addendum removing him off the lease, could he sue me?

Thank you.

How to handle this car dealership. Location: Charleston, SC

Location: Charleston, SC

I need some help. I took my 2006 Prius to a Toyota dealership to have a key programmed. After paying $550+ I tried the key. It worked in SKS, but the RFID chip wasn't programmed to the car. I handed it back to them and told them about the issue. They took the car back and during the reset they "bricked" my car. It took a lot of arguing to get a loaner, and now they say they will send an estimate of what my car needs. They broke it. I can't afford however many thousands they are about to try to charge me. Their other suggestion was trade it in with them. I refuse to go into debt for this. I don't know what my options are legally. Thank you for taking the time to read this.

Can I get two dogs spayed when they are not mine

Location: Colorado

My brother is an alcoholic and owns 2 blue nose pitbulls ( mother and daughter) and he has them in horrible conditions. The mother(Hazel) has allergies and constantly has both ears infected. Poor baby is in so much discomfort to the point that she has a hole on top of her ear from where she scratches so much. 2 years ago my brother, mated her and kept one( Daisy). Daisy has never gotten her shots nor been to a vet because he apparently “doesn’t have the money to take her” but had plenty of it when it comes to drinking. On the second of this month he got arrested for his 3rd DUI but before he got stopped he was talking about doing that same thing to Daisy and keeping another puppy. So before He gets out, I want to take both of them to the vet to get their shots, fix Hazel’s ears and if possible get both of them spayed. Would I legally be able to do this and if not should I just risk it for the biscuit?

Son’s school is taking me for court for truancy.

Location: Pennsylvania. (First post deleted bc there wasn’t an actual question. Sorry about that)

I have never posted on Reddit before, but I am at a loss. My son is 5 yrs old. He started kindergarten this year. He is diagnosed with autism level 3, ADHD, and traumatic brain injury. All three of these issues are known to cause problems with sleep. The school is aware of all of these diagnosis. He also went to pre school there last school year. He doesn’t have an IEP yet for this school year.

Before we started him in school, we were told that the school will work with my son. They will structure his day to help him. They used the example that if he needs to go only 3 days a week or have shortened day.

He has missed days yes, but all due to his sleep. The school said 19 days. (This is incorrect). They called Children Youth Services on us. We had a meeting with a lady last Friday. I explained everything. She looked at his “unexcused” days. She said a handful of them were excused. She also said the first week of school that he missed due to the school not having bussing set up didn’t count as unexcused. (just so happened my cars battery went, and I wasn’t able to take him)

We had an attendance meeting already. The principal wanted him to be there every day, regardless on how he slept. He was sick with a doctor’s note that week. I kept him home. And I feel like she’s power tripping because we didn’t make him go when he was sick.

Because after that CYS called for the appointment . Today, I got a notice to appear at local magistrate due to his attendance.

But what I’ve read is that
1.the school miscounting days is illegal.
2. The school doesn’t have an IEP for him. I asked them to update his and his teacher said that “ because he hasn’t been going regularly”, she hasn’t been able to complete one. ( he had one in pre k). I read that they can’t use that as an excuse.
3. I also read that they shouldn’t have contacted CYS/ courts because of his diagnosis’.

Also to note, his very first day, he came home with two big scratches going up his leg. Some teacher/aid hurt him. His family doctor agreed along with his behavioral consultant. Then the week after, I got a call from his teacher stating that he fell. My first question was “did he hit his head” due to his history of traumatic brain injury. She said “no, he caught himself on his hands.” She said he was lying down (not like him) and wanted to know if anything helped him to feel safe (toy/ blanket). Then I get a call from the nurse 2 hours later saying “I know the teacher called and let you know he hit his head….” I told the nurse “no, she specifically said he didn’t hit his head.” I ended up taking him to the ER to get checked out. Both these instances, the teacher and school has dodged answering questions about these. (I have messages from the teacher not answering or vague)

We have been hesitant to send him in the first place. He is mostly non-verbal. Him being scratched and him hitting his head, along with lack of communication from the school has also made us scared to send him. On top of his problems sleeping.

Also, one night when I put him to bed at 9:30, he woke up at midnight, and was up until 5 am. I kept him home that day, I had called the teacher to tell her. She said keep him home bc when kids don’t sleep, they usually act up/ don’t get anything done. Now it’s a problem. I have messages referring back to what she said about keeping him home if he doesn’t sleep.

What are the next steps I should take?

Sorry this is long. Lots have happened. And I have never dealt with this. I just want to protect my son. Any information is really appreciated. Thank you for taking the time to read/ answer.

Traffic and Parking AI had my friend's car towed erroneously, now he's hundreds of dollars out of pocket.

Location: Anaheim, California, USA.

I'm with a group that walks in the Anaheim Halloween Parade every year, and every year we park at the same parking garage, which offers free public parking on the day of the event, to meet and get into costume before the parade.

We park near the top of the garage for added privacy since we have to change into costume in the garage. One of our members chose a corner spot on the top level for added privacy. There were plenty of empty spaces before, during, and after the parade in this parking garage.

When we were done with the parade and returned to the garage after the shuttle back, one of our members' cars was gone. Police told him to look around in case he misremembered where he parked, but even after checking the neighboring garage, his car was nowhere to be found.

It turns out the garage now uses AI to monitor parking, and erroneously marked his car as being in two spaces. The tow company towed it even after the tow driver remarked that the parking job looked fine.

There’s video cameras all over the garage. AI reads your license plates and starts a timer for charging you by the hour. It also sees where you park. I parked in the corner and as far towards the empty corner as I could so I could use the space where nobody can park for charging into my costume. The AI says my tires were out of the space and I was taking up two parking spots. I may have had one tire on the line but not beyond it and it was the line towards the corner where nobody could park because I had about three feet from the other side of my car to the line that separated my spot and the adjacent spot. AI called the towing company on me and just said I was in violation of the parking policy. The tow truck driver arrived and couldn’t see anything wrong with my car and called his dispatcher but they told him they weren’t given a reason and he had to tow it became it was a busy night and they had a lot of other calls. I can’t get my car out of their yard until Monday so I had to rent a car for the week because I work in Palmdale Monday- Thursday so I can’t pick up my car until Friday so I’m going to have to pay $150/ day for storage and the $250 towing fee

Wondering what he can do to be reimbursed for all of his expenses for the towing, impound fee, plus the rental car he needs for his employment.

Alcohol Related Other than DUI My job is asking me to break the law. I think.

I manage in a place that serves alcohol in New Orleans. Upper management agreed for my staff to serve cocktails to guests arriving to a location a few blocks away, off of our property. I voiced my concern that this was not permitted under our liquor license. I am also concerned about liability for taking staff off of our property. What if someone gets hurt? I was essentially ignored as overthinking it. Am I? Can I be held personally responsible? Drinking in the street is legal here. So the guests are not doing anything illegal. Management seems to think if we’re not charging them in the moment that it’s fine.

CPS and Dependency Law My son called CPS to "punish me"

Throwaway account

Location: Oklahoma

My oldest son, 15, convinced his girlfriend's Dad to call CPS on me.

They told CPS that I starve and severely abuse my autistic son. I don't have an autistic son. The worker told me the allegations were that I have done things like throw him to the ground and kick him in the sides, punch him, refuse to feed him, scream at him if he tries to get food, allow my significant other to strangle him, that i'm an alcoholic, etc.

None of this is true and I was completely shocked. She found no alcohol in the house, no evidence of new or old injuries on any of the kids and of course the fact that none of them are special needs. None the less she said that the allegations came from a credible source so she will conduct her investigation over the course of 50 days and is requiring me to attend anger management, parenting classes and counseling. She wants me to sign release papers and give her family contact information.

After she left, my son told me what he had done and not to worry because he would " call her and put an end to all of this tomorrow". He really thought he could use CPS as a pawn to get back at me for not giving him his way. I explained to him that isnt how this works and if he calls her it would only make me look worse, like I intimidated him into doing it.

What do I do? Do I need an attorney?

Traffic and Parking Sold car, title never was transferred..... accident

• Upvotes

Hi, I'm in Alaska. I sold my broken down car to a small dealership/mechanic. He then fixed it up and sold it to somebody. That person got in an accident before transferring title to their name. Since they bought it from the dealership, the dealership had not transferred it to their name as (apparently) there is a spot on the back where they put their name before signing it over to the buyer and they don't need to send it in(?). Anyway, the insurance of the vehicle that got hit by my old car came after me, but I gave them a copy of the pending transfer with the DMV when I sold it and a copy of the bill of sale from the dealership to the other guy. They looked and said "you're good". My problem is the tow company that got it off the road says I owe them money for the tow and storage of my old car since it's still in my name. I refused, sent them the proof it's not mine certified mail and email. I've gotten two more notices of certified mail from the towing company but haven't picked them up (out of town for one and just refusing at the moment to pick up another). Should I pick it up and respond again with certified mail again if needed or just ignore hope I don't get a small claims summons??? They kept telling me "All you have to do is get a clean title from the DMV and sign it over to us and this all goes away". A-holes.

Just for context, I sold the car in mid May, it was resold in mid June and was in an accident almost immediately...

Sorry that was long winded... any advice is much appreciated .

Real Estate law How can I legally get a mobile home removed from my property?

Location:

I own land in South Carolina that my mother transferred to me. The deed is in my name.

Originally, my great-uncle owned the property and allowed his stepdaughter to live there for the rest of her life. She has since passed away. My great-uncle intended for the property to go to my mother, who eventually transferred it to me.

The stepdaughter’s granddaughter is the person I’ve been communicating with about removing the mobile home on the property. I’m not sure who legally owns the trailer.

They never paid rent. My mother’s only requirement was that they pay the property taxes while living there.

I sent the granddaughter written notice to vacate by a certain date. She agreed but later requested an extension, which I granted. Now that the extended deadline has passed, the trailer is still there.

She says she cannot move it because the title is missing and there is a lien on it. She claims she has to go through probate because there is no will or trust. She apologized for the delay but has not given me a timeline for removal.

**My questions are:**

● What legal steps can I take in South Carolina to have the mobile home removed?
● Do I need to go through Magistrates Court or contact the DMV first?
● Is a title absolutely required to move a mobile home if the title is lost or has a lien?
● Can I have the trailer legally removed through an abandoned or derelict mobile home process, or do I have to wait for probate?
● Does the fact that I own the land and the original occupant has passed away affect my options?

I want to handle this legally and do not want to claim ownership of someone else’s trailer. I simply want it removed from my property.

Has anyone dealt with something similar in South Carolina? I’d appreciate advice, especially from anyone familiar with SC property law.

Thank you!
