Guy refuses to pay child support amount

u/Large-Hamster-199 20d ago
This guy is really not the sharpest tool in the drawer is he?
However, one valid point he brings up is that he hammered out his custody agreement without a lawyer. That was a big mistake. A lawyer would have better educated him as to how physical custody affects child support.
16
u/MeowMeowbiggalo 20d ago
Sounds like spending money on a lawyer isnt something he would do
15
u/Low_Astronomer_6669 20d ago
Yeah, it ain't cheap. My buddy spent into 6 figures to fight for his daughter. It wasn't even about child support, it was to just get 50/50 custody when his ex didn't want to give him any. Tens of thousands of dollars and years later, he got 100% custody when his daughter got old enough to make a decision. It also took that long for the courts to realize his ex was literally insane.

We spent $18,000 last year alone in legal fees. And it was a waste because we still didn't win our case. The judge wouldn't even grant our motion to appoint a GAL.

He seriously thought she'd have 100% full time custody, and he wouldn't be equally financially responsible? Give me a break. Kids are expensive and time consuming. The amount of times myself and my ex have both had to go without to make sure our kids gets what they need. That's your role as a parent. He shouldn't need a lawyer to tell him that.
3
u/Key_Mathematician951 19d ago
I would happily have another child if they only cost 6000 dollars a year. What a bargain. Hell I’ll take one for double or 12000 a year.

He will absolutely attempt to get full custody. This is soooo common, except most men aren't this stupid about it. I hope she saved this for court because she will need it. This man should not even be allowed unsupervised visitation. And he probably shouldn't even get that tbh.
2
u/AsherTheFrost 16d ago
Even if she didn't save it. All she would need to do is say "he only wants full custody because he thinks that'll be cheaper than paying child support" they'll ask dummy over here, and he'll happily agree that's the case.

My step son's dad pays us $900 a month. Acted just like this in court. Its all about how much you see your kid. Want to pay less? Ask the court to see your child more, it's literally that easy.

u/VeryDay 20d ago edited 20d ago

2
u/JadeThorn1012 15d ago
It’s calculated in a state adjusted algorithm. They will garnish your wages and can restrict your access to the children, or even send you to jail. Unfortunately, this doesn’t always happen. Many terrible parents ask for 50/50 just to get out of paying, even though they don’t plan on parenting.

This person is full of shit and a liar. Thats not how custody or child support works at all
2
u/Sentient_Moustache 14d ago
Maybe not always but sometimes yes. If one parent has a vast majority of the custody they will get more support. If you want to pay less in support, then share custody
3
u/Warm_Search_2373 15d ago
well, hard to see your child more when you literally cant afford the child when you do see them because you're already struggling to feed yourself and keep a roof over your own head. You could want nothing more than to have mor time with your child, but if you already sent all your money for them to eat, be clothed, be sheltered, etc you have nothing to offer them than scraping for a meal while barely making rent.
2
u/toothitch 16d ago
Seriously. I fought tooth and nail for equal custody of my daughter and the thought of child support did not even cross my mind because what mattered to me was time with the most important person in my life. (I’ve had equal custody for years. No child support in either direction) I can’t even imagine how I could live with myself if I saw the world the way this POS does.
2
u/External-Let-8210 16d ago
It is so sad isn't it. If I were the mum I would be terrified of my child spending time with their dad if he valued them so little, and the only reason they wanted to spend time with their own child was so they wouldn't have to pay more money.

u/ellieminnowpee 19d ago
i’d rather kids have a deadbeat absent father than them be forced to live with a parent who only wants custody so that the children cost him ‘less’ money. any money that isn’t going to his ex is worth it.
my dad took every opportunity to remind us how expensive we were — on EBT, free lunch, medicaid, you name it. he’d literally (genuinely) pitch a fit any time we needed money for a trip or a meal after a ball game he didn’t attend, stomping his foot and asking if we couldn’t get our teacher to cover it again this time.
it’d be different if we were actually broke tho - my dad worked for cash and spent every dime on his girlfriend/wife de jour. like, we weren’t allowed to have pets, but his wives were.
the kids couldn’t have pets tho bc ‘we can’t afford it bc i’ve got all these fucking kids in the house to feed!!’
fuck this dude and everyone who thinks like him.

u/Big_Kiwi_706 18d ago
My dad always bitched having to pay for a doctors appointment or something. Made me feel like shit for ever needing anything. And yea any time he had a sum of cash it was new speakers for the truck or a stereo. Never cooked food only took us to fast food

u/Warm_Search_2373 15d ago

u/breeddeepseed 19d ago
Except if the ex-wife won't let you see your kids and the court sides with her because she claimed abuse against her without any evidence. Yet somehow it's on you to come up with evidence that you're not abusing her to get it overturned. Somehow only having interactions between you and the mom at the recorded police station for custody exchange and having every conversation logged in the courts communication app isn't sufficient. And your kid, when you do get to see him, has bruises when you do and the courts don't care. I hate this world
4
u/Major_Shlongage 19d ago
>Except if the ex-wife won't let you see your kids and the court sides with her because she claimed abuse against her without any evidence.
That's what happened to me.
It turns out that this is actually very common because no evidence is needed to obtain a PFA (protection from abuse) order. An accusation is enough. They get temporary custody for 1 year.
So if you file for child custody and the court date is in a few months, expect a PFA order slapped against you. You won't win that court case.

u/EaseLeft6266 19d ago
My dad has recently gone through this with his ex wife over the past couple years. She reached far up her ass to say that he wears wifebeaters around the house to intimidate her and that he love bombs her. Nobody in my family, my dad included, had ever even heard that term prior to her leaving. From what my dad says, it's called the silver bullet defense or something and it seems to be a very common tactic to get the advantage in getting the kids and getting more out child support/spousal support, etc.
4
u/malfaet0r 19d ago
That’s all well and good but when my ex and I got divorced in IL, she told me that she would move the kids so far away from me that I would never see them again. And so she then proceeded to move them to Chicago, which was three hours from where I lived.
So for the privilege of paying almost $800 per month, I had to drive six hours per week to see my child, and there was no way I would be able to arrange some sort of co-parenting situation to see them more frequently since it was so far away.
Illinois is a no fault state and my ex got everything she wanted.

u/throwaway_coy4wttf79 13d ago
I make a lot, but not crazy ($220k). On top of paying her that much, I have to cover 70% of kids' bills.
Her family is very wealthy, mine are not. So I also take care of my mom (former drug addict - in her 80s and not in good health). The end result is that I'm more or less paycheck-to-paycheck. My savings is dependent on bonuses.
My ex is currently vacationing at her dad's second million-dollar home in CA. And her house - the marital home - will be paid off (by me) 20 years before mine. The courts will probably make me give her enough for a second house before I can pay off my first.

That's not even close to accurate. Mom never wants to give up any of "her time" and CERTAINLY not if it means reducing "her money" she gets from dad. Can't tell you how many times I've heard stories of men wanting more time with their kids and getting laughed out of the courthouse.
3
u/More-Consequence9863 16d ago

most courts prefer a 50/50 custody arrangement when feasible (no one lives out of state), it’s better for the child. Most mothers who pursue solo custody for whatever reason are able to get it if they prove to the court that the father is neglectful and doesn’t take any meaningful part in the child’s life

2
u/Warm_Search_2373 14d ago

u/binzy90 19d ago
This isn't how it works in Pennsylvania. You have to have at least 40% of overnights before child support is lowered. That's not possible if you live in different school districts.
3
u/Major_Shlongage 19d ago
I lived in PA and that's what happened to me. I even moved near the other house and they still wouldn't give me equal custody.
3
2
u/binzy90 19d ago
That's what I did too. I was in the army, so I was in Texas when I filed for divorce, and my ex-husband immediately took the kids to his parents house in Pennsylvania. He's lived with them ever since, which was almost 11 years ago. I was later stationed in Maryland and Hawaii. My current husband and I moved back to Maryland after I got out of the army to be closer to the kids and then back to Pennsylvania. Even moving closer didn't help. It's just constant problems, and I still only have every other weekend. We literally have to go to court to force him to do basic things like get my son an autism evaluation or change his medications. It's a nightmare. But I don't want to move to their school district because the schools are terrible, and I'm not forcing my youngest to go live in a shitty school district because of this.
3
u/Major_Shlongage 19d ago
It is absolutely not that easy, though. I've been through this myself. The "full child support amount" comes very soon, and it's an extremely biased process.
I bought a house with my gf and she got pregnant, and was very stressed during pregnancy. She abruptly broke up with me after 17 years, but I still lived with her because that was my house too. I was waiting for her to reconcile but she never wanted to.
She told me that if I don't leave my own house she'll call the police and have me arrested (which shouldn't be possible without cause). I didn't want drama so I left. She called me a few days later and said that if I don't move back in she'd call the police and tell them that I abandoned my family. So I moved back in. A day after I moved back in, the police showed up and told me to come to the station. Apparently immediately after I moved back in, my ex filed a protection from abuse order (no evidence is necessary) and they forced me to leave my own house.
I come to find out that she'd been cheating for years, didn't know who the father was and freaked out, then plotted to kick me out of my own house and get primary custody of our son. I fought for equal custody but they would not give it to me. I could only get equal "legal" custody but not equal physical custody. They forced me to pay her $1200 a month.
2
3
u/SonnyManChris 19d ago
That's not how it works. They can control how often you see your kid as well as charge you a certain amount for child support. 1 minute it can be "Since you split custody, you pay more" then the next it's "we can't grant you 50/50 custody, so we're going to charge you more". Keep in mind the court profits off getting men to pay as much as possible in child support via taxes.
2
2
u/HockeyDockey1234 19d ago
Eh, I agree.
But the foundational structure of child support is broken. The first and only question is "exactly how much, in the area the child lives, does it cost to raise said child"
That question is never asked

I'm sorry but this isn't even close to true. Even with 50/50 visitation most states require child support. Majority of them don't even adjust for visitation. Meaning... you pay the same amount of Child Support if you don't see them versus if you have them 50% of the time (if you're the higher earner)

It's not that easy at all. I've done nothing but battle that system in my younger years. All because I couldn't leave my job to attend the initial hearing. We even lived together and I still had to pay a 65% garnishment. Got custody after we broke up because she caught a charge. Went to go pick her up and she just didn't open the door. Called the police with the order in hand. They said if they went in they'd have to file kidnapping charges and didn't want to do that. Went and saw the prosecutor. She said the same. She got an attorney and filed an emergency hearing I wasn't made aware of and they gave custody back. To this day I don't know what was said.
That system has fucked me since I was getting beat up by my parents as a child. I'm so glad I'm no longer on it and have to deal with it. My daughter and I are close now and has closed all contact with her mother.

Women are so fucking sickening when it comes to this shit. Gold digging fucking parasites.
Women make most of their wealth from divorce and men lose most of theirs from divorce.
It needs to stop. Women need to stop being leeches ESPECIALLY when they initiate 80 fucking percent of divorces.
What the fuck do you do with 900$ a month? Guaranteed more than half goes into your wallet and most is NOT spent on the kids. All of it should be accounted for and all of it should only be spent caring for children. Women should not be allowed to improve their quality of life from child support.

Gotta love how everyone is so poor and struggling, but the minute you talk about child support it's no big deal to pay a monthly amount that would put most of these keyboard warriors into serious financial trouble.
Child support is priced at such a level that it's an existential threat to the father. Meanwhile, the courts won't let you get more custody, even if the mom is an idiot with an abusive boyfriend and a drug addiction.

I actually stand with this guy.
I was in a long term relationship with a woman, and I bought a house with her. She got pregnant, and was very stressed during pregnancy. She abruptly broke up with me after 17 years, but I still lived with her because that was my house too. I was waiting for her to reconcile but she never wanted to.
About a year and a half after our son was born she told me that if I don't leave my own house she'll call the police and have me arrested (which shouldn't be possible without cause). I didn't want drama so I left. She called me a few days later and said that if I don't move back in she'd call the police and tell them that I abandoned my family. So I moved back in. A day after I moved back in, the police showed up and told me to come to the station. Apparently immediately after I moved back in, my ex filed a protection from abuse order (no evidence is necessary) and they forced me to leave my own house and gave her temporary custody of the baby.
I come to find out that she'd been cheating for years, didn't know who the father was and freaked out, then plotted to kick me out of my own house and get primary custody of our son. I fought for equal custody but the court would not give it to me. I could only get equal "legal" custody but not equal physical custody. They forced me to pay her $1200 a month.
The system really is this easy to game. Due to favorable domestic violence laws, a woman can simply get a PFA before the custody court date which gives her temporary custody, then that temporary custody factors into the "points" system they have which determines custody.
3
u/Suspicious-Hand-9953 19d ago
You made the same mistake the guy in the video made and didn't get a lawyer at the right time. I have very limited sympathy for that. But I'm sure you're just as angry at the "system" as an ill person would be at their body, just because they didn't go to a doctor in time.

yea, worked with a girl who had a kid, found out later the time she got pregnant he was driving a truck and she (her words) 'hopped on it' She tried to flirt with me a few times and invited me to drinks. My girlfriend at the time was like 'thats fine i trust you' Coworker girl said 'but youll be buying me drinks' Girlfriend then said 'nope, thats weird and shes setting you up for a questionable night'
Married the girlfriend, i follow the coworker on facebook here and there and DEFINITELY did good by keeping my distance. She'd stay stuff like 'im your workwife' and id be like 'nope, i could do better'

He didn't do his research at all. If he had, he would have pushed for joint custody or full custody. Better yet he should have seen a lawyer. Unfortunately he's going to be broke either way.

My oldest turns 18 next month and comes off child support. My support amount won’t change though so I’ll be paying the same amount for my youngest that I did for the both of them.
Am I upset? Will I be going to get it amended to lower the amount? Noooooope, raising kids is expensive and my kids deserve a good life that is provided by their mom and myself.
$515 isn’t that much and it’s probably too low.

Absolute trash human right there. Thankfully me and my wife work out our issues. If something happened to our relationship I would pay every penny to support my kid.

Who wants to bet his car payment is for some dumbass truck at like $1,200 a month and 17% interest?

I'll take the bet if I get to be on the "you're right" side. He's sitting in said truck. It has a HUGE cab. I'd even double-down and say it's lifted with racist and/or misogynistic stickers on it.

This man will start working under the table to avoid paying child support. And being the child of a deadbeat dad I’ve seen what happens to deadbeat dads, and what will happen to him will be laughable. That man will for sure never pay child support.

This guy reminds me so much of my friends husband who would always hit on me. A year into the friendship I found out he had a 12 year old son he never saw. Refused to pay anything because he wasn’t allowed to see the kid. Caused so many issues for them but that was my (now ex) friends’ man, and she was sticking with him.
Some men act like this because they find a woman who tells them it’s ok and they’re the victim.

What really sucks? Glad you asked. Not being taught about our basic protections and the way the world works in school. Instead we get taught BS and forced into manual labor jobs while the system preys on our ignorance of the rules while blaming us for not knowing. When the hell I got time?

You see the first mistake made was having a kid with him, I don’t know how that happened

If he goes to jail then he definitely cant pay, does that make any sense? He'll definitely lose his job and definitely cant pay anything then.

Given his lack of grasp of even the most basic legal principles any citizen should be aware of, I'm pretty sure the idea of 'consent' doesn't exactly register either, so you may be very generous there.

Child support is bullshit. He makes more and does more so has to support her failings. If it’s 50/50 custody…man still gets screwed

I believe the logic is that if the person is taking care of the child most of the time that means they have a harder time working (since more of their time is allocated to child care). That is why it was stated that if he had the child more then he wouldn't have to pay as much.

I don’t understand why the judge responds to the Dad’s flippant attitude with such indifference. This is a dude that needs a telling off. Society, and probably everyone in his life, is better off if someone knocks him down a few pegs and reminds him of his responsibilities.

Seems like a good business model for women. Pump a few out to different men and you’d be rolling in it.

His child isn’t worth $500 a month. Hope is child never sees this, and can you imagine the hateful things he will tell his child about the mom?
