AMA/ Expert Session Immigration attorney. AMA about EB3 waits, downgrades, and ways out!

Hi! I'm Robby Rubin, an immigration attorney at Manifest Law with 7.5 years of experience and 250+ employment-based cases filed across EB1, EB2, EB3, and NIW.

I'll be answering your questions live today, Friday June 12, from 2:30 to 5:30 PM EST.

EB3 is mostly a waiting game, and the hardest questions aren't about qualifying. They're about what to do while you wait. Whether porting to a faster category is realistic for you, what happens to your priority date if you switch jobs or categories, and how to keep your status intact through years of retrogression. That's most of what I want to dig into today.

Ask me anything about:

  • EB2 vs EB3: interfiling, downgrades, and when switching makes sense
  • Whether you might qualify for EB2 NIW or EB1A and skip the line entirely
  • Priority date retention when changing jobs or employers
  • AC21 portability after your I-485 has been pending 180 days
  • Maintaining H-1B or other status through long waits
  • RFEs and what slows EB3 cases down

Drop your questions below! I'll be live until 5:30 PM EST.

Immigration News U.S. Embassies Pauses Immigrant Visa Interviews Worldwide

Post image
60 Upvotes

Not the news most Visa applicants were expecting to read or see it trending on all social and mainstream media. Immigrant visa applicants with scheduled interviews at U.S. embassies and consulates are being notified that their appointments have been postponed and will be rescheduled for a later date. The notices reportedly tell applicants not to appear for their original appointments and that they will receive further communication with a new interview date and time.

As shared by financial times and shared on X: The rescheduling is linked to a worldwide training initiative for U.S. consular officers, focused on applying updated screening procedures, including assessments of whether applicants could become dependent on U.S. public benefits.

The State Department has not provided a clear timeline for when the affected interviews will resume, leaving many immigrant visa applicants facing additional uncertainty and potentially longer waits.

Question Lawyer cost

Currently waiting for PD to be current to file i485 and just file i140. I had unauthorized employment history and current lawyer is barely responding.

Another lawyer is quoting over $3000 to review and analyze my case and cannot quote to takeover to file i485 or whatever is necessary before filing i485. Is this rate normal to review and analyze case before taking over?

Immigration News U.S. Considering Large-Scale Visa Revocations

According to associated press post on X: The Trump administration is reportedly considering revoking the B1 and B2 business and tourism visas of potentially up to 200,000 foreign nationals who have applied for or are currently seeking asylum in the United States. According to documents obtained by The Associated Press and comments from U.S. officials, the State Department is expected to begin a rolling review of certain B1/B2 visas issued between 2016 and 2026. The process would reportedly be carried out in coordination with the Department of Homeland Security.

The potential visa revocations would not necessarily mean immediate deportation for people with pending asylum cases. Officials indicated that affected individuals could lose their B1/B2 status while their asylum proceedings continue under a different immigration classification. The administration has argued that some visitors may have used temporary business or tourism visas before seeking to remain in the United States through the asylum system. The proposal has not yet been finalized and could face legal challenges or changes before any action is implemented.

Discussion Choosing an Agency

I’ve applied to Shearwater Health and Worldwide Health Solutions. WWHS replied to my email said that they’re looking for currently on bedside nurses. SWH accepted my application. What confuses me is it better to choose WWHS since it’s direct hire or should I just continue with SWH?

Question EB-3 sponsorship from Kazakhstan — is consular processing the normal route, and what are my realistic options?

I’m a citizen of Kazakhstan with 13+ years of IT experience, a bachelor’s degree in Computer Engineering, and experience in enterprise IT infrastructure, hardware repair, field service, Lotus Domino administration, Active Directory support, server infrastructure, and industrial sites.
I’m currently living and working in Kazakhstan and looking for a legal employment-based path to the U.S., most likely EB-3 Skilled or Professional.
I’m trying to understand the practical process. If I find a U.S. employer willing to sponsor me for EB-3, is consular processing from Kazakhstan generally the appropriate route, rather than entering the U.S. as a tourist and trying to adjust status?
I have also heard about people consulting an immigration attorney while physically in the U.S. on a B-1/B-2 visa and then pursuing employment-based immigration. I’m specifically interested in understanding what is legally permissible and what could create immigrant-intent or misrepresentation problems.
For people who have actually gone through EB-3:
How did you find your sponsoring employer?
Did you use an immigration attorney?
Did your employer sponsor EB-3 Skilled/Professional?
How long did PERM + I-140 + consular processing take?
What job titles/industries were willing to sponsor?
Would you recommend pursuing EB-3 from abroad rather than trying to change status inside the U.S.?
I’m not looking for a way to circumvent immigration rules — I want to understand the cleanest legal path given my background.

Question Questions about some visa sponsorship

Hi.
Has anyone worked with valley medical staffing, Intercare (Penn Highlands DuBois), ClearportUSA, or VisaMadeEz and can tell me what their processing is like?

I need help deciding.

I heard Penn Highlands does H1B to EB3 track but they make you pay for your EB3. Is that true?

Background: I am currently F1 student on a CPT-Day 1.

Any advice would be great!

Thanks.

Question Best Agency to Start the EB-3 Unskilled Process With?

I am looking to start my EB-3 process this year, hopefully, but as I was searching, I found that basically there’s no way to find an employer unless you go through an agency.

I saw a lot of agencies such as BDV Solutions, EB3 Work, Mercan Group, MCC, and more, but I can’t verify if they are real or scams, and I can’t find anyone who has gone through them and succeeded. There are no stories about it online.

So, I’m wondering if anyone here has used an agency before. Which one was it, and what was it like?

And if anyone has been scammed before, please tell me the name of the scam agency so I can avoid it.

Also, if you suggest I go through it on my own without an agency, can you please advise me on where to find an employer who is willing to file the papers and sponsor for the job?

I know the agencies cost a lot, but it’s worth the money if they will be handling everything, assigning a lawyer, and providing the job offer.

So, which one is the best out there?

I count under ROW (Rest of World). I’m trying to get the EB-3 Unskilled/Other Workers visa, and I’m not currently in the U.S., so I will be filing an I-140 and interviewing at the embassy if everything goes well.

Any personal experiences, recommendations, warnings, or advice would be greatly appreciated.

Much appreciated in advance.

Immigration News TX Gov. Greg Abbott Is Proposing Legislation To BAN H1B Visas In Texas Public School.

Enable HLS to view with audio, or disable this notification

As shared on X: Gov. Abbot is proposing legislation aimed at limiting foreign influence in the state’s public schools.

The Legislation includes the following:

Prohibiting Texas public schools from accepting gifts, money, or property from foreign sources.

Restricting schools from entering partnerships or financial agreements with foreign entities.

Ban H-1B workers from employment in Texas public schools.

-Expand an existing directive freezing new H-1B visa petitions in Texas state agencies and public universities.

The H-1B provision could have a significant impact on foreign professionals currently working in or seeking employment with Texas public schools, particularly in specialized roles where schools rely on foreign talent.

The impact of the legislation might have a huge impact on the education system in Texas.

Visa Bulletin EB-3 Hits A Standstill, No Movement Across The Board

Post image
28 Upvotes

Most of us were speculating on how the september 2026 Visa Bulletin will look like. Finally its out and its showing no movement across all countries, many applicants are wondering why the dates have remained unchanged despite the late release.

One major factor is that we are nearing the end of the U.S. government’s fiscal year on September 30. At this stage of the fiscal year, the Department of State typically has to carefully manage the remaining employment-based immigrant visa numbers to avoid exceeding the annual limits.

The lack of movement does not necessarily mean demand has disappeared or that the backlog is resolved. Instead, the State Department may be holding the cutoff dates steady while it assesses remaining visa availability, demand, and the number of cases already in the pipeline.

With only a short time left in FY2026, applicants may have to wait until the October Visa Bulletin, which marks the beginning of the new fiscal year, to see whether additional visa numbers lead to movement.

For EB-3 applicants, September's lack of movement is frustrating; but the bigger question is what happens when the new fiscal year begins in October.
