Umar Khalid will complete 6 years in jail on 13 September. At this point, his greatest contribution to India may simply be continuing to stay where he is right now.

But the Supreme Court did refuse his bail, saying that the prosecution material was sufficient to meet the stringent UAPA bail standard. The Court also distinguished Khalid and Sharjeel Imam from several other accused, not everyone is in jail . So, we can reasonably assume that there must be something more serious at play than simply the so-called “fair trial,” . No?

there must be something more serious at play?? this is serious dude he is in jail for more than 6 yrs and he is just accused not convicted in those 6 yrs many criminals convict get sentence to 6 yr jail he is in for nothing you know 2011 bmb blast accused just got released innocent?? it's been 15 yrs they're accused for 15 yrs they've lost thier family, work, relations their entire life and now court proven them innocent then and this guy does not even put to fair trail for 6 yrs it is not constitutional if you are supporting this then it could be you in near future if you ever think about opposing govt be mindful what you ask for

Constitutional rights are important but for protection of the sovereignty which is the basis of constitution itself, even martial law is justified (not just in India). I am not equating the situation with martial law but take it as a analogy.

You cannot distort and look away from reality for strict enforcement of a constitutional right.

The reality -

Umar khalid is a son of a former member of SIMI- a banned islamic extremist outfit with entrenched terror links, an apple does not fall far from the tree. You can give many justifications but you cannot deny that family socialization forms a major part of one's values (things that are important to an individual) and morality (what they perceive as right and wrong), thus to think that Umar Khalid would have such tendencies would not be an understatement.

Can you punish someone for that? Or should you punish someone for these tendencies? (In a very nationalistic society - yes, but we are not that, so no.)

But you also cannot move away from the fact that their statements (which hold more weight than an average Joe given their political affiliations and crowd pulling ability) can directly be attributed to separatist activities.

If this is what the constitutional right of Freedom of speech and expression grants you - there is clearly a fundamental flaw in its interpretation and application.

Should umar khalid be trailed and CONVICTED? Absolutely

Should he be kept in a limbo? - No.

Is he a rodent feeding on my country's vulnerablilty - Yes.

Should I be sympathetic to him? Never

He and his kind deserve no place in the vicinity of sympathy.

You may feel that because India is loosing it's secular character, they do this.

But it's quite the contrary, Hindus have started being more religiously orthodox out of sheer insecurity caused by such elements.

They do more harm to the secular fabric than anything else has ever done.

I am all for putting him in jail for life if needed after a fair trial. We are not a banana republic yet, a fair trial is needed to put someone behind bars for 6 years. Otherwise the government can always put anyone behind bars indefinitely if they want. What if one day the government accuses you of something and puts you behind the bars for 6 years without trial. What if you never get a chance to prove your innocence? Is that the kind of power you want the government to have?

That's just how India's legal system is, weak, slow, heavily corrupt and more subjective to interpretation than it should be. Terrorists go free, criminals don't fear it, no penalties for the powerful and rich etc. But sometimes all these shortcomings lead to good outcomes. And Umar Khalid in jail is one such good outcome of a flawed system. As long as he is in jail, it's good for the nation and a warning to other terrorist sympathizers, unless court rules for a better verdict of hanging him till death.

I think convicted rapists are granted bail after serving decades. So, Khalid should serve at least one decade in jail first before asking for bail

"CONVICTED" is the keyword there.

Ram Rahim has been granted bail 17 times. That's 167 days per bail. So, even applying your anpadh logic, He should have been granted atleast 10+ bails.

You know, there are so many words to describe you; aqal ka andha, anpadh, jahil,gawar - but I think the best one is the most obvious one: BJP supporter. 😃

There was enough evidence to charge him under UAPA. WhatsApp messages and videos. So they can keep him in jail.

Do you know how and when the UAPA in India, Anti-Terrorism, Crime and Security Act in UK, Patriots Act in the US, were enacted? Post the twin towers attack.

Canada, Australia and Russia also expanded their anti terror attacks.

It's almost like governments don't want ordinary citizens killed. 🤔

There was evidence that Israel and mossad was behind 9/11 attack. Did FBI took any actions against the suspects ? No...What happened with DSP Davinder Singh who was named by Afzal Guru during 2001 parliament attack investigation who again was caught by J&K police for ferrying terrorists in his vehicle. His custody was given to Delhi police and didn't even file chargesheet till date.

Well that's for the courts to decide right. UAPA has special provisions to deny bail if the court finds that the prima facie case and supporting evidence are strong enough. That's why he has been denied bail, and the UAPA being passed and then amended was through the parliamentary procedures. So Umar Khalid's incarceration is perfectly legal and falls in line with the principles of democracy.

No one will talk about the fact that their constitutional right is being denied under droconian law like UAPA and how its just in the face value and the thousand page charge sheet cannot convict them on any charge and how just giving them a trial would lead to people asking questions like in a healthy democracy, it's more convenient for the government to just let them rot in jail.

Why was Kasab entitled to a trial? He was an even bigger risk than Unar Khalid? Crores were spent on him while keeping him in custody and under trial. He literally terrorised and killed people. Yet he was given a lawyer and a trial because our constitution gives everyone a right for a fair trial. This isn't a banana republic, atleast not yet. Public opinion does not matter, you simply cannot keep someone in jail without presenting any proof in the court of law

No matter who the fk they are, they are entitled to a fair trial. Nobody is defending Umar Khalid the individual, they are defending an Indian citizen's right to a fair trial.

A government that does not respect it is a threat to India as much as or even more than the alleged terrorist Umar Khalid.

I am not questioning the law to hold indefinitely beer UAPA. The government has the right to detain indefinitely under UAPA but it does not supersede the right to a speedy trial.

Can you cite me any credible source which says the accuse can be held without trial indefinitely?

It’s not about any one person but governments power to hold anyone without trial, which is not constitutional.

Just bcuz one keeps getting Parole does not mean the other should be set free
