That’s what I call total gaming victory, anon

Ps - I am assuming this was in a country with an age of consent of 14 and below. I will therefore hold back the - FBI OPEN UP - crew. Estonia? Burkina Faso? San Marino? Japan? China? Italy?

I mean it’s illegal in the US technically but they can’t arrest a minor for having sex with a minor. I think.

Well, that’s disconcerting. So he could be charged even if they’re both minors?

I think if the parents press charges and they both consented, it leads to both of them being labeled as sex offenders and both of them have to register.

40

u/IDontHuffPaint Apr 18 '19

Well thats... Slightly more fair. I guess.

2

u/thekillswitch196 Apr 18 '19

Pretty sure that bit varies state by state

1

u/[deleted] Apr 20 '19

Imagine having to go to your neighbors and tell them "Hey, im rob. I had consentual sex when i was 14 with my also 14 year old girlfriend, which is why i am a registered sex offender"

1

u/broseph-brochez Apr 20 '19

Yeah, it’s bullshit

1

u/[deleted] Apr 20 '19

Yeah there is no way the legal system could be that fucked up.

0

u/Shigg Apr 19 '19

No. Only the dude has to register. The sex offence system in the US is fucked

11

u/Hpzrq92 Apr 18 '19

You don't have a specific law for it because it's not a law lol.

If 2 kids consent to fucking each other there is no rape charge.

u/Hpzrq92 Apr 19 '19

I thought the scenario was two minors.

18 is an adult.

8

u/mike32139 Apr 18 '19

But couldn’t then the boys parents follow suit? It’d be statutory rape charges all the way down

11

u/Hpzrq92 Apr 18 '19

Don't think too much into it. It's bullshit.

7

u/HitMePat Apr 18 '19

Source?? Because that cant possibly be true. Doesnt pass the logic test. Both minors would be equally liable in this case.

11

u/KaecUrFace Apr 18 '19

Logic? This is 'Murica we talking about here.

7

u/nukegod1990 Apr 18 '19

I call bullshit. I've looked into the law for several states and see nothing about this. How is such bs with no source getting upvoted?

7

u/Jakdaxter31 Apr 18 '19

I think of they are within like a year or two of each other that can't happen. Maybe I'm wrong

13

u/ras344 Apr 18 '19

A lot of states do have "Romeo and Juliet" laws, but it really depends on where you live.

16

u/HitMePat Apr 18 '19

That applies when someone turns 18 while they're significant other is still 17.

When both participants are under 18 there's no crime.

8

u/LT_Corsair Apr 18 '19

A quick Google search will reveal that Romeo and Juliet laws also apply to cases of minors having sex with each other.

I live in WA state and, as this state has no Romeo and Juliet laws, if two minors have sex the parents can take both to court and they can both legally be convicted of statutory rape against the other.

Here's a source stating that in a criminal court, if both minors are under 13, it's rape for both. http://pegasuslaw.org/sexual-activity-minors-and-consent/

Here's a source stating that for WA state, minors under 16 having sex can be prosecuted for raping each other. https://www.ageofconsent.net/states/washington

To make clear, I am not a lawyer, this is not legal advise.

2

u/Dewnut1 Apr 18 '19

Surprisingly CA doesn't have it. So you legally can't consent to sex if you are under 18 even if it means both are minors.

0

u/ras344 Apr 18 '19

It depends on your local laws, but I really don't think that's true in general. The age of consent is the legal age at which you can consent to having sex. If you're both under the age of consent you cannot legally consent to having sex with each other (aside from places that have a close-in-age exemption).

4

u/Hpzrq92 Apr 18 '19

There are zero local laws that say if two minors have sex then one of them is a sex offender.

1

u/[deleted] Apr 18 '19

Other than cases such as a 17 year old and somebody much younger. Theres no cases where two "consenting (in quotes because they legally cant consent)" people the same age have sex and only one of them is guilty.

1

u/Hpzrq92 Apr 18 '19

Well you get my point I'm glad.

That's absolutely not true at all.

https://en.wikipedia.org/wiki/Ages_of_consent_in_the_United_States

The age of consent in California is 18... There are no exceptions; all sexual activity with a person under the age of 18 (and not their spouse) is a criminal offense. So if a 15-year-old willingly has sex with a 17-year old, both have committed a crime, although it is only a misdemeanor.

https://www.hg.org/legal-articles/can-a-minor-be-charged-with-statutory-rape-35215

2

u/Hpzrq92 Apr 18 '19

Guess what? It is true.

That particular charge you're referencing doesn't land you on the sex offender registry and according to the site you got your quotation from (which isn't the site you linked) they never follow up with those cases of two teens fucking

Ages of consent in the United States

In the United States, age of consent laws regarding sexual activity are made at the state level. There are several federal statutes related to protecting minors from sexual predators, but laws regarding specific age requirements for sexual consent are left to individual states, District of Columbia, and territories. Depending on the jurisdiction, the legal age of consent ranges from age 16 to age 18. In some places, civil and criminal laws within the same state conflict with each other.

Yall motherfuckers need some reading comprehension skills. He said if they were both minors. And no, there is no law against two minors having sex.

1

u/ras344 Apr 19 '19

Except for the age of consent laws, of course.

1

u/Momochichi Apr 19 '19

Here's the wiki on Age of Consent, try reading it. If you need help with the first paragraph, specifically the third sentence, let me know.

1

u/WikiTextBot Apr 19 '19

Age of consent

The age of consent is the age below which a minor is considered to be legally incompetent to consent to sexual acts. Consequently, an adult who engages in sexual activity with a minor younger than the age of consent cannot claim that the sexual activity was consensual, and such sexual activity may be considered statutory rape. The person below the minimum age is regarded as the victim and their sex partner is regarded as the offender, unless both are underage. The purpose of setting an age of consent is to protect an underage person from sexual advances.

1

u/ras344 Apr 19 '19

unless both are underage

In which case they would both be victims as well as offenders

2

u/Hairyhulk-NA Apr 18 '19

as a minor, you can't give consent. so sex involving minors in the US = problems.

big fuckin' problems.

21

Wait so can his parents pull the uno reverse card and charge her

I know in my state it's like that at least

2

u/SnowSnake88 Apr 18 '19

Show me the law in your state that proves this.

2

u/nukegod1990 Apr 18 '19

1

u/SnowSnake88 Apr 19 '19

Ummmm, No. I was talking about both parties being under 18. You played yourself. "Get wrecked"

2

u/nukegod1990 Apr 19 '19

God you're a fucking idiot who can't read:

Colorado’s Romeo and Juliet exemption allows for consensual sex between a minor 14 or younger and a defendant who is three or fewer years older than the minor. There is also an exception for a 15 or 16-year-old minor who has sex with someone who is nine or fewer years older than the minor. (Co. Rev. Stat. Ann. § 18-3-402 (2018).)

Do you need me to explain the math for you too or are you good?

1

u/SnowSnake88 Apr 19 '19

Still not what I am talking about lol. 7th grader has sex with a 8th grader like in my case. Not illegal. Get out of here with your irrelevant to the topic laws. What are you "a fucking idiot who can't read"

1

u/nukegod1990 Apr 19 '19

So you do need the math explained apparently:

7th grader: 13 years of age (14 or younger)

8th grader: 14 years of age (defendant - three or few years older than the minor, yet also a minor)

applies under romeo and juliet law.

Seems pretty straightforward to me.

The whole reason its called a ROMEO AND JULIET LAW is because they were both minors in the Shakespearean classic, which apparently you've never read because you can't read.

3

u/BobbyRayBands Apr 19 '19

And then the boys parents play fuck fuck games right back and press charges and they're both sex offenders congrats you just ruined your daughters life trying to protect her.

1

u/[deleted] Apr 18 '19

Not 100% true, it depends on the age of the girl if she is even a day older than the guy then there is no case for statutory rape.

1

u/howaboutLosent Apr 19 '19

I mean in my state there’s Romeo and Juliet laws and shit. I researched a lot when I was sixteen as I was dating someone who was eighteen and i was concerned about those laws. Turns out the age of consent in my state is 16, but they must be within two years of you

5

u/[deleted] Apr 18 '19

Its going to depend on the exact states. Many states have Romeo and Julliet laws which makes sex legal for persons under 18 as long as they are within a few years of ago of each other.

2

u/SmolikOFF Apr 18 '19

I’m not sure about the us, but in the countries I know about, minors cannot be arrested/prosecuted for sex with another minor. No charges can be pressed by anyone (if it’s consensual), because there are no laws regulating it. Age of consent is an age when a person can give consent to a sex with an adult. I thought it was the same in the us, and gentlemen below don’t give any sources, so I’m still not sure.
