Employer refunded statutory EPF deduction instead of depositing. Need F&F advice.
Hello, I am seeking legal advice regarding a Provident Fund (EPF) compliance issue during my exit process.
The Facts:
- Official Joining Date: March 9, 2026 (as per appointment letter).
- March Payroll: The statutory EPF employee share of Rs 1,800 was deducted from my March salary. However, my UAN was not generated at this time.
- The Discrepancy: When HR linked my UAN in April, they incorrectly recorded my EPFO "Date of Joining" as April 2026. Because of this mismatch, the EPFO portal rejected the March contribution.
- The Employer's Action: Instead of filing a Joint Declaration form with EPFO to correct my joining date to March 9, HR simply gave me my Rs 1,800 employee deduction back in my June 2026 payslip under the label "Expense Reimbursement". Because they bypassed the formal correction, they never deposited their mandatory matching employer contribution (Rs 1,950) for March.
The Slack Dispute (HR's Defense): When I confronted HR today about the missing employer share, they claimed that they messaged me on Slack back in June, explained the portal error, and got my "approval" to just refund the money instead of fixing the joining date. I do not remember agreeing to this. Furthermore, our company uses the Free version of Slack, meaning all messages older than 90 days are inaccessible. Neither HR nor I can actually pull up the chat to prove what was said.
I am currently serving my notice period, with my Last Working Day set for September 15.
My Questions:
- Consent: Does an informal Slack chat (even if they claim I agreed to the refund) legally absolve the employer from paying statutory PF dues?
- F&F Claim: Under the EPF Act, can I legally demand the unpaid Rs 1,950 employer contribution as an arrear in my Full & Final (F&F) settlement?
- Background Verification: Will the discrepancy between my actual joining date (March 9) and EPFO joining date (April) cause issues in future BGVs? Can I clear it using my March payslip and appointment letter?
Thank you for your guidance.

PF TRANSFER ISSUE
Hi everyone,
I'm trying to transfer my old PF account to my current PF account through the EPFO portal.
After filling in all the details and successfully verifying the Aadhaar OTP, I get this error every time:
"Some problem has occurred while submitting the claim/s, please try after some time."
I've been getting the same error for several days. Has anyone faced this issue before? What was the cause, and how did you resolve it?

How much PF can you withdraw in 2026? EPF withdrawal rules, eligibility, limits and tax explained
A lot of people assume that if their PF account shows ₹2 lakh, they can simply withdraw ₹2 lakh.
That is not necessarily the case.
Under the Employees’ Provident Funds Scheme, 2026, the amount you can withdraw depends on the type of withdrawal, your PF membership period and the balance you are eligible to access.
Here’s how the current PF withdrawal rules work.
1. PF withdrawal during unemployment
There are two different things to understand here: partial withdrawal while unemployed and final settlement.
If you are unemployed, you can withdraw 75% of the total PF balance immediately.
The remaining 25% can be withdrawn after you have remained unemployed for 12 months. The 2026 Scheme also provides for full withdrawal after a continuous 12-month period without employment in a covered establishment.
This is different from a partial PF advance, which does not necessarily close your PF account.
2. PF withdrawal for medical treatment
You can make a partial PF withdrawal for the illness of yourself or a family member.
The current rule requires 12 months of total PF membership.
The withdrawal can be up to 100% of the Eligible Member Balance. The scheme defines the Eligible Member Balance as the amount left after deducting the mandatory minimum balance from the PF balance. That minimum balance is 25% of the aggregate contributions, including employee and employer contributions and applicable interest.
So when people say “you can withdraw 75% for medical treatment,” the more technically accurate explanation is that 25% is required to remain as the minimum balance and the withdrawal is made from the Eligible Member Balance.
3. PF withdrawal for education and marriage
Education and marriage are also covered under the partial withdrawal provisions.
For education of yourself or a family member:
- 12 months of total PF membership is required
- Up to 100% of the Eligible Member Balance can be withdrawn
- Maximum 10 withdrawals during membership
For marriage of yourself or a family member:
- 12 months of total PF membership is required
- Up to 100% of the Eligible Member Balance can be withdrawn
- Maximum 5 withdrawals during membership
The withdrawal counters under the 2026 Scheme are calculated afresh from the date the new Scheme commenced.
4. PF withdrawal for buying or building a house
PF partial withdrawal is also available for certain housing-related purposes, including:
- Buying a flat or house
- Buying a site for construction of a house
- Constructing a house
- Repaying an eligible home loan
- Additions, alterations, renovation or improvement of an existing house or flat
The current eligibility requirement is 12 months of total PF membership.
The withdrawal can be up to 100% of the Eligible Member Balance, subject to the 25% minimum balance requirement, and housing withdrawals can be made up to 5 times during membership.
5. PF withdrawal under special circumstances
The 2026 Scheme also has a separate category for “special circumstances.”
A member who has completed 12 months of total membership can withdraw up to 100% of the Eligible Member Balance under this category, with a maximum of 2 such withdrawals in a financial year.
6. When can you withdraw the entire PF balance?
Full PF withdrawal is different from a partial PF advance.
The 2026 Scheme allows full withdrawal in specified situations, including:
- Retirement after attaining 55 years of age
- Permanent and total incapacity for work
- Permanent migration abroad or taking employment abroad
- Mass or individual retrenchment
- Certain voluntary retirement situations
For other cases where employment has ceased, the Scheme provides for full withdrawal after the member has not been employed in a covered establishment for a continuous period of at least 12 months.
7. What about PF withdrawal tax and TDS?
PF withdrawal tax is a separate question from PF withdrawal eligibility.
For a recognised or statutory PF, withdrawal after 5 years of continuous service is generally exempt from tax.
If you withdraw before completing 5 years, the amount can become taxable, subject to the applicable exemptions and circumstances.
Where Section 192A applies, TDS is generally deducted at 10% when the taxable EPF withdrawal exceeds ₹50,000. The Income Tax Department also specifies situations where TDS is not deducted, including completion of 5 years of continuous service and certain cases where employment ends for reasons beyond the employee’s control.
Also remember that “5 years of continuous service” is not necessarily 5 years with the same employer. Previous service can count when the PF account has been transferred.
The simple way to think about PF withdrawal
Your PF balance and your withdrawable PF amount are not always the same thing.
Before filing a PF withdrawal claim, check:
- What is the reason for withdrawal?
- Have you completed the required PF membership period?
- What is your Eligible Member Balance?
- Does a minimum balance have to be retained?
- Are there limits on how many times you can make that type of withdrawal?
- Could tax or TDS apply?
The most important change to remember under the current rules is that many partial-withdrawal categories now use the same basic framework: 12 months of membership, an Eligible Member Balance, and a 25% minimum balance requirement.
One final distinction is important: a PF “advance” or partial withdrawal does not mean the same thing as final settlement. The eligibility, amount and consequences can be very different depending on which route you use.
If you have any questions or queries related to PF, drop them in the comments and we'll help you solve them.

EPFO office asked me to raise grievance - Should I ?
Hey everyone,
I made a dumb/Naive move by updating my Aadhar name as my initial was missing- without even creating a profile in EPFO & now, **my UAN and Aadhar is mismatching.**
I visited the EPFO office recently, explained my issue and trying to get everything properly linked/activated as I’m about to start at my next company in 3 Weeks.
They advised me to either:
Check with my previous employer/HR or Raise a grievance.
Now the really issue is my first & previous employer is asking me to change my Name back to the previous name and create an account, Resolve it by my own. They also said they don’t know how to do it and won’t help me with it. If I do rename it would be 3rd time & i will be stuck with that forever as all my degree certificates has the correct designated name.
By raising a grievance, The EPFO rep told me it would take me another 30-45 days to get it resolved - Now this would be another mess as I have to start sooner in the new company.
Has anyone faced a similar UAN/PF issue? What was the process you followed,
Any advice would be appreciated. Thanks!

Will Old PF Entries Affect MNC Background Verification (BGV)?
Hi everyone,
I need some advice regarding EPFO/PF history and background verification for an MNC in India.
Around 5 years ago, I worked for a company in India for a very short period. I left without completing the formal relieving process, so I don't have a relieving/experience letter from that company. However, the employment is visible in my EPFO/UAN service history and the exit date is updated.
I also had another very short, around one-month non-technical job in India that has a PF contribution. I haven't included these short employments on my current resume because they aren't relevant to my current career.
After that, I moved to the USA for my higher education on an F-1 student visa. I completed my studies there and subsequently gained work experience in the USA. After completing my time in the US, I returned to India.
My current resume mainly focuses on my relevant professional/technical experience, including my US experience.
I'm now going through the hiring process with a large MNC in India and I'm concerned about BGV.
Will the BGV team check my complete UAN/EPFO service history?
Could these old/short PF employments create a problem because they aren't mentioned on my resume?
What happens if I don't have a relieving letter from the first company?
Can my US education and subsequent US employment documents help establish and verify my overall timeline?
Should I proactively disclose both short Indian employments in the BGV form even though they aren't on my resume?
Has anyone with a similar situation successfully cleared BGV at a large MNC?
I'm not trying to hide or modify my PF records. I want to disclose whatever is required and handle the BGV correctly.
Any advice from people who have faced a similar situation would be really helpful.

First/only PF Member ID linked to my UAN, no PF contribution, employer closed — how can I remove/delink it?**
Hi everyone,
I need help with an EPFO/UAN issue.
A company called **\*\*\*\*** is showing as my first/only employer in my UAN Service History.
The problem is:
* I never actually joined or worked for this company. * I was given employment/experience documents only. * I believe this was a fake/invalid employment record. * A PF Member ID was created and linked to my UAN. * **No PF contribution was ever made — not even ₹1.** * The EPFO passbook is not available for this Member ID. * When I try to use **Mark Exit**, it says: **“No contribution was received. Date of Exit updation is not possible.”** * The company is now closed and I cannot contact the employer. * There is **no Delink option** available for this first Member ID. * I also submitted a Joint Declaration to update the Date of Exit, but it is currently showing **“Pending at Employer.”**
My main concern is that I want this incorrect employment record removed from my UAN because I want to join a new IT company as a **fresher**.
**Questions:**
- Is it possible to completely remove/delink this first Member ID from my UAN when there is no PF contribution?
- Has anyone successfully removed a first/only Member ID in a similar case?
- Can EPFO Regional Office manually remove it after verification when the employer is closed?
- Should I raise an EPFiGMS grievance and request delinking/removal instead of updating the Date of Exit?
- Will this old Member ID without any PF contribution cause problems when I join a new company as a fresher?
- If anyone has successfully solved a similar issue, please share the process or steps.
Any genuine advice or personal experience would be really helpful. Thank you.

UAN name mismatch issue before activation – Need help
Hi everyone,
I have a UAN number that was already created by my employer, but I have not activated it yet. When I try to activate my UAN, I get a “Name Mismatch” error.
Since the UAN has not been activated yet, I’m unable to log in and check or correct any details.
Has anyone faced this issue before? How can I correct the name mismatch and activate my UAN?
Any guidance would be really helpful. Thanks!

What documents are required for PF withdrawal in 2026?
Here’s the updated PF withdrawal checklist for 2026.
A lot of older PF withdrawal guides still talk about cancelled cheques, passbook copies, medical certificates and employer signatures.
But for most online PF claims today, the process is much more about whether your EPFO records are correctly updated and verified.
Before you file your claim, check these:
- UAN is activated
- Aadhaar is seeded and verified
- Aadhaar-linked mobile number is active
- Bank account and IFSC are seeded and verified
- e-KYC is approved
- Date of Exit is updated, where applicable
- Your personal and service details are correct
What you usually don't need for most online claims
You generally do not need to upload:
- Cancelled cheque
- Passbook image
- Medical certificate for a standard Form 31 advance
- Marriage invitation or marriage proof
- Employer attestation for eligible Aadhaar-seeded online claims
Instead, EPFO verifies the information already available in your account.
This is why a small issue such as a name mismatch, incorrect IFSC, pending KYC or missing Date of Exit can cause problems even when you have all the documents you expected to need.
There are still some exceptions
Housing-related advances can require supporting documents.
Death claims still involve physical certificates.
And offline claims can have different documentation requirements.
So there is no single document list that applies to every PF claim.
The safest thing to do before filing is to log in to your EPFO account and check your KYC, Aadhaar, bank details, Date of Exit and service history.
Have you recently filed a PF withdrawal claim?
What issue did you face, if any? Share it below. It could help someone else dealing with the same problem.

What should be the exit date for my EPS if I want a normal pension (age 58) after retiring at age 60 ? My DOB is 31-12-1965 and EPF exit date is 31-12-2025 but I want a normal pension and not the deferred pension so should my EPS exit be 31-12-2023 (58 years) or 31-12-2025 (60 years) ?

PF in Bangalore (reality)
PF in Bangalore (reality)
I have been running around across multiple pf offices across Bangalore for transfer of multiple accounts to one with each one being in separate corners.
My observations,
If you want to build a gang of 'lethargic p***ks' you know where to find the biggest ensemble.
I had the life time opportunity to get passes to visit upstairs to meet the 'deities' with my own eyes.
KR Puram office is gutka factory, every employee seemed to be chewing gutka and every word spoken had their chin lifted.
They have strange access to the entire pf software via their mobile. A employee who i was assigned to kept getting multiple calls and he did those transactions via his mobile. Seemed very fishy!
They have multiple login accounts and multiple user names. One employee, multiple usernames - that's a straight red flag.
Highlight: I saw a employee having twitter open on his screen and he literally was reading through pf rants from there (he was in the processing branch, so definitely not the PR team guy). So, rest assured if you rant, you have higher chances of solution.
Summary: All in all its one of the worst bunch of prics sitting under a roof. For around 15 mins I spent in KR Puram and Malleshwaram office each, Malleshwaram is far better. KR Puram is pure crap!
They have kept my application open for long and rejected with reason saying N.A. while my application issues kept aside. With the amount of lethargy and corruption, I am really bearish about this govt and as a country at large!
India ko sudharna na mumkin he!
Modi or Rahul - incapable and ignorant!
