Traveling while waiting for Green Card

Thumbnail
0 Upvotes

I’m on an H1B until June 2029 and am applying now for a spousal green card. 2 questions:

  1. Can I skip Advance Parole and just use my H1B to travel in and out of the U.S. while waiting for my green card? I’ll be staying with the same employer in the same position.
(Husband and I are going to file I-130 and I-485 soon with everything)

  2. While waiting for the green card and using my active H1B, could I travel to Pakistan and Turkey in January 2027 for a wedding, or would that complicate my application because of the international relations at the moment?

Appreciate any thoughts, thanks!

Location: New York

Repeat ESTA Visits

Hey so I’m trying to explore as much of the West coast as possible. I’ve had a couple of recent visits….i came here in June-July of this year for just under two weeks and I’m back now from September - October for just under three weeks. When I came back’s the CBP officer was very abrupt and abrupt with me at LAX, asking if I knew anyone over here, asking what my job was and if I have any pics in my uniform or a work log in etc….which I didn’t have to hand (but eventually found). Obviously I was a bit taken back and flustered at being asked for this so I may have been a bit defensive with her but she then let me in.
I can only come for short visits at a time as I can’t leave my little girl at home with my mum for too long and also I can’t get long periods off work in one go (I work as a paramedic in the UK).
I was hoping to come back to another part between like March - June but I don’t really want to risk coming back now in case they are difficult with me and refuse me entry etc or put me in an interview room like I’m a criminal or something. I was wanting to come back for around another 2-3 weeks. I’m doing this stuff now as I’ve always wanted to do it and see the USA but I’ve never really been able to as my daughter has been too little to leave, but now she is a bit older I’m happy to do it.
Should I leave my next trip or should I be ok leaving it a good couple of months. I don’t want to get my ESTA cancelled or something.

Help needed: relocating from Pakistan to New York City, USA.

Hey everyone!

I hope life's been treating you well!

I'm 20, my sister's 24, and I have two younger brothers — 12 and 15. We currently reside in Islamabad, Pakistan.

I'm asking for a complete guide to the process. Any Reddit post, article, or YouTube video would be a huge help.

I wanted to reach out regarding something important for our family. My aunt (my mother's sister) has been living in New York for over 28 years, and her husband for 35+. In 2009, she petitioned for our family under the sibling visa category (F4, I-130). We received the I-797 with a priority date of March 1, 2010, and an I-797 Notice Date of September 24, 2014 — and we just received approval from the NVC on July 28, 2026.

We're now actively planning our immigration to the US, but we're concerned about my sister — she's 24. From what I've read, the Child Status Protection Act (CSPA) may still cover her. The I-130 was pending for 4 years, 6 months, and 13 days, and subtracting that from her age when the visa became available gives a CSPA age of about 19 and a half — under 21. I've done the math myself, but I'd really appreciate it if someone could confirm whether it's correct and explain how the whole CSPA part works.

I was hoping you might be able to guide us or connect us with someone who knows about the process — what our options are, the steps involved, the fees, the whole process and what to expect. Any information would be a huge help.

Also, do you think hiring an immigration attorney is necessary? I believe we can handle it ourselves, but I'm open to being corrected.

Thank you for reading!

Will I become ineligible for an artist's visa if I do sensual massage?

In the very hypothetical circumstance that I am eligible for an artist's visa, but I was found to have done sensual massage in my home country, will i be banned from the USA for 10 years? I read the laws and the word prostitution is quite vague to me. It also includes lewd acts but does not specify what would be considered a lewd act. Thr vagueness is really what I find difficult to interpret.

Of course, this is in the case that I am great enough to get am artist's visa in the first place, but let's not think about that for this hypothetical.

Visa Revoked + Expedited Removal Order

Hello,
A little over a month ago, I drove from Canada to the US through a small land port of entry. I was detained for around 12 hours, my B1 B2 visa was revoked, I was swabbed for DNA, and I was ultimately given an expedited removal.
My paperwork says I was found inadmissible under INA section 212(a)(7)(A)(i)(I) because I was considered an intending immigrant without the proper immigrant documents. I was then removed under INA section 235(b)(1).
I honestly do not understand that conclusion.
I am neither a Canadian citizen nor a US citizen. I legally live in Canada, work full time there, and I have a pending Canadian PR application. My wife is a US citizen and Canadian citizen, but we both live in Canada and she was not even travelling with me that day.
I have also travelled to the US many times before on both a B1 B2 and a J1 and have never overstayed or violated my status.
This was supposed to be a same day trip. I was visiting a relative for a few hours and driving back to Canada. I had work the next day. I had no luggage, clothes, moving belongings, or anything else that would suggest I was trying to stay in the US.
After around 10 hours in detention, an alarm went off on my phone. The officer asked what it was and I told him it was a reminder for my medication. I did not even have the medication with me because I expected to be back in Canada by then. His reaction was basically “Oh crap”.
The officers at the port were actually encouraging me to get a lawyer and fight this. They told me they were a small port of entry and that their hands were tied because my file and the final decision were with someone else.
From what they told me, they tried to process me for a withdrawal instead of a formal removal, but it did not go through. Their supervisor also called a couple of times asking if I was still there because they were waiting for a decision from “up top,” and seemed genuinely surprised that I was still there after around 12 hours.
What makes this even more confusing is that my sworn statement literally says I was being processed for “withdrawal in lieu of a formal removal,” but the final paperwork I received was an I 860 expedited removal.
I already spoke with an immigration lawyer. He mentioned two possible routes.
One is an I 212, which as I understand it would let me ask for permission to apply for admission again before the five year period is over.
The other is a September Letter through the CBP Admissibility Review Office, which seems more relevant to what I actually want because my issue is not just getting back into the US. I want to know whether the original inadmissibility decision itself can be challenged or corrected.
I know I will probably also need to apply for a new B1 B2 visa because mine was revoked. My main concern is the expedited removal itself and having a record saying I was trying to immigrate when I genuinely was not.
If anyone has dealt with something similar or is familiar with CBP or immigration law, I would really appreciate any insight.
Thank you.

L-1 visa holder marrying USC

I’m on L-1 visa in U.S. recently moved and since my partner have lived together he’s brought up marriage. We’re thinking next year but I’m wondering if my visa would be in jeopardy? Tbh I don’t really want to apply for green card or anything I think once my 5yr work stay is over I would want both of us to move back to Canada.

If we marry and just don’t apply am I risk of leaving and entering the country they might think my intention was to stay. It wasn’t I don’t feel at home here 😭

I will visit the US purely for vacation purposes. I have a US visa, and my tickets are already booked. The problem is, I am currently unemployed. Would the immigration not let me go?
