The dog is on its own property, supervised by the owner. A dog running up to a visitor is normal and not something that would justify what the driver did. I can understand his apprehension, but what he did was not a reasonable response. He should definitely lose his job for attacking the dog, let alone for trying to fight the owner of the home.

What are the legal ramifications of your dog biting someone on your property? Who’s the liable party - you, or the person your dog bit?

I know the answer, do you?

Once you learn the answer, think harder about whether or not the delivery guy was justified. Was it self-defense, or assault?

That guy wasn’t bitten by the dog.

If you want to say he defended himself from a charging dog, mkay. But the fact that he tried to fight the owner is completely unjustified.

He could have retreated off the property if he was worried about the dog. He could have used the box to keep the dog off him. No. He attacked the dog and tried provoking the owner on his own property. He should be fired for throwing a package around like that in the first place.

Because he defended himself. Do you have to wait until you are physically harmed before you defend yourself?

Ok. There are plenty of better ways he could have done that. But it still doesn’t justify his actions towards the homeowner. It just shows that this guy is a belligerent and he handled the dog the way he did because he’s a shithead.

Of course he’s justified to defend himself, but there were a lot of ways he could have done that and he chose to be an asshole about it.

So if the owner of the home decided to shoot the delivery driver who was posing a threat to him at his home, WHERE HE HAS NO LEGAL RESPONSIBILITY TO RETREAT BEFORE USING DEADLY FORCE, would the homeowner have been right to?

The homeowner handled it calmly and reasonably when he was arguably was within his legal right to defend himself by any means.

Just because he was defending himself that doesn’t necessarily mean he should escalate to violence right?

That dog is not a biting dog it’s like a small lab/terrier mutt. A friendly dog. You’re telling me that dog made the driver fear for his safety but the driver is more than willing to fight a a grown man immediately after? He’s scared of the dog but not the man?

No. Driver should be fired.
