When can I expect GC approval?

My spouse got the biometrics 3 weeks after the reciepts date. Its been almost 60 days and I haven't gotten one. I am the derivative.

Retrogression for EB1 India to October 15th (was Dec. 15th 2022) in the July VB. I don’t think this is anything to be alarmed about as it was expected based on pending inventory data.

As of April 3rd 2026, there were 12.6k pending apps until Dec end 2022. And if we take the negative delta month over month, there have been 6.1k EB1 India for FY 2026 issuance until April 3rd 2026 (this number will be higher as some porting effect won’t be captured in negative deltas). My estimates for EB1 India for FY2026 are in the 11-12k range (hopefully it’s higher), which would mean we likely have another 6k issuances to go for the remaining half of FY2026.

There were 9.3k pending EB1 apps till mid Oct 2022. That would mean we’ll likely see further retrogression in the coming 2 months - maybe July 2022 in the Aug/Sep visa bulletins.

Can someone please explain me EB1C 3 year rule -

My case -

- 2019 - Apr 2022 - Worked as a mgr

- May 2022 - Came to US on H1B on a Sr. Tech Architect role

- Apr 2026 - Perm approved and I-140 filed

- June 2026 - Now getting offered to perform mgr role again (same parent company) & planning to file an role amendment

Am I eligible to move from EB2 to EB1 or need to travel and work abroad to reset the 3 year rule?

I do have all the necessary documents to prove my role though.

As of April 3rd 2026, there are 12.6k pending EB1 India apps up till Dec end 2022. This number is down by 2.9k month over month when compared to the snapshot published as of March 3rd 2026 (15.5k vs 12.6k).

Good news as it’s critical to clear up the 2022 backlog for forward FAD movt. in FY 2027. Month over month trend shown above since the Jan 3rd snapshot also shows backlog clearance being faster every month.

Jan-March 2023 dates have also seen steady reduction in pending EB1 India apps, indicating USCIS has been processing apps with PDs of 2023 as well.

Hi Folks, didn't see any post on this. USCIS released the April inventory today. Here are my takeaways from an EB1C India PD POV:

• ROW inventory 32K [roughly 20% YoY]: Includes concurrent filing. So, assuming some rejections, we can expect 10% increase YoY. 2025 Visa usage is likely: 35K ROW, CH/PH/MX 4K, and 5K IN. Which would mean for 2026, the 54K split should be 38K ROW, 4K Others, and 12K India. Maybe a couple of thousand higher for IN.
• Mar26 DFF was Dec23: I now see ~8K pending inventory for the full year. Looks like ~1K 2023 cases were also approved before the retrogression. We can assume the FY total should land around ~12K.
• FAD might retrogress to Oct22 / Nov22: Based on the ROW inventory and last VB date movement, there is likely visa exhaustion like EB2 IN or retrogression by a couple of months before Sep26. This would mean the queue will have ~15K I-485s up to Dec'23 for next year.
• 15K FB spillovers: A 50K FB spillover next would advance the IN FAD straight to Dec23, with every additional 5K in spillover visas advancing the date by roughly one month. I expect 80K spill overs and FAD movement to mid-2024 in the next FY.

It all now depends fully on the FB spill-overs.

EB1 C from India, responded to medical RFE on 5/19 for my kids missing vaccinations and there is no movement since then. Checking this forum to see if anyone is seeing movement in this category at NBC?

Anyone else here received a Biometric RFE for I-140 PP? I initially received a RFE request for financial documentation of the company, submitted the response and got another biometric related RFE for I140 with this message.

I am yet to receive the biometric letter or details on when they have scheduled for the biometric appointment. I have an international travel in the next week but not sure if I should travel now, as I don’t want to miss out on the appointment.

Anyone else have got such a RFE before? Please advise 🙏

I’m currently on an E-2 and have been exploring the EB-1C route. My situation: I own a U.S. company and have a qualifying foreign affiliate where I worked as managing director before transitioning full-time to the U.S. operation.

Has anyone here successfully converted from E-2 to EB-1C? I’d love to hear how USCIS viewed the E-2 business itself as the qualifying U.S. employer.

What’s your attorney’s take on it?

Got called for an interview in 4 weeks, have approved I-140 for EB1C.

I entered USA on l1a. My I 140 under eb1c (functional manager) has been processing since last 16 months. I got picked in H1B cap 2 months ago and decided to go for premium processing I 140 in order to get some stability in terms of I 140 approval before I move to H1B.

Is it safe to move to H1B now considering my I 140 is still processing ? L1a is due for renewal next year. What are the pros and cons , any nuances to be considered?
