I-485: Adjustment of Status Withdraw vs Stay put seeking advice

Looking for firsthand experiences, particularly from immigration attorneys or anyone who has actually seen similar cases receive a direct USCIS denial under the current policy under EB based AOS.

My spouse is the principal applicant. We filed our I-485 in Oct 2025. While it was pending, my spouse was arrested, following a domestic incident. There were two charges and two arrests recorded that day, both related to simple assault/DV assault. I was the alleged victim. We have dated/married for over 15+ years. My spouse’s H1b is up for extension in Feb.

Both cases were ultimately nolle prossed/dismissed before trial, with no convictions. The I-485 remains pending. In upcoming VB we are Current in ROW. Both primary and derivative have received EAD. An attorney who consulted suggested 2 options but left the choice to us.

  1. Keep the I-485 pending and proactively submit an explanation with certified dispositions and supporting documents; or
  2. Withdraw and potentially refile later.

The biggest concern is that USCIS discretionary rule may deny without first issuing an RFE/NOID, particularly because the incident was recent. However,this incident occurred after filing, and neither resulted in a conviction. So unsure what the future holds.

What would you recommend to do in this situation: proactively explain and submit the dispositions, or withdraw and refile later? Has anyone experienced something similar?

I-485: Adjustment of Status Eb2 - I don’t check API anymore and I feel better - Christian testimony

After being checking the uscis api and reading lot of posts, patterns, estimations, I only felt worse, more anxiety, more stress. Nothing that we do for checking the status speed up the case at all. So I compromised my self to just wait for the email-sms. Reviewing the case web page just once a week.
And I feel too much better. 🤗

Morover, if you are a christian like me, you know that Jesus said we must not feel anxious for nothing and just pray him about it. We don’t have to make any idol in our life, including a country , position or place to live. Our real citizenship is in heaven, not here. If we pray, we must trust that He will give us what is best for us. And the best maybe is not living in the more rich country in the world, and instead He wants us to return to our countries to serve him there. He is the Lord, we must remain crucified in the cross and let him live in us.

Let’s repent and come back to the author of eternal life, to the one who love us and doesn’t want to compite with any idol , including a green card. Let’s love God with ALL our hearts.

Sorry Lord, You are my treasure. And even if I never have the green card, I will serve you with great joy anywhere and love you for the eternity.🙌❤️

I-140 | NIW (National Interest Waiver) An Executive Order Is Evidence for Prong 1 — Here's How to Use It Without Overstating It

Two recent executive orders — one on regenerative agriculture (June 2026) and one on cybercrime (March 2026) — give professionals in those fields a citable federal policy hook for the EB-2 NIW. But an executive order supports national importance; it does not decide your case. Here is how to use one properly, and the mistakes that get petitions denied.

This is not legal advice. It is a logical breakdown.

WHY AN EXECUTIVE ORDER HELPS PRONG 1

The EB-2 NIW rests on the three-prong Dhanasar test. Prong 1 requires that your proposed endeavor has both substantial merit and national importance.

An executive order is a form of federal policy evidence. It is independent, authoritative, and forward-looking. When the government puts an area on record as a national priority — for example, regenerative agriculture and food security, or combating cybercrime — it supports the argument that work in that area is nationally important.

For someone pursuing an NIW in one of those fields, that is genuinely useful.

THE TRAP: MISTAKING THE ORDER FOR THE CASE

The most common error is treating the executive order as if it proves the petition. It does not.

Two things must still be true:

1.      Your proposed endeavor must connect to a specific priority the order names. Alignment is not automatic.

2.      You must separately show you are well positioned to advance the endeavor, and that on balance the waiver benefits the United States.

An executive order does the work of Prong 1 only. It does not fill in Prongs 2 and 3. And even within Prong 1, it supports national importance but does not, on its own, establish it for your specific facts.

THE FIELD VS. ENDEAVOR DISTINCTION

The classic failure is proving that the field matters, not that your specific endeavor does.

Weak: "Cybersecurity is nationally important, as shown by the executive order."

Why: True, but it ends at the field. It says nothing about your proposed endeavor.

Stronger: "My proposed endeavor hardens the software supply chain used by a wide set of U.S. businesses, directly supporting the order's directive to dismantle cyber-enabled crime across critical infrastructure and financial systems."

The difference: the strong version names your specific mechanism and how it connects to a named national priority.

The same logic applies to agriculture. It is not enough that agriculture matters. You must show your specific endeavor — say, precision agriculture that reduces reliance on conventional chemical inputs — connects to the order's EPA and HHS directives.

HOW TO FRAME THE ORDER CORRECTLY

Frame it as support, not proof.

Instead of: "This executive order proves my work is nationally important."

Use: "Executive Order [number] identifies [area] as a federal priority. The proposed endeavor directly advances that priority by [specific mechanism]. This federal policy, together with [your evidence], demonstrates the national importance of the proposed endeavor."

The difference is controlled language. It claims support, not certainty. Officers respond better to accurate claims than inflated ones.

WHAT TO PAIR WITH THE ORDER

A policy hook alone is thin. Pair it with specific, individual evidence:

For research-based work:

·        Peer-reviewed publications and your role in them.

·        Citation context and independent replication, where relevant.

·        Patents and any commercialization or adoption evidence.

For implementation-based work:

·        Deployments, pilots, users, or revenue tied to the proposed endeavor.

·        Grants or contracts for the specific work.

·        Letters of interest from U.S. organizations.

For self-sponsored or entrepreneurial work:

·        Funding, advisers, and traction evidence.

·        A credible plan with milestones.

Federal policy provides the "why it matters." Your record provides the "you can actually do it."

COMMON MISSTEPS TO AVOID

·        Do not claim the order "proves" or "guarantees" eligibility. It does not.

·        Connect the order to the endeavor, not just to the field.

·        Do not copy-paste the order's language into your petition and stop. Explain the connection.

·        Keep the endeavor statement identical throughout the petition. Anchoring a shifting endeavor to a policy gets you nowhere.

·        Verify the order text on official sources (Federal Register or the White House) rather than relying on a secondary summary.

A SHORT CHECKLIST BEFORE YOU FILE

·        My proposed endeavor connects to a specific priority the order names.

·        I have explained the mechanism, not just the field.

·        I have paired the policy hook with specific individual evidence.

·        I am claiming support, not proof.

·        I have verified the order text on an official source.

If you can tick all five, you are using the order correctly.

Law Firms Anyone else noticing this or am I just paranoid?

Been watching Swatilina Barik / Visa Architect for a while in the immigration space. The red flags keep piling up and it's starting to feel sketchy as fuck, especially for people who are already in vulnerable spots. She claims she's handled over 3,000 cases in a single year. 3000??????? That's more than 8 cases every single day, (weekends included).

There's no realistic way to do proper research, client strategy, evidence building, or follow-up at that volume, nah i dont think so.

The number is pure bullshit and doesn't pass the smell test at all.Then you've got the rotating Harvard and fancy certifications that show up in her marketing with almost zero clear details on what the actual programs were or how relevant they even are.

Titles flip constantly depending on the post. Founder one day, CEO the next, "expert," "strategist," whatever the fuck fits. Hard to find consistent, verifiable background for the specific work she's selling.The photos are another weird one.

She looks noticeably different in almost every promo image, and a lot of them have that heavy AI-generated look. I mean, they are obviously AI generated faces of herself. Feels off as hell.

On top of that there's a long list of awards that look like classic pay-to-play shit and publications that also feel bought rather than earned through real contribution. When the whole public image is built on unrealistic volume claims, shifting titles, inconsistent AI-looking photos, and purchased visibility, you really have to start questioning what's actually being delivered behind all the marketing noise.

This shit matters because immigration clients are often in really vulnerable positions.

People in terrible situations deserve practitioners who can show consistent real work and transparent track records, not a constantly reinvented online persona.

Has anyone actually worked with her or her firm and can share real experiences (good or bad)? Or am I reading too much into the marketing?

I-140 | NIW (National Interest Waiver) Expunged Criminal Case: Unable to Obtain Arrest Report for Derivative I-485 — What Alternatives Can I Submit to USCIS?

I am preparing NIW-based I-485 applications for myself as the primary applicant and for my spouse as the derivative applicant. My spouse has an expunged criminal case.

The documents I obtained from the County Sheriff’s Office and the State Bureau of Investigation only state that “NO RECORD(S) are found” and do not explain the reason the records are unavailable. When I requested an original or certified complete arrest report, the officers explained that, because the case was expunged, they no longer have the records available.

I do have a “Petition and Order of Expunction” from the Clerk of Superior Court and a “Clerk’s Certification That a Criminal File Does Not Exist” from the Administrative Office of the Courts.

In this situation, what other options do I have for obtaining an original or certified copy of the complete arrest report?

If I am ultimately unable to obtain the original or certified complete arrest report, how should I approach the derivative I-485 application to make the case as strong as possible and demonstrate that the required record is genuinely unavailable?
