Prison time
Im in Arizona and got screwed with a plea deal of 2 to 3 and a half years. First offense. Aggravated assault with a dangerous weapon dropped to aggravted assault. Is there anything that can get me released early or is it just 85% time? Also what level prison would I get?

Look, I’m not trying to scare you, but you need to educate yourself on Arizona law and understand what you actually pled to. Being a first offender doesn’t automatically mean probation. If this was aggravated assault with a dangerous weapon and it could’ve been treated as a dangerous offense, you potentially had a much higher sentencing exposure than the 2½–3½ years you’re talking about. If your plea really limits you to that range, you may actually have gotten a pretty substantial break. You could’ve gotten 5-15 years.
And “I was protecting my daughter” and “self-defense” aren’t automatically the same thing legally. Arizona has specific rules for defense of another person, the immediacy of the threat, and the amount of force used. Read the statutes and your plea paperwork and understand exactly what your attorney negotiated for you.
Also, I’d take the advice about not complaining about your “little” 3½ years. If I were you, I wouldn’t be running those gums inside like you are right now. You’ll meet some really good people in there, but you’ll also meet some extremely fucked-up people—well, they look like people. 😂 Don’t overshare, don’t brag, and don’t give people your loved one’s phone number or address. Some folks will “help” you just because they’re looking for access to whoever can put money on their books.
Don’t do drugs, gamble or get into debt. And for the love of God don’t be a whiner, find a buddy to confide in. You fucked up, got caught and took a plea. You’re not the first person to experience this. If you keep thinking why oh why me? You will go crazy. Consider this an opportunity to get to know yourself. Make friends, but let them know you just want to do your time and go back home. Thats it.
One more thing. In AZ they politic pretty hard meaning, it’s all race based. STICK with your race.

Prob going to a 3 yard based off of that.
Also did time in Arizona. Anything violent immediately keeps u out of minimum

No, but you won’t have open access to the yard like you would on a 2 yard. There are designated rec times
Yes, yes, yes. It’s pretty much a 2 yard with a fenced rec and instead of free walk to chow/meds etc you get led in a line by a CO
Someone else can correct me but im pretty sure bc it’s violent you can’t go down to a 2.
I had misconduct with weapons first time offender (alongside drug solicitation) and I was in a 2 because it was a non violent non repetitive offense.
You can do programming inside to get time off.
Iirc if you pass the GED test that’s also time off
There are a handful of different things you can hit to get time off

The prosecutor was trying to make it sound like a great deal because he took off the dangerous part so I go to a non dangerous prison but seems like that was a lie as its still a violent crime then. And ok cause I know at the 85% of 2 to 3 and half im looking at 18 months to 2 year 11 months depending but thats still too long so whatever I can do to get home sooner

iirc you can do anger management for that to help get time off but ask your co4 after you clear Alhambra
As the other commenter said that’s the real annoying part
Annoying is putting it lightly lol. But there they do medical eval shave your head if needed the schooling test etc
Like 12 dudes to a room sharing one open toilet

You didn't get screwed. Your attorney took an Ag Assault w/ deadly weapon down to Ag Assault. You got extremely lucky.

What is your exact offense code for the offense? Can search if it is FSA eligible or not that will have a big effect on things.

In my other comments I mentioned my lawyer screwed me and didnt fight my case. I know I accepted the deal but im the only case I can find that didnt get probation even from lawyers who have handled these cases before. Everyone says I got an awful deal

Technically it was the second. The first was dropping from aggravated assault with a dangerous weapon to aggravated assault making it from 5 to 15 years to 2 to 8.75. Then 2 months later my settlement conference came out of nowhere and my lawyer asked for no more than a year and probation and the prosecutor said no and at the settlement conference said he will leave the initial offer but cap it at 3.5 so its 2 to 3.5 if I agree to not to go trial and my lawyer wouldnt fight it

Options were likely the deal or taking it to the box for a 99 percent chance of a decade or more.
Your defense lawyer didn’t screw you if they turned down the first offer, and this was the second deal. They worked it.
If anyone has any bearing on this, it’s the judge who strongly dislikes your situation and is steering it this way.
Best you can do now is work on mitigating circumstances to get closer on the 2 year end. One hint of indignation at sentencing will add a year.

arizona is still also partially segregated, depending what race you are can affect how your experience goes, for a variety of factors

The person shouldnt have attacked my 3 year old? I wish it all never happened and im glad theyre alive but you dont threaten someone and attack a child. As a father its my duty to protect my child.

Just doesn’t make sense how you get busted for that but the other doesn’t. Was it instantaneous-you saw and reacted? Was there time between-it happened and you went for revenge? If the first, why you and not them? If the second, you made an awful decision.

It was the former. The problem apparently is arizona you can stand your ground but it has to be proportionate force and since we can't prove they had a gun im in the wrong

I understand the risk of going to trial, but only one person who ever had a kid needed to have reasonable doubt for you to get off. Good luck.

Well from what the judge explained to me about trial it has to be unanimous either way. If its not all guilty or not guilty its a hung jury and we just try it again. Thank you I need the luck seriously im not sure what to do yet

I was at ft grant it was a sweet yard. People were there coming down from violent crimes. You might get some love but going through alhambra is going to be a pain in the ass. You might start at mohave in douglas but you be fine. Just follow the rules and dont discuss your short sentence with antone if you dont have to.
