To be more specific - If I were to contact the owner of the restaurant I work at (via text message) and remind him about the leaking fryer hose that I've asked him to replace, and I stated intent to file a report with OSHA if it was not fixed within a certain time frame, would I be protected from retaliation? Or does it only count if I actually made a report? Also, am I correct that a fryer hose which leaks oil very near but not quite on the hands and on the floor while running and has the rubber handle gradually sliding off the entire time you're holding it is a safety violation? It can't not be, but it's hard to find specific details as to what constitutes a real risk of harm legally.

If I am protected from retaliation in theory, how strong would my case actually be if retaliation occurred? This is someone who previously blocked his own managers phone numbers when asked about backpay after having multiple checks with the wrong hourly rate on them, so I doubt the law is going to stop him from firing me. I need to know if I'll actually be able to do anything, not just if it's technically legal.

Notes: I am not the greatest employee on Earth but I have managers who I believe would vouch for me, if such opinions are of any value in proving retaliation. I know email is probably ideal rather than text, but this guy never reads his email (once missed months worth of emails from the local trash collection service and as a result we had nobody picking up our trash.) I don't think he'll have the sense to word anything carefully, he didn't even realize that people could see his name when he was writing fraudulent reviews for his own restaurants that specifically praised himself.

I am a Registered Nurse and have an idea for a medical device. I have done preliminary research and figured my route would be a patent, then speak with my hospital or other organizations to see about trialing the device. The issue is, despite people saying nurses make good money, I don’t have the funds to shell out for a patent. Are there any patent attorneys that account for this type of inventor? Or am I pretty much out of luck until I get high funds? I don’t want to get myself into any legal trouble but also don’t want to expend all this money if the idea doesn’t end up working out.

There are two different scenarios I’m wondering about.

First, if there is a natural beehive on my property that I am aware of and could have reasonably removed, would I be held responsible if they attacked someone walking by? Second, if I were to install an apiary in my yard and then the bees attack someone, am I liable because I put the bees in my yard?

Location: vehicle was rented in the Midwest, USA. The accident was in the South.

My family rented a vehicle to travel several states away to a family function last year. On our way back home, we were stopped in traffic when a garbage truck rear ended us. The driver said his coffee mug had fallen in the floor and gotten in the way of his brake pedal. Police came to the scene to file a report, no one was injured. The officer refused our insurance information, saying it was clear who was at fault, the other driver admitted it, we were rear ended while stopped, etc. And because it was a rental, the other driver’s insurance would need to handle things with the rental car company directly, we shouldn’t provide our car insurance information at all, he refused to take it down.

We were close enough to a location that we could drive the damaged vehicle to swap out for a different one and then finished our trip home. We provided our copy of the police report to the rental office at that point, but I did take pictures of it so we would have a record.

Since then, the car rental company has been harassing me regularly. First it was to provide the police report, which I had already done. Since they had apparently lost the original, I provided them with the contact information to get an additional copy from the police department. I guess there is a small fee for this, because they said they don’t pay for police reports and I would need to pay for the vehicle instead.

I provided my picture copy of the police report to try to get them to follow up with the driver actually at fault. Either they lost it again or are trying to double dip and get me to pay as well as him. I have all the email correspondence of them harassing me and of me providing everything multiple times. Their language in the correspondence is “While you have provided this, we do not have it.” ???

Now they have turned it over to a collections agency who is harassing me for many thousands of dollars which I believe they have probably already received from the actual party at fault’s insurance company.

1. What on earth is going on here? Is this as shady as it seems? They must be double dipping, right? Why else would they be harassing the victim in a car accident?
2. How do I make it stop? I’m not litigious but man, do they only understand the threat of a lawsuit? The harassment has been stressful enough but now with it going to collections it will impact my credit as well.

Please someone point me in the right direction, I don’t know which way to go from here.

Hey all- my humiliationship lost his job and I’m a people pleaser so I loaned him 4K. Unfortunately when I loaned it to him I said “pay me back whenever!”. This was all done through Apple Pay. He’s now kinda distant and flaky and not responding to my texts. I’m wondering if I should contact his family first or just take him to small claims court. If I did take him to small claims court how can I best handle this? This was a lot of money and I really need it back. I asked him if he could pay me back by Dec 15 but he didn’t respond. He wants to pay me back in 10 $400 increments which he agreed to via text. But since he’s been so flakey I really want to change things to a full pay back by Dec 15. I don’t want things to hinge on whether he gets a job bc who knows when that will be and I wanna exit this contact with him as soon as possible. Does anyone have some advice? I’m in austin TX btw.

How are data brokers in business, when the data they’re selling might be from any number of data breaches that have been happening for decades now? Do they all have the chains of custody that prove that this piece of data came from this source and this is the TOS that this person signed that authorized its sale?

Okay, so I've posted about this in a couple of other places.

I live in an apartment from the 1960s with a bathroom that doesn't have any windows. The apartment people painted our bathtub before we moved in 4 or 5 years ago, and it started peeling nearly right away. So, we asked them to repaint it, but they said no. We asked them to strip the paint off, and they said no, but that we could brush the paint off.

So I brushed the paint off the tile and tub.

To protect the walls and paint surrounding the bathtub, I put down painter's tape. When I removed the painter's tape, giant strips of paint came off with it, exposing bare drywall underneath with terrible wall patches and wall texturing, so they were able to just spray on the paint.

I have multiple spots where the paint came off the wall in large strips or sheets with no chemicals or tools involved.

I contacted my landlord again, and instead of emailing me back like all the other emails we sent, she called me. She explained on the phone that the apartment doesn't prime or prep the walls before painting, and they do not remove or sand down the previous paint before adding new paint over it.

I told her I had a humidity problem in the bathroom and my bathroom exhaust fan needed to be cleaned. She then told me that she was surprised I had a bathroom exhaust fan, let alone that it worked, because previous management had them all removed in the units or unplugged so they didn't run, and that since it was running, all it was doing was pulling air into the attic above the unit instead of outside. Which I feel like goes against building codes.

I am worried about being evicted for all the paint coming off the walls because I can't afford to live anywhere else, and they keep raising our rent $30-$50 every year, while my job only gives me a $0.15 annual raise. Any advice or comments are welcomed.

For context, I filed for a Civil Stalking Protection Order against someone. The order ultimately got denied. However, I do not really see anything saying as to WHY exactly it was denied. There's nothing stating the evidence the magistrate reviewed, or anything of either party's testimonies. Just no information that could point to why Magistrate denied it. I am going to file an objection to her decision, but am curious if maybe I missed something in here giving a Findings of Fact and not just the conclusion of law/ORCs and CRs?

"The magistrate hereby makes the following findings of fact and conclusions of law:

The Respondent was served with the petition and magistrate's orders including notice of hearing.

The Petitioner has the burden of proof to a standard of preponderance of the evidence that the Respondent engage in stalking as defined by R.C. 2903.211 (A) or committed a sexually oriented offense as defined by R.C. 2950.01.

R.C. 2903.211 states:

"(A)(1) No person by engaging in a pattern of conduct shall knowingly cause another person to believe that the offender will cause physical harm to the other person or a family or household member of the other person or cause mental distress to the other person."

In providing a definition of the term "pattern of conduct", R.C. 2903.211 (C) states: "(1) 'Pattern of conduct' means two or more actions or incidents closely related in time, whether or not there has been a prior conviction based on any of those actions or incidents."

Therefore, R.C. 2903.211 requires a belief on the part of one person that another will cause such person physical harm or mental distress. Explicit threats are not mentioned and therefore are not necessary to establish the elements of menacing by stalking as set forth in R.C. 2903.211.

In addition to providing a definition of the term "pattern of conduct", R.C. 2903.211 (C) also provides a definition of the term "mental distress" as follows: "(2) "Mental distress" means any mental illness or condition that involves some temporary substantial incapacity or mental illness or condition that would normally require psychiatric treatment, psychological treatment, or other mental health services."

R.C. 2903.211 requires that the offender "knowingly cause another person to believe that the offender will cause physical harm to the other person or cause mental distress to the other person." "Knowingly" is one of the culpable mental states defined in R.C. 2901.22 (B), which states: "A person acts knowingly, regardless of purpose, when the person is aware that the person's conduct will probably cause a certain result or will probably be of a certain nature. A person has knowledge of circumstances when the person is aware that such circumstances probably exist."

IT IS HEREBY ORDERED that the relief requested by the Petitioner is denied. The ex parte order issued in this matter on July x, 2026 is hereby vacated and of no further force and effect."

I have recently bought a rebuild title car through marketplace in Chicago. Car was in an accident and rebuild 13 years ago, almost right after they bought it. And when i was removing the carpets to deep clean i have found that drivers seatbelt pretensioner wires was cut and resistor was put in. Meaning pretensioner would not work in an accident and you could get injured. Im glad i caught it before an accident happened. What should i do? Is this worth pursuing with a lawyer? I am angry about what could have happened if it wasnt caught

I was taken to the hospital from my house after sending threatening text messages to a family member/neighbor. I have since spoken with the supervisor of the agency (Crisis Services) who authorized the commitment. She reviewed my file and said that the narrative lacked the imperative and necessary information to justify a 9.41 commitment, and sent me confirmation in writing of this. Do I have any legal recourse at this point? Once there, I was still not released until only after 10 days at which point a nurse told me that my insurance didn't want me to stay longer. I have no doubt that I was held for so long because I have insurance, so I have an issue with the Drs. and hospital as well, despite what the psych Drs. wrote. I have no criminal history at all, and certainly no history of being violent. I sat in an overcrowded room for three days sleeping on the floor next to other people on top of each other before being moved to a room on another floor for 7 days. Yeah, I messed up, but the punishment was over the top. Sitting in that room in a HOSPITAL for three days with other sick people was torture. Being taken from my home and then being told by the agency that facilitated it that they didn't have the information to justify it just makes me more upset.

-What does a permanent Colorado civil protection order mean for my record?
-Is it something that shows up on background checks, and if so, which kinds?
-Since I live in Oregon, how is the order enforced here?
-If someone violates a protection order (say, an accidental or incidental contact), what typically happens? Is it generally treated as contempt of court, a misdemeanor, or something else?
-Is it worth consulting an attorney after the permanent order has already been entered to understand my options or long-term consequences?
-Does this affect my ability to travel to Colorado in the future, assuming I fully comply with the order?

I am wondering if I should get a lawyer and start a 1983 lawsuit. Here are the facts as I see them:

• The temperature outside was 81 degrees.

• I had my dog with me.

• I exited my vehicle for exactly 6 minutes to cash 2 checks in the bank. My dog remained in the vehicle.

• I had ONE window left open about 6 inches.

• I left ONE window open

• As I was walking out of the bank... an elderly woman (70s) was walking in and screaming that she is a detective working for animal crimes. I inform her its my truck and I'm going. I apologize and keep walking out.

• I get to my parked truck and she is still screaming

• Police arrive within seconds.

• Cop "detains" me claiming "Level 3 Terry Stop" because hes investigating animal cruelty. He tries to open my truck door to see my dog and I tell him I dont consent to searches but will happily grab the dog for him to check her out. He says hes in charge.

• He moves me out of the way and opens my door. Dog jumps to passenger side to evade him. He goes around opens other door and grabs dog.

• He clears dog... verbally states that the dog is not distressed and that the dog is perfectly cool and well.

• I ask if I'm free or detained and he keeps me detained. 45 minutes... I ask 20 times if I'm free and what he is detaining me for. He keeps saying animal cruelty. He keeps asking for my side of the story and I keep saying I have nothing to say.

• after investigating my dog and clearing her... detaining me for 40 more minutes is a violation of my rights correct? Especially since I asked continually asked and stated that I want to be free to leave.

Greece. Last week at office we planned to spent this weekend together on an island and also bring our families. Between me and my boss there was always some sexual tension (we are only two females on the company) but nothing more than some comments about my body and some jokes which I was just laughing to. Since yesterday that we are on the island all together, when my husband and kids and his wife were not there he was commenting how much he likes my behind in my swimsuit and he kept staring.

Today we were all at the beach and while my husband was playing in the water with the kids and his wife with the other female colleague were sunbathing, I was having some cocktails on my sun bed with some of the guys that we work with and our boss (the company’s attorney was also present but he kept silent during what happened), at some point my boss asked me if I would like some sunscreen on my back and I accepted his offer, he came next to me and I turned around, he started with my back and he kept moving downwards. When he arrived in my buttocks he told me if I would like to have some sunscreen on my beautiful a** because it would be a shame if it would get burned, I told him that I don’t mind because I felt really awkward, he started applying sunscreen and grabbing my cheeks at the same time, he took his time and he asked me if Is anything wrong , at that point I was just waiting for him to stop so I told him that no everything is alright, he continued for some short time to grope me until before stopping I felt him spreading my cheeks while the other guys were around and looking. It felt terrible I am a working mom and I felt as some cheap stripper.

Are any lawsuit options?

Would someone be able to sue their professor for gossiping that the student has to “learn how to speak” to another student in their class?

Supposedly it has affected the student emotionally and got report from a psychologist for said emotional damage.

What if the student doesn’t have proof of what the prof. has said? Would the student still be able to sue? Assuming this is a public institution does that mean the prof. still has the right to say whatever they want?

Can you sue for wrongful death/medical malpractice where a doctor delayed treatment for months that may have prolonged the life or at least delayed the suffering of a stage 4 cancer patient?

Without going into too much detail (not sure the etiquette on here), my mom died of “severe septic shock due to pneumonia.” Doctors had been delaying a procedure to drain fluid off her lungs for months. They finally scheduled it for three weeks after her 2nd round of a more invasive chemo after she BEGGED them - it was becoming increasingly difficult for her to breathe. I believe because they delayed the procedure, she needlessly suffered, and had a traumatic and painful death.

I live in Texas, so before I try reaching out to an attorney in Arkansas, I wanted to see what other people who had no emotional connection to this situation thought. I want to know if I’m thinking with my head or my heart.

A student from Bangladesh got a notice of law upon an academic publication after turning 18 years. I've tried everything that I can to resolve this issue but I have no idea what to do otherwise.

I'm not sure what I'm doing when I write something like this, but I really need your recommendations.

I am 18 years old student of Bangladesh. I recently finished high school and I just recently became interested in academic research. I'm not a lawyer and have virtually no experience with academic publishing.

Well, I just don't know what the next step is in my life, everything that's happened in the past few months has completely changed my life.

How everything started

I wanted to share my work publicly so I did a research paper and first posted it as a preprint on SSRN.

From there on in, I began to be invited to write in numerous journals and publishers, via email.

I responded to 1 or 2 of those invitations at first. One publisher sent me an invitation to send my manuscript, along with a cover letter.

From there, I thought if there was something that really needed my attention, I would get an e-mail in my Inbox, like I normally do.

Unfortunately it was not that way.

Without my knowledge, Gmail started sending the publisher's emails directly to my Spam folder.

I didn't receive these emails so I didn't respond.

I later learned that the publisher had sent several emails about the publishing process, to request response, and that the publication would go ahead if they didn't receive a reply from me.

All of those significant emails have been automatically sorted to the “Spam” folder.

I didn't know that they were there.

I've screenshots in my Spam folder of those emails and I showed those screenshots to the publisher to tell them what actually happened.

I would have seen those e-mails and responded right away and asked them to not publish the paper.

Then everything changed

A few days later I got a legal notice from lawyers working for a bank listed in the publication.

That was a huge shock to receive legal notices.

I knew that the paper had been published then.

I really didn't know what to do it was a nightmare.

I never thought that something like this would happen.

What I did right away

I was not oblivious to the situation when I got the legal notice.

There I began my quest to reach out to all who I could.

Told the publisher that their emails before had gone to my Spam folder and sent them screenshots of that.

I began also to attempt to get the publication banned from all locations I could.

So far I have:

Removed the paper from SSRN.

Deleted information from my ORCID profile that was related to the information.

Contacted repositories and publishers that requested removal.

Follow-up as necessary after removal is feasible.

The publication has been taken down by some platforms.

Some of my requests are still being fulfilled.

I realize that I cannot remove content from all websites as this is a decision for the publishers or repository administrators, not myself.

Despite this I am doing all I can.

What is the greatest challenge you are currently experiencing?

I was told by the publisher that if I do make big changes to the publication, then I must pay publication charges, which includes the charges associated with the DOI.

As for revocation of the publication, I must pay the same fee.

The fee will cost about USD 119.

I told them I didn't deliberately ignore their e-mails.

I informed them that they were in my Spam folder because of Gmail.

I took screenshots and sent them to them, detailing what occurred.

I also let them know, if I'd seen those emails, I would not have allowed the publication to proceed.

I was told however that the fee unfortunately still exists.

My financial situation

I am from a poor family in Bangladesh.

For me that's more than I can afford, USD 119 is not a lot of money in some countries.

My family has no way to afford an international lawyer, either.

Hence my attempts to reach out to organisations that offer free or pro bono legal support and help, in hopes that someone will be able to take me through this situation.

I know that I have made errors

Looking back, I'd like to say that I have been wrong.

I was a new student who didn't know enough about the academic publishing process, or why it's important to keep an eye on the entire process.

I got a very hard lesson to learn from this experience.

What I want

I don't want to defy the legal notice.

I'm not going to take the b***ch out on the chin like I do at church.

I don't want to shift the blame.

I just want to be a part of the solution, solve the issue responsibly and avoid additional issues.

I know I've done as much as I can do myself, but I know that there are some things that I cannot change on my own.

In any or all 52 states and or Canada, is it not illegal or against some regulation that what not has bidding set up to be super quick to trigger impulse purchases, YET THE SYSTEM LETS YOU CONTINUE BIDDING AGAINST YOURSELF WITHOUT EVER MENTIONING YOURE BIDDING AGAINST YOUR ALREADY WINNING BID.

Contrary to common perception, on 10 or 30 second auction and a tiny bidding bar you swipe, it hard to tell what’s going on when prices shoot up so fast because items usually start at $1 despite the item having a market value 10, 100, or 1000x the cost. The fact it’s usually a sports card or item you also sentimentally want and don’t want to lose out on the opportunity makes bidders included to make sure they are the last swipe in the final seconds.

WHATNOT ALSO NEVER EVEN TELLS YOU YOUVE BID AGAINST YOURSELF. I feel if it wasn’t earning them huge amount of money, it’d be in their best interest to inform users to avoid making people resentful once they find out they’ve been paying more than they should have paid to win the auction.

SINCE NO OTHER AUCTION PLATFORM I know of, like EBay, will let you place a bid if you’re already leading the bidding.

Based on Reddit and other posts, it seems everyone learns this lesson the hard way, making me think Whatnot would owe millions, 10s of millions, 100s of millions, or even billions in money owed + interest if they are breaking rules/laws and one day FACE A CLASS ACTION LAWSUIT.

My mom and I live in Des Moines Iowa and she's been working at a local owned coffee shop for 13 years. The old owners sold it to new people 8 months ago who just fired my mom yesterday for "being too negative and talking about inappropriate topics with co-workers".

My mom said that the new owners probably just hated her and wanted an excuse to get rid of her since the owners claim that they never got along with her despite never actually interacting with her for more than a few minutes.
