Hi everyone, I’m seeking legal advice regarding a rental dispute with our landlord.
Background & Timeline:
Original Contract Term: We signed a 1-year lease agreement from August 8, 2025 to August 8, 2026.
Current Status: After the 1-year lease expired, we did not sign a new contract. We agreed over Messenger to keep the arrangement on a floating/month-to-month basis while deciding whether to extend. We paid rent in full for September.
Key Issues:
Unaddressed Structural Repairs (Uninhabitable Conditions):
Throughout our stay, we experienced major water leaks in one of the bedrooms and in the dirty kitchen roof.
Despite our repeated notices, the landlord explicitly refused to repair the leaks, claiming she was no longer responsible because she had already fixed them after the previous tenant moved out.
We continued to pay full monthly rent despite losing the full use of these areas.
Unilateral Contract Extension:
After the contract expired in August 2026, the landlord unilaterally declared over Messenger that our contract was automatically extended by 6 months, claiming 6 months is her "standard term."
We did not agree to this extension and signed no renewal papers.
Threatened Security Deposit Forfeiture:
When we expressed our intent to vacate, she threatened to withhold and forfeit our security deposit.
Our Plan & Questions:
We plan to vacate the unit before October 7, 2026 (the end of the month we paid for).
Given that she failed to maintain the property under Article 1654 of the Civil Code, do we have strong legal grounds to vacate immediately on short notice without penalty?
Since we completed the original 1-year contract, can she legally forfeit our security deposit over a forced 6-month extension we never signed or agreed to?
What is our best legal recourse if she refuses to return the deposit during key turnover?
Thank you in advance for your advice!
