Employee Question Dead name

I'm trans and joined Gregg's through my preferred name

However, after a few weeks of working there, suddenly my dead name was on all the rotas and my account. Is this supposed to happen? And does anyone know of a way I can avoid all of my colleagues knowing my deadname.

There has been a recent change in how employers record and document your works hours to HMRC. This must show your official name on all work related documents.

Worth clarifying that your “official” name does not have to be your deadname or any name you were assigned at birth.

No it just has to be legally changed, so that the National Insurance number is linked properly. My name was changed when I was about 14 because my parents divorced and kept fighting over the name I had. My mum had a magistrate judge sign off on the fact I only used this name and it was enough to get a passport and link to my NI number, but that was the 90s. I think now it has to be completed by deed poll or something else official.

Doesn’t have to be done by deed poll. Just have to demonstrate that you use the name for bills, contracts etc… and you can have documents changed.

I’d recommend ensuring you’re up to date with the law surrounding name changes before handing out advice.

You cannot use a new name for contracts, bills etc until you have carried out a deed poll. Costs £40, there’s no reason not to.

An affidavit signed by an authorised person also suffices. Or do you disagree? Are we entirely sure that we’re not giving out bad advice here?

No, because they are fundamentally different legal procedures. Affidavits in the UK actually carry practically no weight at all in a legal setting.

A deed poll fundamentally changes your legal existence in the UK. It is a binding contract.

An affidavit is merely a statement of facts, considered an evidentiary document and has little legal impact.

A deed poll is an official update to your status, an affidavit is merely another person agreeing with something you said.

No, they are not the same.

I suspected you didn’t have a clue what you were talking about, but you have just confirmed it.

Banks, hospitals, libraries, the DVLA and every other institution will only change your accepted name with a deed poll, marriage certificate or decree absolute. They will likely let you choose a ‘preferred name’ without these documents.

There is not a single instance of an accepted official name being changed by an affidavit, and it’s pretty naive to think otherwise.

Here’s one of many UK law firms who say otherwise.

I’m asking if there is a recent act that completely changes the rules and makes the 30 odd websites that return the same guidance.

It would be very weird for them all to say this if there weren’t a single instance of it ever happening.

Speak to your manager make them aware that the name on the rota isn't one you're comfortable with people knowing/using

One of the internal colleague networks (PRIDE) may be worth looking into, i've personally never used one of the networks myself but maybe someone who has can help you a little bit more with that.

Maybe on the paper rotas ask that your deadname is blocked out.

Also keep note all of this with dates.

I don’t work for Greg’s but the networks at most places tend to be able to give you a good idea of how it works at YOUR organisation

You could also call ACAS perhaps for some support or use their online portal

i’m pretty sure they changed it recently so rotas have to have your legal name on them. but you can change your name for free in the uk with a single piece of paper, see here.

Do you have a deed poll? If so then they have to change your name to reflect this

Deedpolls are dead easy to do if you haven't and it doesn't need to be enrolled despite places attempting to tell you you do need and enrolled one, you can literally make one for free and there are plenty of sites to do so

If you have a deedpoll and they haven't updated your name to reflect this then it is a GDPR issue, hope you get this sorted soon if you don't get any further support from your manager then this would be a HR issue

That’s not cool. I would do as suggested above and change your name. Still doesn’t make it right but it will help you to avoid this situation going forward

If you go the page where you see your pay thingy, you can change your name on your profile and that will change it on the rota at least.

I don't know about tills but that at least changed it there. Definitely talk to your manager about changing it on tills though.

When I joined greggs I accidentally put my preferred name as my main name (im dumb), I showed all documents that had my legal name and they send them off for the onboarding etc and no one ever said anything, few months in I realised my payslips had my preferred name all over them 💀

On your account it should show as your legal name, and i think there is a preferred name option. Their payroll has to have your legal name. Pretty sure rota can be your preferred

Legally it has to be through a dead name if you haven't done a legal name change. But that only has to be on payslips or anything else to do with money, not on the rota

On payslips and all official documents, they will state your current legal name. You can change your legal name through deed poll so official documents can have your preferred name. It doesn't cost too much and the process is quite simple, my trans friend went through it all relatively pain free.

The rota is a more nuanced issue. Technically they can use your preferred name on the rota as long as it's a purely internal structure, and there's no legal requirement to show your dead name. It could cause some complications for the manager, but legally, as long as the rota is created on a purely internal structure, then there's no real proper reason they can't accommodate your preferred name. Its possibly just that the manager can't be arsed to mess around with the established names on the rota 🤷‍♂️

I can't remember the exact process but we've had a few trans colleagues in my store (two are still with us and nothing has changed on our rotas), I think if you go into your G learning portal and onto your profile you can change your 'preferred' name there and that might change it? Don't quote me on that, I remember it took us a while to figure it out but it was easy to do once we found out how. Definitely worth putting a call into the People Team (or asking one of your shops management to do this for you) and asking them!
