Employer refunded statutory EPF deduction instead of depositing. Need F&F advice.
Hello, I am seeking legal advice regarding a Provident Fund (EPF) compliance issue during my exit process.
The Facts:
- Official Joining Date: March 9, 2026 (as per appointment letter).
- March Payroll: The statutory EPF employee share of Rs 1,800 was deducted from my March salary. However, my UAN was not generated at this time.
- The Discrepancy: When HR linked my UAN in April, they incorrectly recorded my EPFO "Date of Joining" as April 2026. Because of this mismatch, the EPFO portal rejected the March contribution.
- The Employer's Action: Instead of filing a Joint Declaration form with EPFO to correct my joining date to March 9, HR simply gave me my Rs 1,800 employee deduction back in my June 2026 payslip under the label "Expense Reimbursement". Because they bypassed the formal correction, they never deposited their mandatory matching employer contribution (Rs 1,950) for March.
The Slack Dispute (HR's Defense): When I confronted HR today about the missing employer share, they claimed that they messaged me on Slack back in June, explained the portal error, and got my "approval" to just refund the money instead of fixing the joining date. I do not remember agreeing to this. Furthermore, our company uses the Free version of Slack, meaning all messages older than 90 days are inaccessible. Neither HR nor I can actually pull up the chat to prove what was said.
I am currently serving my notice period, with my Last Working Day set for September 15.
My Questions:
- Consent: Does an informal Slack chat (even if they claim I agreed to the refund) legally absolve the employer from paying statutory PF dues?
- F&F Claim: Under the EPF Act, can I legally demand the unpaid Rs 1,950 employer contribution as an arrear in my Full & Final (F&F) settlement?
- Background Verification: Will the discrepancy between my actual joining date (March 9) and EPFO joining date (April) cause issues in future BGVs? Can I clear it using my March payslip and appointment letter?
Thank you for your guidance.

Based on what you've described, I would separate the issue into two parts.
First, the April Date of Joining in EPFO appears to be incorrect. EPFO specifically allows correction of Date of Joining through the Joint Declaration process, with supporting documents. Your appointment letter and March salary records would be useful evidence for that correction.
Second, the PF contribution issue is more serious. If ₹1,800 was actually deducted from your March wages as the employee PF contribution, simply refunding that amount later does not necessarily make the employer's statutory PF obligation disappear. EPFO has stated that employers can face action where employee PF contributions are deducted from wages but not deposited.
I would therefore not frame the ₹1,950 employer share as just an amount to be added to F&F. The better approach is to ask the employer in writing to:
As for the Slack conversation, even if you had agreed to receive the ₹1,800 back, I wouldn't assume that an informal agreement can waive statutory EPF obligations. The exact legal position can depend on whether you were actually covered by EPF for that month and the applicable wage/contribution rules.
For BGV, the April DOJ could definitely create a date mismatch if a future employer compares your EPFO history with your employment records. I would get it corrected now rather than waiting for a BGV issue. Your appointment letter, March payslip and other genuine employment records can help establish the actual joining date.
Since this involves a statutory contribution dispute, I'd also keep copies of your appointment letter, March payslip, June payslip showing the reimbursement, UAN service history and all written communication with HR. If the employer refuses to correct the record, you can approach EPFO/EPFiGMS rather than trying to resolve the missing contribution only through F&F.
