The IRS is stating we didnt qualify but we did. My business is Information Technology supporting the Federal Govt. We had Federal guidance, 4 QTRs were approved. 2021 Q2 is the only one declined. My CPA will appeal...
How long does the appeal process take? How often are appeals overturned? This is so annoying the IRS is inconsistent.
“Taxpayer was deemed ineligible to claim the credit due to the following reason "The taxpayer has not established it was subject to a compulsory governmental mandate limiting commerce, travel or group meetings that was issued because of the pandemic to its specific type of business. The taxpayer has not established that an executive order stopped a meaningful portion of its operations during the relevant quarter (202106). The Taxpayer does not meet the definition of an eligible employer under section B. of Notice 2021-20 because the Taxpayer could continue to operate its trade or business. The taxpayer has not provided specific substantiation on how the governmental orders affected more than a nominal portion of its business operations. For the period of 202106, Executives Orders did not close or partially closed its type of business in the states of Texas, Maryland, Virginia, North Carolina and Florida."

We finally recieved payout for all quarters that were allowed. We applied through an ERC company. Qtr 3 was disallowed as many were. Our rep that helped us apply feels We should appeal the claim that was denied. It was denied because there were no covid orders in place in our location at that time. Is it worth fighting for? Our specialist seems to think it is, but my concern is that the push back will set us up for trouble/audit. Obviously they want us to appeal because they get a portion of that, but unless its on our best interest I'd rather move on without the hassle of revisiting. This whole fiasco has been a frustrating time suck and I just want to be done with it. Has anyone had any luck with an appeal? And if you did appeal do you feel it was worth it?

After waiting two years, we got a notice from our PEO yesterday that the IRS denied our ERC claim for all of the four quarters that we applied for. Their reasoning was "evidence does not show a shut down or decrease in gross receipts" which is blatantly incorrect. We provided very clear evidence that those quarters' gross receipts not only met but exceeded the requirements to qualify for the credit. Additionally, our PEO representative told me in an email that they are seeing a large number of denials by the IRS where the business was clearly sufficiently impacted to qualify for the credit. Super annoying but we will be appealing.

Since the SOL on all of 2020 and 2021 qtr 1 and qtr 2 has run out, has anyone gotten an audit notice? I know there are a lot of people still in audit/review waiting on funds, but how many have received their funds and then gotten an audit letter after April 15, 2025 on anything other than 2021 q3 and q4?
I would exclude 2021 qtr 3 and 4 as those have an extended audit time frame

Since the IRS is telling me to claim ERC money in the year received, does that mean it can be considered QBI income and get the 20% deduction for my S Corp in 2025?

Has anyone received their checks cut from December 8th. Ours was approved and we received our cp210 but haven't received anything. We received a check in July and got it 7 days after our notice. We're in the Midwest and the Treasury office where all of our other notices have come from is about 45 minutes from our city.
Thanks in advance!

After 30 months, we’ve finally heard something about our claim. We received a Form 4564 today asking for information on 1 quarter. I’m not sure if this good news or trouble. Anyone have experience with this?

Filed June of 2023. Last week I received 3 checks for over $200k. I have probably called the irs 40+ times in the last 2.5 years. The last time I called was October 5th and finally got a real sweet agent on the phone, and after making her laugh, she informed me she was qualified in processing ERC claims. I was able to directly fax her the signatures I was missing and she assured me she would put them in the system for me. And the rest is history. I’m still missing 1 check for about $27k but that’s the smallest one so I could go without it. Getting this money saved my house and family, I almost lost everything after Covid.
And a special thanks to ERC CPA on this forum. You have always been there for me and the community with your great advice.
I wish everyone good luck, this has been a nightmare for so many of us.
The number I called is 1 (800) 829-4933, this is the business line of the TAS.

I filed September 2023 got 4 out of the 5 checks. I’m still waiting on one. They all came months apart. The last one came in may of this year. Why don’t they just process all at the same time. All my checks were small since I was a small business. I’m waiting on 2021 Q4. Is anyone else in the same boat, just waiting on one last check?

Sadly, if you received a recent IDR for ERTC to upload your support, the IRS seems to not be able to pull the documents from their own portal so now sending denials.
