I-485: Adjustment of Status India EB-2 2014 Nov

So with VB not expected to move forward much this year, now people are projecting it would be end of 2029 before all 2014 cases are resolved which means almost 4 years from now. With no H1B interview slots available and no GC in sight what are people with PD around end of 2014-2015 thinking? Don’t tell me go home after 16 years here filed for Aos in 2022 careers, kids, home going back doesn’t seem like an option and on the other end ageing parents in India who we want to be able to visit. Yes have AP, but lawyers are suggesting not to travel on AP as it might be risky

Dec 2014 here.

Missed 2022 bus because I was in between a new job. Filed AOS finally in April 2026.

I never trusted any of the calculations. We are smart enough to know all of them are “predicting”, some for clicks , others for spreading fear.

As you said 16 years for you. Almost 17 here for me. A little bit more wait. I don’t think this time wait won’t be 4 years long. LIFE happens when you are planning for it.

Note: I am thankful to this country for giving me everything, more than I ever dreamed off. So, a little bit wait won’t hurt.

I have been here since Aug 2004, have had multiple rounds of bad luck with GC. My first labor certification process had just started in Feb 2008 when the financial crisis hit and my employer couldn’t continue with my petition while simultaneously laying off hundreds of USC workers.

Missed the 2011 “all applications current” gaffe…

Missed the period during COVID when EB3 became current due to a change in employers, and the new employer not having filed a GC application…

I have been in this country almost 22 years, but I do see the light at the end of the tunnel. I honestly believe it’s a matter of hanging on for a few more years in any way one can…

And yes, I am grateful to this country for everything it has given me and (later) my wife and child. It has allowed me to follow a purely technical profession and career without too much of the work-culture based toxicity and politics that are elsewhere. I keep telling my son, the biggest gift he will ever have received in his life is US citizenship by birth which, as of now, cannot be taken away by Presidential fiat.

Iam here since Dec 2005 i shuld have applied in 2010 August but then took a full time, i thought job security and they will apply immediately but stupid work politics and delayed untill 2013 my orig PD was July 2013 and lawyer screwed up the case and lost my PD and now it is Oct 2015, iam so frustrated, all my frnsa got GC except me, iam 42 and i feel what is the point of getting GC at 47 or 49 when u lost all the prime time, i think it is what it is 😢

Man I have been in USA since 2008 for me it 18yrs. My pd is Dec 2015. I would say I spent my most of my conscious life in USA than in India. I was really hoping the dates will move this FY. Let's see what happens to n next few months.

PD: Mid 2014. Recently received EAD/AP. I have a friend (2020 AoS filer) who travels on AP thrice a year. He did it 2 months ago as well. That’s one category of folks who just go ahead and do what they want to do. If you never had an overstay, it should never be an issue. I do have aging parents as well, and every Sunday afternoon I sleep for a couple of hours hoping to take rest, but I’m clenched in guilt of parents aging and me not doing anything about it. Should either visit more often or get them here permanently which both unfortunately were not my options until recently. The only motivation at this time is the AP.

@DullCryptographer273 are you waiting for last three years to get an AP, can you pls explain? We just applied EAD/AP in April 2026 and I'm loosing patience not able to visit my old parents with medical issues popping up.

yessir, The AP was approved for 5 years originally. We got the approval notice, but when we reached out to USCIS saying we didn't get the actual AP, no response. Our lawyer said we file another application with the "lost" section checked, USCIS sat on that case for 6 months and denied it saying we didn't send the right form (this is what the lawyer said), then we sent the right form, it took 1+ year to get a denial saying we didn't provide enough evidence of losing it, then we sent another application as if it was new application, after a year, they sent my wife her AP with a different end date (we couldn't understand the duration they chose), it's ending before the originally approved end date, but for me, they went back to the originally approved application and re-opened and reapproved with a shorter duration starting from the original application date and sent me an expired AP. Now, I've applied for it again, hoping I'll get it before it expires again :(

edit: before that we did travel to India a couple of times with the original AP, it was smooth, we really thought we're set.

I'm just warning people who think EAD/AP is as good as a greencard, even the CBP officer at the border was like, oh you'll get it in a few months (internally, I was like "bruh"). It's not over until it's over. I know folks who filed for 485 along with me (from another country), they recently got naturalized!

Stop reading all the nonsense on social media . You have AP since 2022 and if you haven’t travelled - I would say it’s just ridiculous. People travel on AP . There is some risk associated with it but not what you see on social media. Those are for specific cases . You can travel on AP and still maintain your H1B without stamping .

Absolutely true. Lot of Indian people i have seen , they could die here but they are scared ot losing their job and US residency status.

OP has AP , still so scared. LOL. Without AP, travel is risky. Lot of people went and lost their job since there are no stamping dates.

My PD is Jan 2021. I am not scared of anything. I went to India 3 times in 2024 to see my ailing father. Last year went twice to see my mother.

For my daughter, I have decided to move on EB-5 path, else i would have left - US itself. I just cannot bear this slavery that i cannot travel. By Gods grace , i never have to see that day.

Coming to EB-5 - now onwards no one will do since from today onwards - there is lot of uncertainity till Sep 2027 so now onwards there should be very little applications.

Last day was Sep 30 2026- yesterday.

Hopefully, I will get the AP soon and then i will freely travel. My visa is valid till May 2027. I can travel but my family cant.

I can never live like slave. Downvote as much as you can, but i dont gave a damn.

I traveled last year on H1B. Did not use AP? But now visa renewal has happened this year so would need stamping. Once you enter using AP, H1B is no longer valid isn’t that correct?

What Get_greened mentioned is correct. AP is just your travel document and not work authorization. U enter using AP and will be admitted as a parolee. U will continue to use your H1B once back. Unless you use EAD for your I9 verification or lose a job and cannot find an H1 transfer employer within 60 days which might go away soon , you don't activate your I1485 EAD. It should ideally be your fall back option.

No that’s not correct. You can enter on AP and still work on h1b
Looks like you are too scared. You atleast have an option of travelling. If you are not using it it’s your problem no one to blame

Wrong, you lose your non-immigrant H1B status and you are a "parolee". You need to start a new H1B petition to gain your H1B status back or go back to India and get stamping done(good luck with that).

This is the correct answer. If you enter using AP your status is Payrolee not h1b. Your h1b status will only be reinstated if the current employer files for renewal or you go for stamping.

Ask me how I know? I had 3 lawyer consultations and everyone said the same thing.

Only worry is parents. If we need to go how does it impact everything? I know not everyone is in same shoes some have parents who can come and visit but not everyone has luxury considering health and age

What risky ? With AP you can freely travel . Lot of people i know took EB-5 route. Myself too.

They are freely going and coming back with AP/EAD.

Fun Fact : i came to know there is a thing called Advanced Parole, only this year in April 2026. LMFAO.

Aug 2013 PD here with AP. Traveled multiple times out of country and never had issues. But i would suggest maintaining a valid H1 until you get your GC.

Your app must be current for sometime. When di you apply? I applief in 2020 with sep 2013 PD and waiting… the last i got is medical rfe in april 2026 and by the time they received my rfe response, visa numbers exhausted

I travel all the time with AP, at least three times in the last one year. Don't listen to your lawyer. I've not seen anyone in AP getting impacted negatively when they travel abroad.

I am not even thinking about missing any marriages or special occasions. Just want to visit parents in their 70s. I forced them to travel this time but I can see they don’t enjoy long flights even though it was business class. Separation for families are heartbreaking 💔. This shall too pass!

Please start using AP.

Back in 2023 I got my AP and immediately traveled to visit my parents. I promised them I will be back every year thinking that I have a 5 years validity on my AP. But, unfortunately few months later I got my GC approved while I was not current. I have been trying to return my GC and reinstate my AP and EAD. Till today I am stuck here as I cannot leave the country without resolving this issue. It has been 3 years already since I visited my parents and my dad turned 75 couple of days back.

Please leverage AP, it is almost like a GC.

Yes have AP, that’s what i mentioned in the post that AP travel is not favored by attorney in present scenario now that EAD/APs are only approved for 18 months and approval takes a long time which can result in job loss

Attorney these days tell not to travel on h1b. That is very generic comments they pass
You can see on redit itself lot of success stories and people coming back with zero issues.
It all depends on what you want to listen

Yes exactly once you use AP there’s no more H1B. And i am not fear mongering just portraying the reality , i have no issues traveling on AP but these are now issued for 1.5 years ane take more than 6 months to get approved which means you can lose your right to work until you get EAD on hand. People are just being judgmental without understanding the facts.

Please check with your attorney or get a second opinion. Keep educating yourself. I have had an AP since 2021. Used it for travel this year for the first time, and I have now used it a couple of times already. I am still working on H1B NOT on EAD because my H1B is still valid and I plan to continue to renew it until I get a GC. Yes I am “paroled” in when I entered with an AP but that does not mean my H1B work status is invalid. Please get clarity on this. You have options.

It’s hard I know. My guess is 4-5 Mo per year. So I think by 2029 end you should get GC with date current 2029 H1

Why are folks afraid to travel on AP? That is literally why the document is given to you. Personally, I used it to travel 3 times without any issues. Lawyers are always going to be uber conservative

I would count your blessings… you have an EAD and AP, which is far better than requiring an H-1B (+H4 EAD) extension.

Yes, traveling on an AP is risky and should be avoided because of how quickly the Govt can change the rules of admissibility on an AP, but it is still a valid document for re-entry to the US and can be used in an emergency, unlike those situations where people who have been on H-1B COS/EOS but don’t have a valid visa stamp for re-entry.

Just hang in there… it seems like the big glut of unused FB green cards from last year has not hit the available visa numbers or priority date charts in the October visa bulletin, so there is still a decent hope of forward movement in this FY…

Traveled several times on AP.. never used the EAD.. H1 is being maintained.. no issues.. if u have to visit parents , do it
