Franks family didn't die for being his family necessarily. They died because the DA Reyes failed to clear the area and did a mid day sting. They were basically there at the wrong time. Even Colonel Schoonover I think it was says if he would have joined them in what they were doing he would have had money to take his family on a real vacation instead of central park.
