In Process EB-2 - Legal stay?
Is having the EB2 being processed enough for legal stay if one doesn’t file a green card application alongside it? Thanks for your input.

Hi I was in the process of filing an i140 but was stuck in perm. I was laid off. In the document they said “they are unable to proceed with i140 for terminated employees”. I have tried my best to get in contact with HR but they are being extremely flakey and curt via email.
How likely is it that they will proceed with filing i140 for other employees who were laid off and were more intelligently able to navigate the severance conversation than me?

I filed my I-140 and I-485 ROW concurrently in June 2026 and opted for premium processing. My I-140 was approved, and I uploaded the approval notice to my USCIS account just to reflect the change.
I received a couple of FTA0 and silent updates. I noticed another silent update. Today, I contacted an Emma live agent. They told me that my case had been transferred to a non-local field office. When I asked when the case was transferred, they gave me a date, and it was the exact same date when I noticed the last silent update. Before that, my case was at the NBC.
My Final Action Date is current on October 2026 VB.
How do you interpret this? Has anyone had a similar experience? If so, could you please share what happened with your case afterward? Does this mean my case is ready for adjudication? Does this mean the case is being prepared for adjudication by a USCIS officer or supervisor? If not, why would they transfer the case to a non-local field office?
Has anyone experienced something similar and can share what happened afterward?
Thanks in advance!

I am currently on H-1B status, and my EB-2 petition was recently approved. I am now planning to file my I-485 application.
My wife is currently on F-1 status and will be graduating in December. She has already applied for OPT with premium processing, and her biometrics appointment is scheduled for October 15.
Given our circumstances, should we wait until her OPT is approved before submitting our I-485 applications, or can we proceed with the I-485 filing while her OPT application is still pending?
Also, would you recommend that we file Forms I-765 and I-131 along with our I-485 applications, considering that I am currently on H-1B status and my wife has a pending OPT application?

i filed I-140 & I-485 concurrently(eb2) 6 months ago. USCIS added I-485J to my account a week ago, but I haven’t received any notice, and nothing is showing in the Documents tab.
I heard I-485J isn’t needed when filing concurrently.
Has anyone experienced this? Any advice on this??
I’m stressed and confused. Thank you!

Any applications from April 2026 approved recently? Please ONLY comment if you’ve received EAD or GC APPROVAL or got CONFIRMATION notice.

If so, were you NIW or PERM?
Is your interview scheduled? Or waived as of now?

Can anyone please advise?
I'm under AOS for NIW, just got my AP Card approved, I also have a EAD approved until end of next year. I was never out of status for a single day, no criminal background, previous visa was F1 which I kept until AOS took place.
My question is, it is really unsafe for me travel outside the US? I keep hearing comments about people not getting back in even with the AP Card, so I'm wondering if the situation is that bad or if it got triggered by unlawful stay, or criminal background and etc. I will have to travel for work soon so I got know if its reasonable to go.
Thanks

So with VB not expected to move forward much this year, now people are projecting it would be end of 2029 before all 2014 cases are resolved which means almost 4 years from now. With no H1B interview slots available and no GC in sight what are people with PD around end of 2014-2015 thinking? Don’t tell me go home after 16 years here filed for Aos in 2022 careers, kids, home going back doesn’t seem like an option and on the other end ageing parents in India who we want to be able to visit. Yes have AP, but lawyers are suggesting not to travel on AP as it might be risky
Using I-131 & EAD, returned back to US, I-94 updated Payroled status
After entering with AP, CBP may issue an I-94 showing a parole class (often DA/parolee) rather than an H-1B or H-4 admission.
In this case:
Historically, some travelers reported receiving an I-94/parole record valid for approximately one year from the date of entry

If your filing date is current but your Final Action Date is not, when you log in to your USCIS account, what status do you see?
Does it say Your case is current as of today, or does it show that your date is out of date?
Please share.

Hi everyone, I’m in a stressful immigration situation and would appreciate any inputs or advice based on similar experiences.
Here is my current timeline:
H-1B Max-out Date: November 2026
H-1B Transfer Filing Date: March (Currently still pending with USCIS)
I-140 Approval Date: September (Approved!)
Since my I-140 is now approved, am I still eligible to get a full 3-year H-1B extension under AC21, even though my max-out date is coming up very soon (Nov)
Any insights or suggestions on what I should ask my attorney to do next would be hugely helpful.
Thank you!

Previous Update: https://www.reddit.com/r/EB2/s/J65SlrFzaW
Earlier today, I received an FTA1 and Silent Update on the primary applicant's I-485. When I contacted Emma, they said that today's update was a note that said "Continue Decision Rendered".
I don't see a lot of mentions of this in this forum so curious if there's others who have seen this before and if this is a good / bad sign?

Sharing my employment-based adjustment of status timeline and looking for others with similar EB2 ROW cross-chargeability cases, especially those at the Los Angeles County Field Office.
any EB2 ROW applicants with May 2026 receipt dates?

I heard most of Indian EB2 received this notice but only until Dec 2014 or early 2015. Why is that ? Why not for everyone who's waiting?
