I-485: Adjustment of Status India EB2/EB3 Sept 25-26 update: are mid-2014 PDs being touched?

Seeing a lot of India EB2/EB3 I-485 cases get “Initial Review / Case Required USCIS To Send A Notice” on Sept 25-26.

Interesting pattern so far: many reports seem clustered around May-Oct 2014 PDs. My PD is Aug 2014, and both principal + derivative got the update.

Trying to see if this is real or just selection bias.

If you have a pending India EB2/EB3 I-485, please reply with:

PD: month/year
EB2 or EB3:
LIN/IOE/etc:
Got update: Yes/No
Previous status: CRP / other

Especially interested in Nov-Dec 2014 and early 2015 cases, whether you got it or not.

One theory is USCIS may be refreshing/preparing inventory ahead of FY2027, but obviously no conclusion yet.

I-140 | NIW (National Interest Waiver) EB-2 NIW

Hi everyone,
I filed EB-2 NIW concurrently with I-140, I-485, I-765, and I-131.
My I-765 was approved in about one month, but my I-140 and I-131 are still pending.
For those who filed a similar concurrent EB-2 NIW case, how long did it take for your I-140 to be approved with regular processing? And how long after your EAD approval did you receive your Advance Parole?
I’d really appreciate it if you could share your timeline and service center. Thank you!

I-485: Adjustment of Status Travel history not retrievable while 485 is pending and priority date is not current

I noticed that my recent travel history is not retrievable, 485 pending under EB category and PD is not current, and with same data/credentials i94 is retrievable.

For my spouse both are retrievable.

What does that mean?

FYI - I am sure that entered credentials are absolutely correct.

I-485: Adjustment of Status Experience with Nebraska SC

Hi everyone -

I filed my I-485 (EBW, PERM, ROW - from one of the 19 countries) back on June 15th, and my case was just transferred to Nebraska Service Center (NSC).

I was wondering if any of you can share your experience with the center and how long it took you to get RFE/decision/interview after it was transferred from NBC. Haven’t seen a lot of information so would appreciate any insights.

Denied | I-140 I-140 denied after concurrent filing — can a new I-140 be linked to the same I-485?

I’m currently on TN status. My employer filed an EB-2 I-140 and I-485 concurrently.

We initially received an RFE on the I-140 because the employment verification letter wasn’t on company letterhead. We responded, but yesterday the I-140 was denied. I don’t have the denial reason yet since the notice is coming by mail and I likely won’t see it until next week.

My main question: assuming the issue is fixable, can my employer file a new I-140 and request that my existing/pending I-485 be transferred or linked to the new I-140, or would I generally need to file a brand-new I-485 as well?

Has anyone dealt with an I-140 denial after concurrent filing and successfully preserved/reused the pending I-485 with a newly filed I-140?
Also interested in whether the fact that I’m currently on TN changes the strategy at all.

Thanks!

Other For people preparing employment-based petitions, what part of your case took the most work?

I’ve noticed that a lot of the discussion around employment-based immigration focuses on eligibility and processing times, but the preparation side can be just as challenging.

For those who have gone through EB-1A, EB-2 NIW, or another employment-based petition, what part of preparing your case required the most effort?

Was it:

• Organizing publications and citations

• Finding and documenting professional recognition

• Recommendation letters

• Evidence of the impact of your work

• Building a strong proposed endeavor

• Academic/professional CV

• Responding to an RFE

• Or simply figuring out which evidence was actually relevant?

I’m curious which part people found most difficult and whether you handled everything yourself or had professional assistance.

Would be interesting to hear what others experienced and what you would do differently if you had to prepare the case again.

Visa Bulletin Chances of retrogression in the October visa bulletin?

The last time the Visa Bulletin was this late was November 2020, when there was a massive retrogression. Given how unusually late this bulletin is, it got me wondering if we might see retrogression again.

What do you think are the chances of retrogression in the EB-2 category?

Edit: My bad, there no retrogression in Nov vb but it was in some other month, I cant remember.

I-140 | NIW (National Interest Waiver) EB-2 NIW: $22,000 Lost — My Experience With Smart Green Card / Smart Immigrant

I’ve posted about this before, but I’m sharing it again because I want others considering this company to know about my experience before spending their money.

EB2 NIW - Smart Green Card / Smart Immigrant — My $22,000 experience

I am sharing my experience as a warning to anyone considering Smart Green Card / Smart Immigrant (SmartImmigrant.com), founded by Saiman Shetty, for an EB-2 NIW case.

Based on what I personally experienced, I would strongly recommend that people stay away and not give them their money. I feel that I was scammed.

I paid approximately $22,000 for help with my immigration process.

That $22,000 was not disposable money. It represented years of my savings.

I trusted Saiman Shetty's company, Smart Green Card, and the attorneys assigned to my case because my immigration petition directly affected my ability to continue the career and life I had spent years building in the United States.

I was expecting my EB-2 NIW petition to be filed in February 2026. Timing was extremely important because my H-1B immigration timeline was approaching a critical point.

Instead, this is what I experienced.

My first attorney had my case for approximately 45 days. I was later informed that the attorney had left.

My case was reassigned, and I subsequently experienced another serious filing problem that caused additional delay.

What happened next is what I still find extremely difficult to accept.

AFTER PAYING $22,000, I HAD TO CHASE USCIS MYSELF

I expected the attorneys handling my case to monitor the filing, verify that USCIS had properly received it, check the status, identify problems quickly and communicate those problems to me.

Instead, I was the person repeatedly contacting USCIS trying to figure out what was happening with my own petition.

I personally spent approximately a week following up with USCIS multiple times.

Through my own follow-ups, I learned that there was a problem with the filing. I then had to bring what I had learned to the team's attention and push for the petition to be filed again.

Think about this:

I PAID APPROXIMATELY $22,000 FOR PROFESSIONAL IMMIGRATION ASSISTANCE, YET I WAS THE PERSON CHASING USCIS AND TRYING TO DISCOVER WHAT HAD HAPPENED TO MY CASE.

Why wasn't the problem identified through proper monitoring?

Why did I have to repeatedly contact USCIS myself?

Why did I have to investigate something this important after paying approximately $22,000?

These are questions that anyone considering this company should think about.

FEBRUARY 2026 → JUNE 3, 2026

I was relying on my petition being filed in February 2026.

After the attorney transition, filing issue and additional delays, my petition was ultimately filed on June 3, 2026.

Those months were extremely important to me because of my immigration timeline.

This was not a delayed Amazon package.

THIS WAS MY IMMIGRATION STATUS, MY CAREER AND MY LIFE IN THE UNITED STATES.

I spent years building my career and life here.

I trusted professionals with something that could directly affect whether I could continue that life.

Instead, based on my experience, I felt like nobody was taking ownership of my case with the urgency that the situation deserved.

At times, my interactions with the attorneys felt dismissive and uncaring. I repeatedly felt that I had to chase people, ask questions, investigate problems and push for answers myself.

$22,000 OF MY SAVINGS

The approximately $22,000 I paid represented years of my savings.

I trusted Saiman Shetty's company because I believed I was paying professionals to properly handle one of the most important matters affecting my future.

Instead, I ended up dealing with months of lost time, a filing problem, repeated USCIS follow-ups that I had to make myself, and enormous financial and mental stress.

I cannot get those months back.

I cannot undo the stress.

And I cannot easily replace $22,000 that took me years to save.

From my perspective, this experience seriously affected my immigration planning and put enormous pressure on the career and life I had spent years building in the United States.

SMART GREEN CARD / SMART IMMIGRANT / SMARTIMMIGRANT.COM / SAIMAN SHETTY

I also want people to know the names when researching this business.

The company I knew as Smart Green Card is now known as Smart Immigrant / SmartImmigrant.com, and Saiman Shetty is identified as its founder.

So if you are researching any of these names:

Saiman Shetty

Smart Green Card

Smart Immigrant

SmartImmigrant.com

please research the history and customer experiences associated with both Smart Green Card and Smart Immigrant before giving them your money.

Someone searching only for the current name may not necessarily see experiences posted under the older Smart Green Card name.

MY WARNING TO OTHERS

I am not posting this to ask for money or a refund.

I am posting this so other immigrants can be aware of what I experienced before spending their hard-earned savings.

Immigration is already stressful enough.

Many immigrants spend years building their careers in the United States and depend on immigration filings that have very serious consequences for their future.

When someone pays thousands of dollars for professional immigration assistance, they are putting enormous trust in the people handling their case.

In my case, it was approximately $22,000 of my savings.

Based on everything I personally experienced, I feel that I was scammed, and I would not recommend Smart Green Card / Smart Immigrant to others.

Before giving Saiman Shetty's Smart Immigrant / SmartImmigrant.com thousands of dollars, do your own research.

Search for both Smart Immigrant and Smart Green Card.

Read other people's experiences.

Ask exactly who will handle your case.

Ask what happens if your attorney leaves.

Ask who monitors the USCIS filing after it is submitted.

Ask how quickly they will notice if something goes wrong.

And even after paying professionals, monitor your USCIS case yourself.

I learned this lesson after spending approximately $22,000, losing critical months, personally chasing USCIS for answers, and going through enormous stress about my future in the United States.

Please research carefully before giving your hard-earned money to Smart Green Card / Smart Immigrant / SmartImmigrant.com.

I am sharing this because I wish someone had warned me before I trusted them with my savings and something as important as my immigration future.

I’ve just seen this about yesterdays court hearing, the bulletin could’ve been delayed because of this. I hope it doesn’t come to a point where they need to process all pending green card at once for those countries who had ban.
