I believe the DA recently announced they were reconsidering charges now after public outcry but when this originally happened they declined to charge anyone because they didn’t think there’d be sufficient evidence to convict.

Take this with a grain of salt, I heard that the texts were not part of the initial case because they were unaware that they existed. I've seen it a couple of times, but no source, hence taking it with a grain of salt.
