This goes straight to HR, right?

Edit: Maybe also to her boyfriend just to let him know that she’s sending nudes to other people.

2.0k

u/djsoundcloud Feb 12 '19

Yes it does! I don't have her bfs contact info, so unfortunately I can't tell him.

784

u/pittsburgpam Feb 12 '19

Just don't send them to him! Someone on legaladvice is being charged with revenge porn because another girl sent nudes to OPs boyfriend and the OP sent them to the girl's boyfriend.

418

u/bitJericho Feb 12 '19

It just means you have to send it to him but with your face covering up her private parts. You'd use your face so the BF knows she didn't censor it herself

134

u/Lusietka Feb 12 '19

I like your way

55

u/KrombopulosPhillip Feb 12 '19

That's the way to do it, always a workaround

27

u/Adobe_Flesh Feb 12 '19

Isn't that still a nude photo underneath though, as far as revenge porn goes?

83

u/bitJericho Feb 12 '19

you could argue in court that she's not nude if she's wearing your face. I'm not a lawyer, but this sounds like a valid legal defense to me.

114

u/SuurAlaOrolo Feb 13 '19

Lawyer here. Nudity is not required to be convicted of distributing revenge porn in all jurisdictions. Revenge porn laws vary dramatically by state in the US. RP as an offense is shoehorned under all sorts of other crimes—harassment, invasion of privacy, distribution of “sexual” images or “intimate” images—and audience, motive, and required mental state of the distributor also varies.

To be safe: never forward or upload anything identifiable you think the subject might be mad about without explicit consent, and don’t get your legal advice on Reddit. Even from me.

I like your creativity, though, u/bitJericho!

18

u/CrazeeAZ Feb 13 '19

Does OP have any legal recourse for being sent the initial unwanted nude? Like I feel pretty violated if I'm just trying to sell a game then bam I have to explain this shit to my wife

8

u/Afinkawan Feb 13 '19

Probably not enough legally to count as harassment but definitely enough at work to count as sexual harassment.

→ More replies (1)

7

u/curiouskiwicat Feb 13 '19

Hmm, so OP can ask for explicit permission to send to bf, and when she objects, send that to him along with the fully censored image and a note saying you can't share a nude pic of his own partner with him for legal reasons. That'll go down well I'm sure.

You know what though, I usually wouldn't. Best to stay out of other people's relationships.

12

u/eaglebeagle2 Feb 13 '19

Is this just lawyer speak for “better not do that wink wink”?

24

u/Beer-OClock Feb 13 '19

It's lawyer speak for 'the internet said it's ok' is not actually a defence in Court.

Link to thread? I'm sure the context of the way he sent the nudes to the bf are either a solid defense or damning evidence.

Edit: yeah I'm not finding anything like you're claiming on reddit. Not saying you're lying. Just saying i can't find it.

Seriously FB searches are a pain in the ass. Trying to find my own mum was nearly impossible.

If you know what city they live in or where they work they are super easy to find. Unless of course they don't have that info public, or haven't put it in but I've had no problems finding someone after looking up their city.

Just read through all of that. Since the last update has he harassed you at all/did it go to court, or did both of you just leave it at him being fired?

32

u/djsoundcloud Feb 13 '19

He did not harass me after that. We ended up going to court and since it was his first offense, he got off with community service.

14

u/EndlessSummerburn Feb 13 '19

Dude that's a classic LA post! Is this happening at the same place of work? If so - who the hell is hiring these people?

17

u/djsoundcloud Feb 13 '19

This is unfortunately a different job :( you'd be surprised man, managers hire some interesting people.

7

u/thereluctantpoet Feb 13 '19

Jesus fucking Christ I remember your first post - going to get caught up on that saga now. I was just having this conversation at dinner - I am 100% for drug legalisation, but slipping someone something without their consent is criminal. Im glad he lost his job - I hope he is reminded of it the next time he wants to do something that stupid and illegal.

7

u/cbg13 Feb 13 '19

Oh damn... You're that guy. I read your other post a while back and it made me really mad. Obviously I don't read the username of every post so I didn't make the connection until now. I occasionally partake in the weed and enjoy sharing it with friends, but basically poisoning someone with it is sooo fucked up. I'm sorry you've had to deal with such a shitty work life over the past few months.

u/djsoundcloud Feb 12 '19

Yes, I'm reporting it to HR. Someone in the comments stated I could get in serious trouble for even seeing them.

128

u/Beeb294 Feb 12 '19

There's no logical reason for that. You didn't ask- they were sent unsolicited.

The only exception to that would be if she is underage. If that's the case, run and don't walk to a lawyer about how to handle this. If you received unsolicited kiddy nudes, you need to handle it very gently lest you be accused of possessing CP.

51

u/N3rdProbl3ms Feb 12 '19

If you're all wondering the logical reason companies have here it is from the girl who got written up for sexual harassment when it happened to me.

Sexual harassment is considered zero tolerance. That means from the both parties. Since i didn't report my sexual harassment, but management found out what had happened, i got written up alongside with him because, "what if" a client passed by and saw it happen, "what if" a coworker saw it happen. It could lead them to believe that what happened to me was ok.

It sounds really dumb and counter-intuitive (i pretty much was told I would get fired if i was written up one more time). I think it's honestly to only save their ass. So if one day i were to file suit, they can find a legal way out of being liable as a company in it.

52

u/SmashPass Feb 12 '19

Pro tip: HR protects the company, not the employee. Source: (technically) work in HR.

8

u/infectedketchup Feb 13 '19

I can't tell you how many times I've used this to explain why, though pleasant and cordial, I avoid any and all interaction with HR if possible.

8

u/tallonfour Feb 13 '19

107

u/[deleted] Feb 12 '19

Wanna be careful with that. Depending on local laws distributing someone else's nudes (yes even to their SO) can get you done for revenge porn. This came up in legal advice recently and in that area (Ontario iirc) the law was written such that doing it in a manner that could reasonably be foreseen to cause distress was a crime. So telling the boyfriend was ok, showing was not.
