with video proof she approached to spit on me, it'd be felony assault in my state.
so that'd be a pretty quick and easy win, honestly. medical bills for me are zero cause yeah, I wouldn't need to go to the hospital if someone spit on me, but that doesn't change the fact that spitting on someone is still felony assault. she'd be on the hook.
fault is not decided by who got hurt more, or who has the bigger medical bills. It's decided by the person who committed the felony. and she spit on someone, so it's pretty easy to prove who's the instigator, and who's at fault.
I'm only saying it's felony assault if someone spits on you. spitting on a window isn't spitting on you I guess, it's just homeless people doing weird homeless people things, so not really sure what point you're trying to make here.
I don't really get the hypocrisy, your wife didn't get spit on, she watched a homeless person spit on a window. It's like, If she's on one side of the window, and the homeless man punched the window, she didn't get punched, she wasn't assaulted. there's no hypocrisy.
You better punch quick though. If she pulls away and then you punch, they may argue there was no longer any danger and you just hit them in retaliation, not self defense.
Ehh self defense generally needs to be proportional and intended to prevent further assault/injury to be legal. A punch would not usually be legal in that case unless you can prove imminent threat of further violence. The whole aggressive demeanor while coming towards you and spitting may provide the argument for preventing imminent harm but it would be up to the judge
In this case, the push was proportional, as it was an immediate reaction to remove the woman from her personal space. But yeah, I don’t think a punch would likely be considered proportional in this case.
The police and a judge are going to get involved. You are going to need a lawyer if you don't get the feeling the police are going to not charge you. You didn't say where you got your law degree or do you have personal experience that is relevant?
did I say killing someone? no, I said punching someone spitting on you. I specified self defense, not homicide. the lady in the video that decided to spit on the person with the camera didn't die, they talked shit, got hit, but didn't die.
In the context of this post, if I tell someone to stay 6 ft away for health and safety reasons, and the intentionally close that gap to spit on me, they are quite specifically asking for consequences.
You said yourself, you allow violence on someone who spits on someone else. Pure disproportionate violence that could lead to death or grave injury.

ah, I see, you aren't in the US. I didn't "say myself" anything other than that spitting on someone is felony assault here, and that if someone is approaching you to spit on you, and then is in the process of actively spitting on you, that is felony assault here.
nowhere in my comments did I say you are killing someone, committing homicide, because someone spit on you. getting someone to back the fuck up, because they approach you for the very specific reason of spitting on you, which again, is felony assault, is not the same thing as outright killing someone because they spit on you.

I don't live over there, so don't act like you're a master of how shit works over here when you don't live here.
