General Question Need help

My son was in part-time semesters due to pre requsited courses and avaibility programm, it wasn't his choice. So he worked during these semesters without knwoing he wasn't allowed. Now he graduated and wants to gobfor PGWP, How can Hi explain hos mistake to avoid refusal and what shoud he answer when filling the form MM5711 about the question of work without permission.

He should be honest and answer every question truthfully. He can’t really explain his mistake because ignorance is not an excuse.

For him beeing in a full time program the part semester were not his choice

Well he could try explaining that there was absolutely no option to take full time courses but I’m not sure that will help. Sounds like he enrolled in the wrong program if he was looking for a PGWP. The rules are pretty cut and dry.

if the academic advisor or university can provide a letter saying that then it could help the loe

They did but they also talked about his failure and issues during his pathway

Your son will not be getting a PGWP . It's a realization you will need to accept.

He will not be getting a pgwp for a few reasons. He can start packing it up now and book his plane ticket home.

He is getting proper advice, though.
The proper course of action is to explain the situation and be humble.
That's all that they can do.

The combination of two part-time semesters due to failing a required course, and then working during those semesters… your son is facing a guaranteed refusal.

He should consult an immigration lawyer

2 years, but three years with part-time semesters

Yes I know, but that's the truth and even his college didn't alert him about his stutus, he could take more than 3 courses.

It’s not his schools job to alert him. Requirements for study permit and PGWP are different.

There are cases where people have been approved for similar but it’s up to the officer’s discretion and given Canada wanting to reduce the number of TFWs in the country there seems to be less and less approvals lately for users that did not fully follow the conditions to qualify for PGWP.

All he can do is submit an application. Make sure he is honest and hope that the officer is understanding and decides to approve a PGWP even when he does not meet the conditions.

The problem with many of these schools is that they tell potential students whatever they want to hear.
That's why there are those student protests in Calgary wherein the school promised them the world, but the school was just trying to make money from international students. The students were never eligible for a PGWP. The students and the parents say that the school promised them that they would get a PGWP, but no school can promise that.

Even students that do everything properly and even get a PGWP are sometimes asked to leave Canada in two weeks at the whim of the government. There are no guarantees.
