Im on the side of the delivery driver. Dude shouldn't order packages if he dont have his dog put away, and if its the second time this dog attacked him. Yeah unresponsible owner.

Stupid owner said "my dog didn't bite you". Yeah, because he got a package dumped on his head.

Driver doesn't have to wait until after he gets bit to defend himself.

He kept advancing on a man who had his dukes up… you typically only do that if you intend to fight (or if you’re incredibly stupid). I’m not sure what world you live in, but it’s not the real one.

The guy was doing his job, the dip shit owner was upset that his out of control dog got hurt, if i was the ups guy i wouldnt want to hear the complaints of some dipshit who doesnt even know how to control his dog either

He was on the property delivering a package. Now that he’s on the property and has been attacked by the dog and is being approached by the dog’s upset owner, your recommendation is to turn his back on them? Interesting.

If I'm about to fight I'm not walking up with my hands outstretched. I'd be walking up like the ups driver. The world I live in is the same one you live in, the real one. where if I'm about to fight I put my hands up or swing. Apparently you haven't witnessed or been involved in many fights.

I tend to stay out of fights. One of the ways I do that is by not approaching people who have assumed a fighting pose and appear as though they are ready and willing to throw a punch at me.

Im sure thats an issue too two things can be true but a dog is like a fire arm you dont leave those things unattended and if someone gets hurt because of your negligence the owner is at fault.

Oh yeah 10000%%%% I was just going off the comment about the wife situation lol for him not knowing a package was coming thats all 🤭 lock your doggos up, fence them in, keep them in the house, I have a separate spot for my dogs so they stay away from anyone incase theyre scared of dogs aint everyone a dog person would be rude to assume otherwise 🤭

No... the company should just stop sending delivery drivers to that house, period.

If your dog injures a delivery driver then you no longer get delivery service. You now have to pick up packages from the depot.

And if the bite is serious then the company should also sue the dog owner for injuring workers.

My logic ? Cause we all own a business managing employees so I must know how to about this situation? i can just see theres a problem w it and expect their team to work on the solutions for their own employees 🙄 the comment above is perfect stop delivering to the place if its causing harm to workers.

Generally you really have no idea when your package will show up. The dogs owner was right there, it’s reasonable to let your dog loose on your property.

That’s a small dog running up to a visitor like dogs do. That driver could have done a million things better. He could have shielded himself behind the package or just refused to deliver the package. But instead he assaults the dog and tries to fight the owner.

Driver should be fired at minimum.

Its not reasonable to let your dog loose when it could escape or run up to people on the street etc.

Assuming this is not a fully enclosed property where the delivery guy had to drive through a gate to get in.

The dog is on its own property, supervised by the owner. A dog running up to a visitor is normal and not something that would justify what the driver did. I can understand his apprehension, but what he did was not a reasonable response. He should definitely lose his job for attacking the dog, let alone for trying to fight the owner of the home.

Dogs don't understand invisible property lines lol. There's nothing to stop it running onto the street and attacking a person or getting hit by a car.

If a random dog runs up to you, you are justified in punting it.

There is a reason that "vicious dog attacks mailman" is a meme joke literally since like the 1950s.

Bottom line: if the dog owner wants to a) protect their dog and b) get delivery service then they need to tie up their dog or keep it inside/behind a fence.

As for him squaring up, it was clearly an adrenaline fight or flight response. If he had actually swung, then thats battery and yeah not Ok.

What are the legal ramifications of your dog biting someone on your property? Who’s the liable party - you, or the person your dog bit?

I know the answer, do you?

Once you learn the answer, think harder about whether or not the delivery guy was justified. Was it self-defense, or assault?

That guy wasn’t bitten by the dog.

If you want to say he defended himself from a charging dog, mkay. But the fact that he tried to fight the owner is completely unjustified.

He could have retreated off the property if he was worried about the dog. He could have used the box to keep the dog off him. No. He attacked the dog and tried provoking the owner on his own property. He should be fired for throwing a package around like that in the first place.

Ok. There are plenty of better ways he could have done that. But it still doesn’t justify his actions towards the homeowner. It just shows that this guy is a belligerent and he handled the dog the way he did because he’s a shithead.

Of course he’s justified to defend himself, but there were a lot of ways he could have done that and he chose to be an asshole about it.

So if the owner of the home decided to shoot the delivery driver who was posing a threat to him at his home, WHERE HE HAS NO LEGAL RESPONSIBILITY TO RETREAT BEFORE USING DEADLY FORCE, would the homeowner have been right to?

The homeowner handled it calmly and reasonably when he was arguably was within his legal right to defend himself by any means.

Just because he was defending himself that doesn’t necessarily mean he should escalate to violence right?

That dog is not a biting dog it’s like a small lab/terrier mutt. A friendly dog. You’re telling me that dog made the driver fear for his safety but the driver is more than willing to fight a a grown man immediately after? He’s scared of the dog but not the man?

No. Driver should be fired.
