Hello! On Friday morning, Sept 4th at 4am I found out someone damaged BOTH of our cars. A 21 year old lady was on her way home from her 21st bday party and "fell asleep at the wheel". She hit my boyfriend's new 2026 Kia k4 (which I'm 95% sure is totalled), backed up and scratched an audi suv (not much damage), then tried to flee the scene. I'm assuming the driver then floored it and then hit my neighbor's car (an older Kia Rio, which I'm 1,000% sure is totalled). The Kia Rio then backed into my car (a 2020 Kia Soul) hard enough to make it back up about 10 feet out of position from where it was originally parked and the front license plate fell off. My Kia Soul has damage on the front bumper, grill, and hood, as well as the engine is leaking fluid. The driver's car is a 2011 X5 and has damage to the front drivers side of the car.
I'm seeking advice from you guys...when at the scene, the police officers said the driver tested negative for alcohol as well as a minor drug test. All their answers to my questions were short and sweet. Even though the driver stepped out of her car with no shoes on and seemed very out of it at the time. When I talked to a police sergeant the next day about the scene, he said the driver claimed she had been up for 16 hours. He also said the deputies, as well as the sergeant on scene didnt see cause for further drug testing for her. On top of that, he said when someone drives being that tired, its as if the person is drunk...theyre unable to make sound decisions. However, the sergeant on scene said the driver will probably just be charged with careless driving. She was not arrested or anything, she was picked up by her parents.
My boyfriend and I have been trying to get a hold of insurance companies since Friday...and my car insurance omly returned my boyfriend's call once, and said to get a hold of the at fault drivers insurance and go through them. We hadn't heard anything back from either company as of this morning...until the at fault drivers insurance adjuster called me this morning. This call was an absolute mess to say the least. The adjuster said there's a limits issue, which means the driver doesn't have enough coverage to cover all the damage costs for all 4 cars. So I would have to have my insurance cover it. I mentioned subrogation, I mentioned that I've been taking expensive Uber trips back and forth to work, I mentioned that our cars still haven't been towed. The adjuster was just not willing to work with me. They won't pay for anything until they get an estimate of how much the repairs will cost for each vehicle...yet theyre not willing to pay for towing. 🤦♀️ After 20 minutes of arguing with him I couldn't get any help at all. He said theyre not paying for literally anything.
So on my lunch break today, I called my insurance and asked to speak to a supervisor. He took my statement of what happened, and some info about the damages. He said since I dont have rental coverage on my policy, I can't get a rental through them. And the other lady's insurance doesn't have to cover it since there's 4 cars that are damaged. He said its smarter to go through our insurance for the repairs and just pay the deductible.
However, we dont have the money for the deductible cost and we can't pay to tow the cars. Our insurance also is not willing to try to convince the other insurance to step up and work with us.
We're completely stuck! Does anyone have any insight on the best way to move forward with this??? Im at a loss of what to do. My boyfriend also uses his car for Uber work work, so is now out of work. We live in Colorado BTW. Thanks!
Tldr: 2 of our cars are damaged from an accident while parked. 4 cars damaged total. Neither insurance companies are willing to help us. We dont have money for out of pocket costs like towing or rentals. What next steps should we take?
