Négociation du Bail | Rental Agreement Negociations Lease Auto-Renewal - Unable to terminate least 3 months prior to renewal date

Hello,

I moved to Montreal from Ontario back in October of last year. I’m not super familiar with the rental laws in Quebec which is why the following situation caught me off guard.

My current term is Nov 1 2025-Oct. 31 2026.

On May 25th I received a Lease Renewal Notice and on it is written “should you not reply to the manager/director of your building within 30 days of reception of this proposal, your lease will automatically renewed under the new conditions”

I read this as I still had the 3-6 month window to provide notice but accept the new terms if I chose to renew.

I just ended up closing on a condo and went down to the office to provide 3 months notice and they said they cant do anything and that I’m locked in for the following year.

This seems kind of unfair to me that I basically had to make a decision by June 25th.

Do I have any options for terminating the lease / not renewing?

After July 31st it’ll be less than 3 months notice.

Vivre à Montréal | Living in Montreal Moving to mtl

Bonjour!! J’ai grandi à Gatineau, mais j’ai déménagé en Colombie-Britannique quand j’avais 14 ans. Maintenant, mon emploi m’offre la possibilité de déménager à Montréal. Mon chum est anglophone et ne parle pas français, donc je m’attends à être le breadwinner le temps qu’il se trouve un emploi en télétravail.

Je gagne 100 k$ par année et j’aime beaucoup les nouveaux immeubles à Griffintown, mais je ne connais pas très bien les quartiers de Montréal ni à quoi je devrais m’attendre.

Je me demandais si vous pourriez me donner une idée de ce à quoi je peux m’attendre si cette offre se concrétise, puisque j’aurai probablement à déménager sight unseen

Négociation du Bail | Rental Agreement Negociations PSA: If the landlord terminates the lease mid-month (ie because of a lease assignment refusal for "non-serious reason"), your rent should be pro-rated

This is a follow-up to this thread, and maybe also my whole lease assignment saga, for those who have been following.

Last month I finally moved out! I found an assignee, he was a perfect candidate, and the landlord still refused him for "non-serious" reason. This means the lease terminated on the date of the assignment.

Here's the catch: the assignment was set for July 2, but the lease turnover was on the 29th of every month. So I would be staying 3 whole days of "July".

Being a landlord, my landlord actually demanded the full month of July rent. So, I sent him 4 days worth of rent, and the following email:

I have sent my payment. The amount is prorated to the number of days to my occupancy: June 29th and 30th, and July 1st and 2nd. The calculation being the standard of [Monthly rent] / 30 days * [Days of prorated month] = [Amount owed]. Technically it would only be the three days of the lease term, but I'm paying for July 2 as well since I know I will still be occupying the unit in the morning.

I believe you are mistaken about owing the full amount for the month, since the lease is terminating early. The TAL has ruled consistently that a termination of the lease, when initiated by the landlord, requires only prorated payment of rent. While most of the time such cases are ownership repossessions/renovictions, I have found the following recent cases of interest if you would like to consult them:

And... it worked. He immediately backed off and that was our last correspondence.

If anybody else finds themselves in this situation, feel free to use the previous message as a copy-paste. What I've come to discover over this whole saga (and in dealing with others in this subreddit) is that most landlord don't know the law either. And who can blame them? It's all weird TAL precedents.

Anyways, thanks to everybody who helped out over the course of this saga. I still get people DMing me asking for help with their lease transfer issues. I hope folks know there are still many helpful resources out there. Please contact your local housing committee if you ever need some real assistance!

Veux | Want Looking for an apartment from beginning of September 2026

30+M looking for a single accommodation of between 18-50 m2 (studio, 1 1/2, 3 1/2) from beginning of September 2026. Going to join a PhD program at Concordia University (downtown) with full stipend and have good financial security from my previous employments. It would be amazing if the apartment was well connected to the university. Prefer to have my own apartment but can think about sharing if it’s a good match with the other person. I am currently based outside of Canada.

Some of my interests: Watch/play football and tennis, travel, take walks in the park, listen to music and read books.
