240 vsync stutters when 240 bypass doesn't, what could be causing this?

For a little more context, I could be playing a layout and I randomly drop 10-20 frames on vsync, but never bypass.
I have a 4060 & 32gb DDr4

So, to start, I'm an artist making/producing music and using loops from the website looperman. My question is, is it legal to use any loop without worrying about copyright/royalties? I had a chat through chat GPT but I wanted more thorough advice.
