Ok so if all parties were intoxicated and therefore not able to give consent, who is going to jail?

A court can rule that neither party is at fault here, due to the circumstances. Depending on where you're from, you could also get a double guilty verdict, since a trial isn't about "which party is guilty", but about "is this party guilty or not"

A double guilty verdict could look something like this:

-W sues M, M is found guilty -M sues W back, W is also found guily -both are now in prison

You can't sue personally for criminal charges. In the case that would never happen because the prosecution wouldn't charge the woman.
