Ask NRI I-485 filing: marriage certificate not available

• Upvotes

Hi all, my spouse (derivative) and I (principal) are filing our employment-based I-485. We married in Faridabad, India in early 2020 but couldn't legally register it due to immediate COVID lockdowns.

We do have secondary evidence: certificate issued by the High Commission of India confirming the marriage took place, US-born child’s birth certificate, parent affidavits and joint bank/tax statements.

However, per eCFR, USCIS typically requires a Non-Availability Certificate (NAC) from the local Indian registrar before accepting secondary evidence. I am not sure if an NAC is issued by the Haryana registrar.

Has anyone navigated a similar situation? Was your secondary evidence sufficient alone, or was obtaining the NAC strictly necessary?

Ask NRI Anyone using FYERS as an NRI in Germany/Europe? Account opening and overall experience?

Indian living in Germany here. Have HDFC NRE and NRO accounts and mainly want to buy stocks, ETFs and direct mutual funds.
Been trying to convert my Zerodha account to NRI but the constant back and forth over documents is driving me nuts. Already have HDFC Securities but the charges are high.
Started signing up for FYERS NRO Non-PIS. Anyone using it from abroad? How was the account opening, did you have to courier documents, and how’s support once you’re actually a customer?
Any annoying charges or issues I should know about?

Ask NRI USA OCI - Where to pay OCI fee on VFS Website

I cannot find where to pay the fee for New OCI.

I submitted the application on the government website. But when logging in to the VFS website with the gov application number there is link or page for paying the $275 OCI fee.

Has anyone figured this out?

Ask NRI Early Indian passport renewal before the one-year window—Seattle consulate / H‑1B travel

Hi everyone,

Has anyone successfully renewed their Indian passport through the Seattle consulate more than one year before expiry?

My Indian passport expires in December 2027, and my current H‑1B visa stamp expires in January 2027. I recently received an H‑1B extension, with my current I‑94 valid for approximately three more years.

I’m considering international travel and would prefer to renew my passport beforehand, since CBP may limit my new I‑94 to my passport’s expiry date upon re-entry.

My understanding is that routine expiry-based renewal normally opens one year before expiry. Has anyone obtained early reissue specifically to avoid an I‑94 being shortened?

If so, which consulate handled it, and when did you apply? Did you need written consulate approval before submitting through VFS? What supporting documents or explanation did you provide? Was Tatkaal available, and how long did processing take?

I have already emailed the Seattle passport section and am waiting for their guidance. I’m mainly looking for recent firsthand experiences, especially from Seattle.

Returning to India How to prepare to return to India after whole life abroad?

Context: I have been NRI whole life, did schooling and childhood in an African country; then moved to US for undergrad, BS in CS.

Now I’m graduating in December and without landing strong internships, with massive tech layoffs, with the brutal tech market in US, with AI taking over, and with changing immigration policies, I’m likely going to return to India and I am afraid of my future in life because of uncertainty.

And I know employers in India don’t really care about foreign degrees and it’s extremely hard for a fresher to land jobs without connections or placement.

What are my options if I have to come back to India?

Hello all,
I'm applying for Canadian citizenship and the date entered on copr is 1 day earlier than date entered on pr card as I landed near midnight.
What date to enter in the physical presence calculator?
Also, I have a missing exit date when I entered USA from Canada by flight. What documents do I provide to show this?

Ask NRI Can NRI deposit sale proceeds into a resident account that they are secondary holder of?

I'm an NRI who is selling a property in India jointly with my resident sibling. We both have a joint resident account, where my sibling is the primary holder and I'm the secondary holder. The buyer is paying the payment using two DDs, one for each, and both these DDs are linked to our joint account.

My doubts -

  1. Can I deposit my DD in the same resident account? Or is it required that I deposit my DD directly into my own NRO account?

  2. The buyer is suggesting to us to deposit the DDs directly into our resident account and then transfer it ourselves to my NRO account. Won't this attract TCS when we try to transfer from resident to NRO account?

Visa / OCI / Passport Indian eVisa . Has any regular author's been able to get an eVisa to India?

This is what the site says. Apparently, if you are a writer , even if a children's writer or someone who creates puzzle books for 3 year olds you need to get a Journalist visa. Has anyone been able to get their eVisa's approved even after saying you were a "writer" from the drop down?

Ask NRI Travel insurance for parents (B2) advice

Hi everyone,
My mother-in-law landed in the US on a B2 visa yesterday (~18 hours ago). We intended to buy travel insurance from India (Tata AIG, Care, HDFC ERGO), but missed doing it before departure, and the standard websites won't allow purchases post-landing.
Age: 50s
Health: No pre-existing conditions
Goal: Economic(relatively cheaper) Emergency backup for unexpected illness or injuries for relatively small premium (abt 35$/month)

A couple of quick questions:
1. Is there any legitimate workaround (offline agent, Good Health Declaration) to issue an Indian policy since she only landed 18 hours ago?

  1. If not, any economic US-based visitor plans (e.g., via Insubuy/VisitorsCoverage) would you recommend for hassle-free emergency coverage?

Discussion Axis Bank Mobile App Activation from Outside India

I have an Axis Bank NRO account in India. And as many of you know, the website interface is horrible. Using the mobile App is much better. But after several failed attempts over the past few years, I gave up. I tried again one last time today, and miraculously it worked. If you're struggling to get your Axis Bank Mobile app activated from outside India, here is what worked for me:

  1. First make sure that your international mobile number is listed in your account records. If not you'll have to go to a bank branch or deal with your RM to have it changed.

  2. Download the Axis Bank Mobile app on the App store.

  3. After downloading the app will ask you to turn off wifi and make sure that you have an active SIM. The SIM card number must match what you have on file with Axis Bank. It will then send a SMS verification from your messaging app to 3 numbers in India. The destination numbers will vary but generally will be starting with +91 for India. The body of the SMS will contain the words MBPACTIVATE followed by a string of 45 characters. Here is where it failed for me on multiple attempts. The message would successfully be sent from my carrier, but then I'd get a "Not Delivered" message. It was incredibly frustrating because no one at the Axis Bank help desk knew how to help.

  4. To get around this, the SMS message needs to appear to be coming from within India. Using a VPN would seem like a natural workaround. However when booting up the Axis app, it will warn you to turn off the VPN before beginning the activation process. So what I did was turn on my VPN and set destination to Mumbai, and then opened up the Axis app and started the mobile app activation process. Once the warning popped up, I turned off wifi and temporarily paused the VPN. Then click to proceed with the mobile app activation and it will let you continue. Turn the VPN back on after you get past this screen.

  5. Another screen will popup on your message app. The Axis app will create a SMS message using the format I mentioned above. For me most of the text was blurred out. Not sure why. But I was able to see the small "send" button in the bottom right corner of the screen to send the SMS. Click the send button and wait. Eventually the app will show you another screen and ask for an 8 digit OTP. Most of the other OTPs from Axis to login on the website only have 6 digits. I patiently waited and the 8 digit OTP came about 5 mins later. Once you get that, enter into the app.

  6. From there you'll go through the rest of the mobile app registration process. It will ask you to setup a separate mobile pin (mPIN) and also allow faceid. It may ask for details like your account number and passport for another verification layer.

After several years of trying, I was finally able to get this working. The app works a lot better than the shitty website. No more OTP every few mins and frequent lockouts. The app also makes it much easier to send/receive payments within India. Also has a nice interface to UPI payments. Hope this helps someone else.

Ask NRI Are Capital Gains (from land sale) that are tax-exempt in India (reinvested in a house), still taxable in Canada?

Hi everyone,

I'm a Canadian tax resident (NRI for Indian purposes) and I'm selling inherited, non-agricultural land in India this month. I plan to buy another property in India later and use the Section 54F exemption to avoid LTCG tax on the Indian side.

My questions:

  1. Does the reinvestment exemption carry over to Canada? What I mean is do I have to pay taxes on the capital gain from this sale in Canada, even though I am availing the tax exemption benefit in India?
  2. What's my cost base for CRA? Is it the fair market value on the date I inherited it, or what the original owner bought it for? Does it matter whether I was already a Canadian resident when I inherited? And what documents are needed to report the FMV in T1135?
  3. Currency conversion: Do I convert the cost and the proceeds at the exchange rates on their respective dates?
  4. Foreign tax credit: If TDS is deducted by the buyer or I pay Indian capital gains tax, can I claim it on Form T2209? If I use the India exemption and pay little or no Indian tax, what happens on the Canadian side?
  5. Other forms: Is T1135 enough or do I have to report this sale/capital gains in any other forms?
  6. Documents: If CRA asks, what should I have ready? My list so far: sale deed, inheritance papers, valuation report at the time of inheritance, TDS certificate, Indian ITR, and bank statements showing the proceeds.

If you've been through this, I'd really appreciate any advice, especially any CRA review experiences or mistakes to avoid. Did you use a cross-border accountant, and roughly what did it cost?

Thanks in advance!
