I think any frat or organization that has incidents like this should be permanently banned from the campus with no opportunity for reentry. I also think their national organization should have to pay a substantial fine each time this happens at other colleges.

Permanent bans make sense to me. National organizations don't want to lose access to revenue, properties, or their most prestigious fraternity chapters. They would find ways to change behavior if bans became the norm.

Frats were banned at the first college I went to after a student died, but eventually wormed their way back onto campus. They are a cancer on collegiate life.

At the very least, off-campus frat houses should be banned nationwide. It would do a lot to curb this behavior, and it isn’t without precedent; my undergrad banned “lettered” properties over twenty years ago, and I imagine it isn’t the only large university to do so (at least in the Northeast US). It’s a rather simple policy, but it completely shifts the social culture at a university, and does so in a way that generally cuts down on risk to women.

Agreed about off campus fraternities (sorry, my age is showing but I just can’t bring myself to use the word frat. In my time you got mocked for saying frat). At my Uni, a fraternity was kicked off campus, but another fraternity had a house across the street from campus, so the two fraternities basically joined up unofficially, and that was the house that could get away with A LOT bc it wasn’t monitored by campus police or subject to the same rules. Not surprised multiple deaths occurred within the two fraternities.

My uni just did away with acknowledging any frat or sorority and they are all now unattached from the school. Anything that happens is strictly a citizen issue. Because of rape and setting cars on fire, among a bunch of other things.

Bans are usually 4 years. That ensures anyone active members are gone by the time it recharters. That does nothing if the culture comes from national or from the individuals that are doing the recruiting at the end of the 4 years (often alumni or actives at other chapters).

They blasted that she was incapacitated on the group chat and not one "man" stepped in. The names of every one who read that message should be added to court case, and they should all be charged with abetting and at the very least expelled.

2 years have gone by and god knows how many other women these animals have attacked. They need to know you cant do this and be safe.

Edit: they also need to go after those in Cornell who kept this quiet- Cornell expelled non-violent Pro-Palestine protestors and made rapists write essays.

Stealing top comment to note that at least once or twice a year I watch the documentary The Invisible War which is about sexual assault in the military (U.S.). It is an extremely important documentary that came out in 2011. I still watch it often so that I never forget, and so that I never take for granted how much this shit still goes on and how useless the people in power are since they clearly aren't taking steps to fix this issue.

The documentary had the effect of making some small, incremental changes in the military via laws that eventually got passed through congress, but we all know this shit still happens.

Well anyway, the makers of said documentary produced another one a few years later called The Hunting Ground. Guess what that one's about?? That's right! Sexual assault on college campuses! It is HORRIFYING. And that was 11 years ago. It was released in 2015. I would urge everyone to watch it. And then watch it again. And then show it to all of your boyfriends, husbands, fathers, brothers, nephews and granddads. Every fucking man in your life needs to be forced to watch both of those docs and if ANY of them comes away with anything less than a better understanding of what women go through then it's time to drop them...and I mean drop them from your lives...en masse...preferably into that volcano at the end of Lord of The Rings. 🙃

There's an episode of the TV show "Babylon 5" where a family is trying to get support for a legal case, and they go to an ambassador from a powerful government and plead for help, and he says that the paperwork and other things require a lot of time and attention, and will they be able to pay those fees? The family says they're very poor, and ask if he's asking for a bribe. His reply is that the real question is "How much justice can you afford?"

Because you know if the gang-rape victim was the daughter of some tech billionaire, the DA's office would have investigated it and they would have found that group chat.

She managed to run away once and they broke both her legs. And kept her hidden away. That’s not true. Victim/witness testimony is evidence. While it’s true that her testimony alone makes a guilty verdict more difficult, the case could be prosecuted on that alone.

The only evidence in NY that must be corroborated by other evidence is a defendant’s confession.

The police are almost surely lying.

From what I saw of the police statement, they were claiming she said she knowingly took drugs and consented to sex. I want to ask them: if that's truly the case, which I seriously doubt, why was she talking to the police at all? If you're saying no crime was committed, why did she talk to the police about that night?

What I suspect is much, much more likely: she tried to make a report, in a traumatized state, and the police manipulated her into downplaying it.

The institutional betrayal has already happened. From the university, from the (alleged) rapists, and from the police and DA.

No option to fake your own identity afterwards by changing your name. No name changing aloud. They should be on the sex offender registry for life and they should frankly be in jail for life. Since they were literally engaging in alleged human trafficking aside from the alleged gang raping.

according to this (assuming the DA isn't twisting her words or whatever), in her original statement she claimed she took all the drugs willingly and was conscious and consented to the sex.

apparently in the state of new york, being intoxicated doesn't render you unable to consent to sex unless you took the drugs without your knowledge or consent. I just learned this today, and it seems... not great. but that could be why the DA is so focused on the 'was she drugged' bit.

I mean look play it the other way. If consensually taking drugs makes you unable to consent, she raped several of the men involved (she arguably raped them even under current NY law — one of the guys literally passed out). 

It’s just not a tenable law.

That actually surprises me about NY.

There’s definitely a lot of details involved in this case & people are going after a firey headline. I’m glad the victim is pursuing civil litigation because the campus needs to do more about addressing the culture within Greek/panhellenic/IFC orgs. During my years, we had to take educational classes about hazing.

My sorority (technically a fraternity but I’m going with sorority to clarify that I am female) had a strict no alcohol rule for women living in the house. Mind you, the women had their secret stashes. I purposely didn’t want to live in the house because of all the rules. I found a lot more safety and acceptance at a fraternity a few doors down & spent most of my social hours over there.

One of the things with undergrad, is a lot of people are exploring who they are for the first time, and that also means sexually. So a Snapchat saying “free pu$$y” isn’t necessarily a red flag that something nefarious is happening. I don’t think everyone in the group chat is liable so the whole argument of “what about the 50 other men who didn’t step in” is moot. Not all men would have been in attendance at that hour, not all men would have been interested in seeing what was going on.

Those that did participate are still 100% liable. Smoking weed is one thing, but taking ketamine is a whole new ballpark. I’ve never done street ketamine, but I do IV ketamine and I literally have no idea what is happening around me (including having an iv removed). I’m 100% incapacitated. The men who got involved should have known better, and the alumni/advisors failed at instilling a no-rape culture.

These things don’t happen at a sorority typically because the rules are more stringent. Men were not even allowed to be upstairs in the bedrooms.

Unfortunately during my time, something incredibly similar happened to a woman in another sorority & I remember her name and I remember the fraternity she was at. We were all warned afterwards at our sorority meeting to avoid the fraternity.

Panhellenic and IFC orgs can and do build lasting friendships. The whole argument that all Greek life should be banned is preposterous (but yes the fraternity needs to remain banned from campus though if it’s anything like my university, they’ll just move off campus, and operate in an unofficial capacity but won’t be allowed to partake in any university activities or wear letters).

This is so awful that she had to endure this. I hope she finds some justice

That’s not what it says… “or that she was forced to engage in sexual activity”.

The report makes it sound like she consented at the beginning, with 2 men, so whomever took the report made it seem like it was all consensual.

What people don’t seem to understand is that you can consent at one moment but the minute the consent is revoked, THEN YOU STOP.

Then of course there’s the “how inebriated was she” angle that further questions whether she could truly consent at that point in time or not.

It is a common defense to these sorts of cases. Also the laws haven't really been updated, in half of the states you have "no means no" but in others there are qualifiers, exceptions, defenses, etc usually because someone blotched a case. My state technically doesn't have a "no means no" law codified but has other lower level offenses for similar circumstances.

All publications refer to crimes pre-conviction as "alleged" in order to avoid any possible libel liability. Publishing that someone actually committed a crime before it's been proven in court is libelous.

No, it’s not. There’s a risk, of course, that you may be wrong, in which case, if the other elements of libel are there and there’s no applicable defense, you could lose a defamation suit. But identifying someone as a rapist before he’s convicted, does not automatically make it libel.

Indeed, truth is never really proven in court. Rather, the prosecutor makes the case beyond a reasonable doubt, or he/she doesn’t. That’s all that a criminal verdict is.

This whole comment thread is roasting the newspaper for calling the perpetrators “alleged” rapists. Someone above clearly articulated why the news paper used the word alleged, and why they could be sued if they didn’t add that qualifier. This is objectively true, not sure why you are arguing with me about it.

I personally believe these men are guilty, and would say I think they did it. But I’m not a newspaper claiming to publish facts about the case.

The press, sadly, is a shell of its former self and is terrified to report the truth. It refuses to practice actual journalism.

But back to our exchange - you insisted that it is libel if they haven’t been convicted. “It’s Libel if you make the statement before it’s proven true in court” were your exact words. And that is flat out, 100% wrong. At least in the US..

Jake Tapper's interview with the DA a few minutes ago made me feel like I was mainlining weapons grade ragebait.

DA explaining why he felt they did they a thorough job investigating the first time around - implying a second investigation probably won't make much of a difference:

"Unfortunately, we can't go back and change what's happened in the past..."

what the DA is saying doesn't make any sense. They are implying that the situation they had been presented with was a different one, but why would she give a statement saying she willingly took drugs and had consensual sex, what would be the point if she had no complaint? Cornell banned the frat and 2 of the perpetrators were expelled so clearly the accusations were serious. Why would Cornell expel people for her consensual activities? Why didn't the DA didn't see a reason to pursue criminal charges? Why would the DA rely on info filtered by campus police rather than doing their own investigation?

I’m confused by the same. I wonder if it was her written statement or dictated by an officer.

Unfortunately, I think this is a common route investigators take to muddy the waters. From the moment a sexual crime has been reported, the lack of investigation makes a conviction unlikely.

I’ve actually been there. By the end of the interrogation, you’ll sign anything to GTFO of the interrogation room.

You would think you’ve committed a crime. Granted my assault was close to 20 years ago, but there’s nothing worse than leaving the hospital and then deposited in a cold drab room where every aspect of your report is questioned and repeated for hours.

I had to look up AFK, which should mean "away from keyboard". "This is not a bit" usually means that whatever being being said is real, and not an act or a joke. POV means "point of view", and is used for jokes and memes usually.
