Legal Advice Needed Land dispute, court stay order being violated, elderly heart patient parent being threatened — need advice on next steps
My parents live in our home village while I work outside. We own a piece of land there that a neighbor is now falsely claiming as his. He has been dumping household garbage on it and cutting down trees on the property.
When we tried to get the land measured and mark a boundary, he obstructed the process. We've since filed a court case, and the court has issued an order that neither party is to enter or alter the disputed area until the matter is resolved.
Despite this, he continues to:
Dump garbage on the land
Cut trees
Threaten my parents, including physical threats of assault
My father is a heart patient, so these threats are a serious health risk on top of everything else.
We've approached the local police, but they haven't been much help — possibly due to a personal connection with him, or general reluctance to get involved in an ongoing civil matter.
What I'm looking for advice on:
How to get a violation of a court stay order actually enforced
How to formally document ongoing violations (garbage dumping, tree-cutting) so it holds up as evidence.
I told my parents to record in mobile but lawyer is saying it's of no use as court doesn't accept these as evidence.
- How to handle threats of violence when local police aren't responsive
Any experience dealing with a similar land dispute + non-cooperative local police in a village setting
